Vel on 28-03-2018 and discussed the pending issues
of executives of Finance/Accounts in Kerala. While discussing the financial performance of Kerala
circle, PGM-F
congratulated all the executives of
Finance/Accounts department in Kerala Circle on liquidating all
the dues of outstanding Target . All
BAs have been performing in a much better way compared to the Previous
financial year . Some BAs have already achieved 27
out of 27 segments. He mentioned that in the Project Aiswarya also the performance of Kerala
circle is at the topmost position . We reciprocated thanks and suggested to
honour all the officers who are behind in achieving this remarkable targets, as a token of
motivation . He shared the suggestion and assured to explore this
motive. It is expected that Kerala circle will be at the top profitable
slot in this F.Y also with an approx
profit of Rs 300 Crores Regarding HR issues , we submitted that in the last
CEC meeting of AIBSNLEA Kerala, a common feeling rather displeasure
has strongly been arisen that the
issues of the members belongs to the accounts vertical are not getting
resolved especially in the resent past compared to those being resolved with other
circles . We requested to fill up all the vacant AO/CAO post
through LA arrangement . PGM assured to do the same as and when BA
head request for the same . We request all DSs to
take up the matter with BA heads and forward requests to circle office
immediately. We requested to consider the request transfers of
DGM_F/AO and JAOs. We specifically requested the cases of Com.Sivasankaran
Nair DGM_F , Kottayam to Ernakulam , Com.Parthan AO from
Palakad to Kannur etc .
PGM assured to consider the requests after the closure of the F.Y 2017-18 . PGM-F assured to consider the transfer request of LICE
2016 JAOs on completion of two years possibly without rotational transfer
since new DR JAOs will be inducted . |

News Meeting
with the officers of DPE: GS

met Joint Secretary (DPE), Director (DPE) and Assistant Director (DPE). We requested Jt.
Secretary (DPE) to reply DoT regarding the relaxation in the affordability
Clause of 3rd PRC recommendations to BSNL as the relaxation has been granted to some PSUs like FCI & others. We
also requested to consider the recommendations of the BSNL Board for
implementation of 3rd PRC with 15% fitment benefits in BSNL.
Jt. Secretary (DPE) after detailed discussions assured to reply DoT at the
earliest. He also mentioned
that DoT being the Administrative Ministry of BSNL should take up the matter
with Union Cabinet for relaxation based on the recommendations given by the
BSNL Board for relaxation in the affordability clause. He assured that the
reply will be given to DoT with the approval of Hon’ble Minister of Heavy Industries so that he may be
aware of the issue when it is taken up in the Union Cabinet. |

Associations vehemently opposed the recruitment of JAOs in BSNL to weaken the
strength of Finance Wing in BSNL The Merit List has
been prepared on the basis of Circle-wise merit position, as per the choice
of Circle opted during registration by the provisionally selected candidates
and as per the category-wise (OC, OBC, SC, ST & PWD) for the net vacancy
position/qualified candidates, available in the respective Circles. The concerned Circles
have been requested to issue offer of appointment letter to the provisionally
selected candidates for the post of JAO in BSNL |

: CHQ News Successfully organised “Lunch Hour demonstrations” today
against operationalization of the Subsidiary Tower
Company: At
15.00 Hrs all the Central leaders of All Unions and
Associations of BSNL hold a meeting and congratulated the BSNBL employees for
their active participation in the demonstration. Further, decisions were
taken to continuously protest against the arbitrary decision of Government
for formation of BSNL’s Tower Subsidiary Company. Future course of agitation
programs are decided as under: 1.One day Dharana on 12.04.2018 at BSNL Corporate Office, Circle
and SSA Head Quarters to protest against the Government decision in 2.On 19.04.2018 at all the
Circle HQs “March to Governor House” will be organised and a Memorandum will
be submitted to His 3.All India National
Convention will be organized at New Delhi on 8th or 9th May
2018 subject to availability of Mavalankar Hall at
New Delhi 4.
In case the Government do not roll back the BSNL’s Tower Subsidiary,
Indefinite Strike will be organized. All
the Circle / District Secretaries are requested to
hold joint meetings along with their counter parts to implement the above agitational program in a successful manner. |

23-03-2018 :CHQ News Creation of Tower Subsidiary of BSNL - lunch hour
demonstrations on 27-03-2018, against the government's attempt to operationalise the Subsidiary Tower Company A meeting of All Unions and Associations of BSNL (AUAB) was held
yesterday the 22nd March,2018. Representatives of
BSNLEU, NFTE, SNEA, AIBSNLEA, FNTO, SEWA BSNL, BSNLMS, BSNLOA participated. The meeting reviewed the developments
that had taken place after the meeting held on 24th February,2018 with the Hon'ble MoSC (I/C). It is observed that the government is moving
fast to operationalise the Subsidiary Tower Company
from the 1st of April, 2018, totally ignoring
the strong opposition from the entire employees of BSNL. In view of this, the meeting decided to launch agitational programme to stop the same. Decision is taken
to conduct "lunch hour demonstrations" on 27th March, 2018, in front of Sanchar Bhawan,
New Delhi, as well as at circle and SSA head quarters throughout the country.
A memorandum, opposing the Subsidiary Tower Company will be submitted to the Hon'ble MoSC(I/C) at Sanchar Bhawan. Same
memorandum will be submitted to the respective
CGMs and the state governors, to be forwarded to the MoSC
(I/C). All the Circle Secretaries stationed at New Delhi are requested to assemble at Sanchar Bhawan,
Ashoka Road along with their members to participate
in the demonstration. Neighbouring Circle Secretaries like UP (West), Haryana
and Rajasthan are requested to participate in the
demonstration at Sanchar Bhawan, New Delhi along
with as many as maximum possible members to make the program a grand success. Rest all the Circle / District Secretaries are
requested to observe the Lunch Hour Demonstration on 27.03.2018 as
scheduled by All Unions and Associations of BSNL. |

21-03-2018 Today GM (A/HR) , Shri. Robin Poddar ,
called a meeting with AIBSNLEA . CS Com.Shaji ,
CVP Com.Binu
and DS TVM Com.Rajan attended the meeting , started at 9.30 AM. Both DGM (HR) and AGM (HR) were
present during the meeting. Discussion agenda was
on long stay rotational transfer of SDE/JTO. GM suggested recording our
opinion on the matter. We categorically stated that AIBSNLEA is not for
transfer of executive for the sake of transfer especially while sufficient
LICE/DR JTOs are available with every BA. Regarding bringing
back of SDEs went on long stay in 2016
, we strongly demanded to bring
back of all the SDEs on completion of 2 years of their service in the currently working BA . We requested
to consider completion of two years of service until 31st August 2018 , since some executives were relieved only in August
2016 due to administrative reason. Against the SDEs coming back to Parent BA,
equal number of SDEs may be shifted from long stay list for the smooth
operation of all BAs. The SDEs shifted may be posted
to nearest BAs. No need to shift any SDE from any other BA
where in long stay list in not operated in 2016. Operation of JTO long
stay list: we strongly recorded that
while sufficient JTOs are available with all BAs, unnecessary shifting of
JTOs is not needed.
If at all JTO long stay list is operated on compulsion from some
corner with ulterior motive, it will deteriorate and imbalance the
functioning of BSNL. Moreover, in the incipient sick stage of BSNL spending money irrationally will harm BSNL further
and AIBSNLEA will stand against any such move. We requested to
publish the transfer requests in intranet for the feedback of any anomaly. He
assured to do it. Other issues like righteous awarding of
FR 22 (1) (a) (1) pay fixation to the erstwhile O-JTOs , Filling of 4 JAO
Vacancies etc were also discussed . He assured to look into the matter
favourably. GM Listened all our
arguments and appreciated all our points/views. He assured to share all our
views to CGMT. Meeting lasted for one and half hours. |

is reliably learnt that DoT has directed BSNL managemnt to hold BSNL Board meeting with
in three days to ratify the DoT order regarding appointment of Shri Amit Yadav,
Jt. Secretray (Admn), DoT
as CMD, BSNL TowerCo and to make it operational
from 01.04.2018. Now, BSNL Unions and Associations will decide further course
of action shortly. |

Com.Prahlad Rai ( To take up with CGM-Legal , DirHR
and CMD BSNL) on the very righteous awarding of FR 22 (1) (a) (1) pay
fixation to the erstwhile O-JTOs Subject: A typical example of a section of
BSNL Management’s unaccountability in spending BSNL money in vain even now on
the declared Reference: (1) WP(C) NO-7723/2010 and 13 connected
cases Judgment from Hon’ble high court Kerala. (2) The Hon.
Supreme Court judgment on SLP 4583/2012 dtd
13/01/2012 Respected Sir, Kindly recall the discussion we
had on the matter in subject at the meeting with you on 27-02-2018 where in
your kindness directed to write corporate office about the genuinely of the
case. It seems that no communication
has happened so far from Kerala Circle. After officiated posting, the
erstwhile O-JTOs had been granted pay fixation on FR 35 .
Since they had totally completed all the recruitment eligibility norms, they
were eligible for FR 22 (1) (a) (1) fixation. Since the employees were
negated legitimate pay fixation, they approached Ho’ble
High court of Kerala in 2005 as WPC : 14 WP(C) NOs 28349,35263,...35938/2005
&2006 . All these petitions were disposed favourable to petioners stating they are eligible for FR 22 (1) (a) (1)
fixation. BSNL Kerala appealed at Ernakulum
HC Division Bench through WA No:1735 of 2006 and
connected cases . HC Judgment released
in June-2007 directed to maintain FR 22 (1) (a) (1) fixation. Due to the Implementation failure Again WPC 3791/2007 and 13 other cases are
filed by the affected employees to Ernakulum HC DB .
In the very next year 2008
all these 14 cases are transferred to CAT,EKM TA Nos : 84 to 97/2008 . On 15/07/2009 CAT, order upheld the
Ernakulam HC SB judgment in 2006 that FR 22 (1) (a)
(1) granted was righteous. BSNL Kerala again Appealed at Ernakulam
HC DB through WPC Nos : 7723 23850 , 1735 of 2010
and OP (CAT) No:2107 against TA Nos : 84 to 97/2008
. On 15th September 2017 HC judgment released,
after 7 years of legal analysis, very much gendable
to the affected employees. The very
strong judgment ( Ref:1) concluded
that “ The finding rendered by the
Tribunal that fixation has to be effected based on FR 22 (1) (a) (1) “ is
perfectly within the four walls of law and is not assailable ” ( assaile
: to attack with arguments) ` Parallel to affected people in
Kerala, some other affected employees went to PCAT Delhi for FR 22 (1) (a)
(1) fixation OA No:
1282/2010. PCAT also upheld Kerala CAT orders TA 84-07/2008
. But, through various appeals
the case escalated to Hon’ble Supreme court of
India by BSNL in 2012 as SLP(C) NO:
4583/2012 ( Ref:2) and as usual BSNL SLP failed against FR 22 (1) (a) (1)
granting. SC also upheld Kerala Tribunal’s order. Sir , Out of more than
10 various court judgments ,
known to us, right from CAT to SC of
India on the very righteous FR 22 (1)
(a) (1) fixation for erstwhile O-JTOs , BSNL could never succeed to negate
the FR 22 (1) (a) (1) fixation to FR (35) . In the series of judgments , the last one On 15th September
2017 from the HC of Kerala ,Ref:1, was
a very strongest one verdict that “ the verdict cannot be
attacked further with arguments”
. Thus, so far BSNL could spend
only millions of rupees , in vain , to fight against FR 22 (1) (a) (1)
fixation It is a fact that BSNL cannot
take back the additional payments if any based on the SC judgment in State of
genda and Ors. Vs. Rafiq Masih (White Washer) in CA no. 1L527 of 2014 on recovery
of excess Payments made to employees Now, apparently, Kerala Circle is
directed to file SLP against Kerala HC judgment Ref-( 1
) in all the 14 cases. It would consume multiple crores
of rupees to fight against all the 14 cases at Hon’ble
SC and may take years and years of fighting . On common logical thinking
, here also fate of BSNL would
be the same in line with the last more than 10 back to back failures at various courts
including SC of India. Sir , Being these are facts , we cannot digest the
intention of a section of BSNL Management’s genda
behind spending millions of rupees as advocate fees in SC especially in the
stage where in BSNL is declared as “incipient
sick “ unit. Moreover , Its learned that before going to file SLP again to SC of India ,
legal opinion is not sought form
senior advocates who were already involved in the case. Hence, we request your good office to seek a second legal opinion
from a senior advocate before going with this SLP as Kerala Circle doing in
many cases. In addition, we request your kind office to
strongly write corporate office to rethink the matter of going ahead
with another SLP for another failure worth corers of rupees. Otherwise,
AIBSNLEA will stand for recovering this huge amount of money spending at SC
in the name of this SLP from the responsible sections of Kerala Circle and

of 2nd CEC The Second CEC of the
7th Circle body has been conducted on 16 & 17th of
March 2018 at RTTC Trivandrum in an exuberant manner . The meeting
started with silent prayer . All
CEC members were welcomed by DP Trivandrum. All the Service/HR matters were fruitfully transacted during the two days of the
successful CEC. The meeting hall was jam packed with more than 40 CEC
members. CEC felicitated
the retired CEC members Com.Sebastian ( DGM-Rtd ) , Com.V.Suresh kumar ( DGM-Rtd ) and Com. Jyothi Krishnan on his achievement of “vishisht sanchar seva padak” In
addition to the BSNL service issues like future of BSNL , Allotment of 4G
spectrum , cut throat market competition by private operator , difficulty
being faced by BSNL in Aadhaar Verification both
EKYC machine and App , difficulties of
DSA/Franchisees , slapping of heavy tax on land/buildings by State local authorities etc
some of the HR issue transacted are the very legitimate Pay protection on FR 22 (1)(a)(1) to the Erstwhile officiating JTOS for
their officiating period and Pay protection of other JTOs during their O-JTO
Period , Shortage of CAO and AOs in various BAs , Settlement of the
Pending issues of 2nd PRC ( SAB, E2-E3 , Pay fixation on Rs.22820
for post 2007 JTO/JAO and EPF Option )
, Very unwanted and
illogical order for SDE Civil (LO) instead of EE Civil (LA) ,ghoulish and
indecent behaviour of SNEA Kerala by harassing DS EKM ( Lady Comrade) through their website repeatedly, Notional Pay Fixation from 1-10-2000 bases on E1A/E2A for
JTO/ SDE (Civil / Electri /PA-PS...) at Par with
JTO-JAO/SDE-AO , One time up gradation of Stenos working at E1A/E2A to
executive cadre , SDE Long stay rotational Transfer , Misuse of office mechanism by one
association in adding members to them in a non-permitted and unethical way , rotational transfer in the sensitive
posts like Vig/Admin/HR etc : in some BAs Vig Officers are continuing for more than 4 years ,
