Today CMD BSNL invited all the Unions and Associations of BSNL to apprise about the Revival Plan approved by the Union Cabinet on 23.10.2019. CMD and all the Board of Directors were present in the meeting. On behalf of AIBSNLEA, Com. S.Sivakumar, GS attended the meeting. The Power Point presentation was made by the Director (HR) in the Conference Hall of BSNL Corporate Office at 16.15 hrs. The meeting was lasted for more than 3 Hours. CMD BSNL Shri P.K .Purwar explained about the Herculean efforts taken by the BSNL and DoT Team under the Leadership of Secretary(T) for getting approval of the Revival Package by the Union Cabinet and explained in detail about the Salient features of the Revival Plan and Road Map for future Developmental activities to maximize the Revenue.

Salient features of the Revival Plan:                       

1. Administrative allotment of Spectrum for 4G services to BSNL to enable to provide Broadband and other Data services by BSNL. The said Spectrum will be funded by the Government of India by Capital Infusion at a value of Rs 14,115 Cr. in addition, the GST amount of Rs 2,540 Cr on the Spectrum value will also be borne by the Government of India through Budgetary Resources.

2. BSNL will raise Long-Term Bonds of Rs 7,500 Cr for which Sovereign Guarantee will be provided by the Government of India (GoI). With the said resources, BSNL will restructure their existing debt and also partly meet CAPEX, OPEX and other requirements.

3. BSNL will  offer Voluntary Retirement to their employees, aged 50 years and above through attractive Voluntary Retirement Scheme (VRS), the cost of which will be borne by the Government of India through budgetary support. The ex-gratia component of VRS will require Rs. 14,000 Cr. For about 80,000 employees.

4. BSNL will monetize Select Lands/Buildings Assets and other Telecom Assets to the tune of Rs.20,000 Crore over a period of 4 years, so as to raise resources for retiring debt, servicing of bonds, network up gradation, expansion and meeting the operational funds requirement.

5. MTNL will become a Subsidiary of BSNL till the time both the entities are completely merged. 

VRS Package:

1.  VRS Package to BSNL employees who are attaining the Age of 50 years and above wherein they will get 25% more towards Ex- gratia.

2. The Ex-Gratia amount will be calculated on the basis of 35 days salary per Year for the completed Years of Service + 25 days Salary per Year for remaining Years of Service.

3. Ex-gratia +Pension amount shall not exceed 125% of the Salary as on date for the remaining period of Service. There is no other Ceiling Limit like Gujarat Model Package i.e. 36 months/ 40 months or 42 months.

4. The Employees opting VRS will get cash payment of Ex- gratia amount in two instalments i.e. first instalment in the Current Financial Year (during the fourth quarter from Jan.’ 2020 to March’ 2020 and the second instalment in the first quarter of next financial year i.e from April’ 2020 to June‘ 2020.

5. Leave Encashment & Pension (without Commutation) will be paid at the time of VRS but the Gratuity and Commutation Value of Pension Payment will be deferred till they attain the age of Superannuation (i.e., 60 Years) or 5 years after VRS, whichever is earlier in respect of employees above 55 years to 60 years. In respect of employees below 55 years it will be paid in 6th year. During the intervening period from the date of VRS to the date of attain the age of 60 Years, Employees will get GPF interest rate on their Gratuity amount.  

6. 30 days time will be given for VRS option through ERP/ESS Portal. Provision will be created in ERP/ESS Portal for Ex-gratia calculation.

7. EL/HPL in respect of Leave Encashment and TA entitlement for settling at Home Town/Declared Place after VRS will be regulated as per existing Rules.

8. The estimated VRS Target is 80,000 employees.

After the receipt of the Minutes of the Cabinet Meeting from DoT, the revival plan will be placed in the BSNL Board meeting and after getting approval of the BSNL Board the exact date of implementation of VRS will be announced. 

CMD BSNL is of the firm opinion and expected that with the implementation of this Revival Plan, BSNL and MTNL will be able to provide reliable and quality services through its robust Telecommunication Network throughout the country including Rural and Remote areas and BSNL will regain it’s original pristine glory within 2 years. He requested that both the Management and the Unions and Associations should come forward and work together to get better results. He also requested to one and all that it is the right time for raise to the occasion and to grow and move forward with strong force. CMD BSNL further mentioned that all the BSNL employees should feel sense of ownership of BSNL as it is your own Company.

CMD BSNL mentioned that we have to utilize the available resources viz, Core Telecom Net work and generate the maximize Revenue. Only 13000 Towers were leased with other TSPs out of 70,000 BSNL towers. We can earn at least Annual revenue to the tune of Rs.2500 Cr from leasing out of remaining Towers. Out of 8 Lakh OFC Route, 20% can be utilized for sharing and we will get revenue of Rs.1500 cr. annually from this front. Through Leasing out of Buildings/Assets also, we can earn Rs.1000 cr. annually which now we are earning only Rs.160 cr.

After the Power Point Presentation and CMD’s Address, a very good interactive session was conducted. CMD replied all the queries raised by GS AIBSNLEA, other Leaders of AUAB as well as the leaders of other Unions and Associations.

For the queries raised by Com. S.Sivakumar, GS, AIBSNLEA, CMD BSNL clarified the factual position on VRS as detailed below:-

1. On our query regarding 3rd PRC fitment benefits on 5% or at least 0%, CMD replied that the same has not been approved in the PMO meeting or in the Cabinet Decision.

2. The query regarding Pension Revision of BSNL Pensioners due to non-extending of 3rd PRC fitment benefits to the BSNL Employees, CMD advised to take up the issue with the Secretary(T) and Govt. of India since it is not comes under the jurisdiction of BSNL Management.

3. Regarding our query in respect of the Recommendation to the Finance Ministry by BSNL Management for further amendment of Income Tax Act -1993 for increasing the exemption limit of Rs.5,00,000/- for the ex-gratia, CMD BSNL advised to take up the issue with the Finance Ministry.

 4. Regarding our query in respect of pre-ponement of deferred Gratuity and Commutation Value of Pension payment after attaining the age of Superannuation i.e from 60 years to 58 years if there is a move of roll back of Retirement age from 60 years to 58 years, CMD clarified that the pre- ponement of deferred Gratuity and Commutation Value of Pension payment after attaining the age 58 years (due to roll back) has not been discussed in the Cabinet Meeting.

5. Our Query regarding the Commutation Value of Pension  in respect of employees expired after getting VRS, CMD clarified that amendment made in the Gratuity Rules in the Cabinet Meeting regarding payment of Gratuity to the Legal Heirs of the deceased in the event of death after VRS but regarding the Commutation value of Pension in respect of employees expired after getting VRS some Administrative decision should be taken and assured to look in to the issue.

6. Regarding our query about the proposed date of payment of first instalment of Ex-gratia payment to the Employees going on VRS, CMD BSNL mentioned that the funds will be released by the Finance Ministry after the approval of RE-BE for the Financial Year 2019-20 i.e probably at the end of Feb’ 2020 or March’ 2020.

The Power Point Presentation, CMD’s address and Interactive Session have completed in a very effective and constructive manner. After this session, CMD BSNL called the AUAB leaders separately in his Chamber and discussed for further future plan.

Meeting with Member (Finance) and other Senior Officers in DoT: GS, AGS (Fin) and Advisor (HQ) met Member (Finance) and other Senior Officers in DoT and enquired about the salient features of the Revival Package of BSNL and MTNL approved by the Union Cabinet in today’s meeting. Member (Fin.) informed that the Cabinet Note was approved by the Secretary (T) and Hon’ble Minister of Communications, Shri Ravi Shankar Prasad Ji yesterday late night to include it in the agenda of the today’s Cabinet Meeting and DoT officers have worked on the proposal of Revival Plan till late night yesterday, then only on the intervention of the Hon’ble MOC and PMO it was included in the agenda of today’s meeting.

 

We appreciated the Herculean efforts taken by the Hon’ble MOC, Secretary (T), Member (Finance) and other Senior Officers of DOT as well as BSNL Management for getting the approval of the Revival Package by the Cabinet and on behalf of AIBSNLEA, we convey our sincere thanks to one and all. AIBSNLEA expects it’s implementation in true spirit and not ‘lopsided’.   

Member (Finance) specifically mentioned that the Fund for VRS to the tune of about Rs.30,000 Crores for BSNL and MTNL will be borne by the Central Govt. through Budgetary Support instead of raising of Bonds/ getting Loans.

 

The VRS will likely to be implemented w.e.f01.01.2020, after approved by the BSNL Board, the window for the Option for VRS will likely to be opened on 15.11.2019.

 

1.  VRS Package to BSNL employees who are attaining the Age of 50 years and above wherein they will get 25% more towards Ex- gratia and the Ex-gratia will be paid in cash as detailed below:

(a) The Employees opting VRS will get cash payment of Ex- gratia amount in two instalments i.e. first instalment in the current financial year and the second instalment in the next financial year due to the heavy Budgetary burden and as well as for availing Income Tax benefit.

(b) The formula for Ex-gratia will be 125% of the salary (Basic Pay plus IDA) for the remaining period minus Pension. In other words, it will be 75% of the salary for the remaining period and Pension.

(c) The Employees attaining the age of 56 years and 6 Months will get Ex-gratia equivalent to full Salary Benefits i.e up to a maximum of 42 Months Salary. The employees of the age less than 56 years & six months but more than 50 years will also get Ex-gratia up to a maximum of 42 Months Salary only.  

(d) Leave Encashment & Pension (without Commutation) will be paid at the time of VRS but the Gratuity and Commutation Value of Pension Payment will be deferred till they attain the age of Superannuation (i.e., 60 Years) or 5 years after VRS, whichever is earlier. During the intervening period from the date of VRS to the date of attain the age of 60 Years, Employees will get interest @ 8% on their Gratuity amount.  

2.  Cost of the 4G Spectrum including the GST amount will be allocated to BSNL by Capital Infusion.

3.  Immediate Financial Support to the tune of Rs.15,000 Crores to BSNL and MTNL through infusion via Sovereign Bonds.

4. The Assets of BSNL/MTNL to the tune of Rs.38,000 Crores will be monetized over a period of 4 years.

5. MTNL will become a Subsidiary of BSNL till the time both entities are completely merged.   

AIBSNLEA is of the firm opinion that BSNL will regain it’s Original Pristine Glory after the implementation of Revival Plan.

Meeting with Director (HR), BSNL Board: GS and AGS (Fin) along with Rajasthan Circle President met Director (HR) BSNL Board and discussed regarding disbursement of salary for the month of Sept., 2019 to BSNL employees as assured by CMD BSNL and Director (HR) with the AUAB representatives during the meeting held on 17.10.2019. Director (HR) informed that we are on the job and try to disburse the salary by 23rd of this month as assured. Further, we enquired about the status of BSNL Revival Plan. Director (HR) mentioned that the things are going in a positive direction and hopefully it will be approved in the ensuing Cabinet Meeting. We further discussed regarding:-

A) Filling up of all vacant posts of Group ‘B’ and Group ‘A’ in various disciplines:- We requested to fill up all the vacant posts of Group ‘B’ and Group ‘A’ in all disciplines before implementation of proposed VRS in BSNL since there is no financial implications. Director (HR) appreciated our concern and assured to look into the matter. GS handed over a letter addressed to Director (HR) in this regard.

B) Consideration of Promotion from DGM (Fin-Regular) to Jt.GM (Fin) by relaxing the Service conditions: We requested to relax one year in the service conditions for the promotion to the grade of Jt.GM (Fin) from the grade of DGM (Fin-Regular) and arrange to issue the promotion orders in the grade of Jt. GM in the E-7 Scale before the implementation of the proposed VRS in BSNL. After detailed discussion, Director (HR) assured to look in to the matter. GS handed over a letter addressed to CMD BSNL with copy to Director (HR) in this regard.

C) Amendments in Deputation Policy: We requested Director (HR) to review the Deputation Policy in the background of present financial crunch of BSNL. So many executives in various Grades have applied for deputation to various Organizations and waiting for forwarding of their applications. We suggested that it is the high time to amend the Deputation Policy and forward the eligible applications to the concern Organizations since BSNL Management is struggling for timely disbursement of salary to its employees. Director (HR) assured to discuss the matter with the CMD BSNL for further decision. GS handed over a letter addressed to CMD BSNL and Director (HR) in this regard.

D) DE to DGM (T) Promotion: We requested to expedite the issuance of DE to DGM (T) promotion orders. Director (HR) immediately contacted PGM (Pers) over phone and directed him to issue the DGM (T) promotion and posting orders before Deepawali i.e. on or before 25.10.2019.  

E) Consideration of Request transfer in the cadre of DGM (T): We requested to consider the long pending request transfer cases of DGMs who have completed more than two years in other Circles. Director (HR) mentioned that it will be considered along with the DGM (T) promotions.

F) Consideration of Request transfer in the cadre of DE: We requested to consider the pending request transfer cases of DEs without substitutes since they have obeyed the orders of Corporate Office and working in the other Circles for more than 2 years and also away from their families. Director (HR) assured to look into the matter.  

G) Request for remittance of recoveries from Salary to concerned authority: We brought to the notice of Director (HR) that the recoveries from Salary viz: GPF, Bank Loan EMIs, Society, LIC and PLI etc. have not been remitted to the Concerned Authorities since last five months. Due to non-remittance of the above said dues, employees are suffering a lot. BSNL Employees are not able to get GPF advance/withdrawal and Society Loan etc., for celebrating Diwali festival. Further, the negligence and fault on the part of the Management towards the delayed payment of Bank Loan EMIs resulting in imposition of Penal interest on the employees by the Bank Authorities.

We requested Director (HR) at least two or three months LIC/ PLI premium recoveries may be released for remittance before the end of this month so that the Policies will be alive since for the past five months it has not been remitted. Director (HR) after patient hearing assured to look in to the matter. GS handed over a letter addressed to CMD BSNL, copy to Director (HR) in this regard.

AUAB decides to defer tomorrow's Hunger Strike, after meeting with the CMD BSNL today:-

A meeting between the AUAB and the CMD BSNL was held at 03:00 pm today. The Director (HR), Director (CM) and GM (SR) were also present. From the AUAB side, the General Secretary Com. S. Sivakumar on behalf of AIBSNLEA and the General Secretary/ Representative of BSNLEU, NFTE, SNEA, FNTO, BSNLMS, SNATTA, ATM BSNL, BSNL OA, TEPU and TOA BSNL were also participated in the meeting. After detailed discussion, the CMD BSNL assured that the Salary for the Month of Sept., 2019 would be disbursed by 23.10.2019. Further, informed that the Cabinet is likely to take a decision on BSNL’s Revival Package on 23.10.2019. He appealed to the AUAB to defer the Hunger Strike scheduled to be held on 18.10.2019. After this meeting, the representatives of the AUAB present in the meeting, decided to defer the Hunger Strike for the time being. It is also decided to hold the next meeting of the AUAB on 30.10.2019, for reviewing the situation and for taking appropriate decision regarding future course of action.

Meeting with Member (Finance) DCC, DoT:-   

GS, President, Chairman and AGS (Fin) met Member (Finance) DoT and discussed regarding disbursement of salary for the month of Sept., 2019 to BSNL employees by releasing the Claims Payable to BSNL. Member (Finance) informed that BSNL immediately required Rs.365 crores which are being arranged by DoT shortly and salary may be disbursed during early in the next week by 22nd or 23rd Oct., 2019. We further discussed regarding revival of BSNL. Member (Fin) mentioned that the Revival Package of BSNL/ MTNL which has been principally agreed by the GoM may be put up during next Union Cabinet Meeting. Further BSNL will be given “Letter of Comfort” of Rs.30000 crore shortly. The outstanding claims of BSNL Contractors, Vendors and Labour payments need also to be cleared by BSNL.

Meeting of All Unions and Associations of BSNL (AUAB) at New Delhi:-

The scheduled meeting of AUAB held today at 1.30 pm at NFTE Office, New Delhi. The meeting was presided over by Com. C. Singh, the Chairman AUAB and GS NFTE. GS/ leaders of most of the Associations and Unions available at Delhi attended the meeting.

The Convenor AUAB and GS BSNLEU, Com. P. Abhimanu welcomed all the participant leaders and requested the Chairman to discuss further. Com. Chairman welcomed all and delivered the presidential speech and thrust on the unity of all the Unions and Associations of BSNL. All should come under one umbrella to save BSNL.

After detailed discussions, it was felt that rest of the Unions and Associations of BSNL, those who did not participate in today’s meeting due to pre-occupancy may also be invited and brought under the umbrella of AUAB. Further, it has been unanimously decided that a Daylong Hunger Fast by AUAB at District level, Circle level and Corporate Office HQ by the respective DSs, CSs and GSs of all the Unions and Associations be conducted on 18.10.2019.

DEMANDS

1.Immediate release of salary for the month of September 2019.

2. Revival of BSNL:- Immediate financial support, Soft Loan, Land Monetization and allotment of 4G Spectrum to BSNL.

3. Immediate remittance of recoveries from Salary to the respective organizations/ authorities.

4.Implementation of 3rd Pay Revision.

5.Immediate revision of Pension.

6. SAB with 30% benefit.

It was also decided to convene next meeting of AUAB on 21.10.2019 at 03.00 pm at SEWA BSNL Office, Eastern Court, New Delhi to decide the further course of action in this regard. In the meanwhile, all efforts should be made to contact and request rest of the Unions and Associations to come and join under one umbrella.

PRESENT STATUS OF BSNL REVIVAL PACKAGE

It is reliably learnt that the discussions regarding BSNL Revival Package are going in the positive direction and it is expected that the proposal is  likely to be approved by the Cabinet in the 4th week of October 2019 i.e., before Deepawali.

VRS Package to BSNL employees: VRS will be implemented from 1.12.2019. The window for the options will be opened from 1.11.2019 to 30.11.2019.

1.  VRS Package to BSNL employees who are attaining the Age of 50 & above wherein they will get 25% more towards Ex- gratia and Ex-gratia will be paid in cash as detailed below

(a) The Employees opting VRS will get cash payment of Ex- gratia amount in single go or maximum 5 instalments on optional basis for availing Income Tax benefit.

(b) The formula for Ex-gratia will be 125% of the salary  for the remaining period less Pension,

(c) The Employees having 56 years and having 4 years left out service will get full Salary benefits i.e upto a maximum of 40 months salary. 

(d) Leave Encashment & Pension (without Commutation) will be paid at the time of VRS but the Gratuity and Commutation Value of Pension Payment will be deferred till they attain the age of Superannuation (i.e., 60 Years) or 5 years after VRS, whichever is earlier. During the intervening period from the date of VRS to the date of attain the age of 60 Years, Employees will get interest @ 8% on their Gratuity amount.

CS Com.Shaji , DS CO Com.Sreejith and DFS CO Com.Muhammed Salih met GM(A/HR) Shri.Sathesh R and discussed the following pending issues  on 05-10-2019.

 

Reliving  of officers  in ERP  :

We requested to relive all officers in ERP who are ordered for request transfer in August 2019 but not relieved so far . All the officers not relieved so far are demotivated . They may be relieved immediately so that the executives waiting for home town for around three years can join back and contribute more to BSNL . GM assured to release the transfer in ERP at the end of October 2019 , if they have not been released till the time.

 

Considering Pending request transfers in continuation to the orders issued in August 2019:

We remained our prolonged request of releasing these pending orders right from August . GM informed that already directed DGM(HR) to put up all the pending requests for consideration . He assured to release the orders this month itself . Later we met DGM(HR) Smt.Ponnammal R . Madam told all the details are collected and it is about to forward .

 

Release of Pending Financial up gradation orders :

We extended our sincere appreciation to GM for the timely release of financial up gradation orders especially in E5-E6 . We requested to consider pending cases in E5-E6 from Thrissur , EKM etc BAs  those could also have been  considered along with the last DPC   . GM informed that no case is left mistakenly. All the cases wherein VCs are received have been considered and for all the pending cases VC clearance expected from corporate office . We requested to release up gradation orders  at the earliest on reception of VCs as some of the senior officers in DGM grade like Shri.Krishnan DGM Thrissur  are retiring this month on superannuation . He assured to take all efforts to release the orders at the earliest.

 

Posting of AO/JAO under DE at Kollam BA against the assurance of GM(Kollam) to the DS Kollam Com.Amarthlal

We extended our strong protest to GM(A/HR) holding charge of Kollam BA against the orders released in Kollam BA at late hours on 04-10-2019 violating the promise of GM to DS Kollam that JAOs posted in CSC will not be linked under SDE/DE controlling officers. We are repeatedly requesting management to post AO/JAO in CSCs against sanctioned posts though AO/JAO Comrades are voluntarily coming forward to work in CSCs in an encouraging manner  on a vision that our Engineering brethren can concentrate more on field /Technical issues for the benefits of BSNL . However the cross posting of officers in accounts vertical alone under Engineering vertical cannot be appreciated by this association.  We demanded to keep the order , linking DE as controlling officer,  pending at Kollam .

 

GM very patiently heard all our submission and shared our views. He assured to give instructions  to Kollam BA to keep the orders pending . AIBSNLEA is not against posting of AO/JAO in CSCs .  We requested to post JTOs under AO (CSCs) on need base to balance the cross posting of AO/JAO under DEs . GM assured to look into it.

The Unions and Associations of BSNL have served upon a notice to the Secretary (Telecom), DoT and the CMD, BSNL for lunch hour demonstration on 01.10.2019 in protest against the non-payment of salary in time, non-payment of wages to contract workers, electricity bills, rentals etc. and total ban on capital expenditure along with other issues related with Revival of BSNL.

Unions and Associations further demanded that if BSNL is not able to pay the salary, Govt. should pay the salary to all BSNL employees being the Principal Employer and owner of the company.

Charter of Demands

1. Immediate allotment of 4G Spectrum and Land Monetization.

2. Payment of Salary to BSNL employees on due date by BSNL or DoT.

3. Payment of wages to contract workers, payment of electricity and rental charges.

4. Implementation of 3rd Pay Revision.

5. Honour the Commitments given by Union Cabinet in 2000 to ensure financial viability of BSNL:

i) Financial support for loss making Rural Exchanges.

ii) Extend soft loan to BSNL/ Sovereign Guarantee for it’s capital expenditures.

iii) Remove the total ban on capital expenditure by BSNL. Allow field units capital expenditure, where revenue is assured.

6. No Retrenchment & No Roll Back of Retirement age to 58.

7. Payment of Pension Contribution by BSNL as per the Govt. Rule.

Meeting with Hon’ble Minister of State for Finance Shri Anurag Thakur Ji:-

Today GS AIBSNLEA, AGS (Finance), FS/CHQ and Advisor (HQ) met Shri Anurag Thakur Ji, the Minister of State for Finance, Govt. of India and felicitated him by presenting Bouquet. On behalf of AIBSNLEA, we have submitted the Memorandum regarding Revival of BSNL and extension of immediate financial support to BSNL.

GS further explained about the current financial status of BSNL and requested for early consideration of Revival of BSNL and extension of immediate financial support by issuance of Sovereign Guarantee to BSNL for availing long term loans from the Banks to meet the requirement of CAPEX & Developmental activities of BSNL.

Hon’ble Minister of State for Finance mentioned that Hon’ble Minister of Communications Shri Ravi Shankar Prasad Ji, Secretary (T) & CMD BSNL are trying their best for getting the BSNL Revival Plan approved by the Cabinet. They are continuously discussing about the modalities for the revival package of BSNL with the Committee Members. He further mentioned that due to the continuous loss of BSNL, the concurrence of Finance Ministry is delayed. However, he assured to look in to the matter.

GS attended the Extended Circle Executive Committee Meeting of the AIBSNLEA Kerala Circle and Open Session.
The Extended Circle Executive Committee Meeting of AIBSNLEA Kerala Circle followed by Open session has been conducted on 20.09.2019 at Hotel Prasanth, ThiruvananthapuramCom.Vijayakumar, Circle President has presided over the CEC.  Com. Binu, DS TVM welcomed the gathering. Com,.Shaji , CS, Kerala, in his address appreciated the role of AIBSNLEA  CHQ in uniting all the Associations and Unions under the umbrella of AUAB and explained about the local problems faced by the Kerala Executives due to non- payment of Electricity, Diesel and Contractual Labour Bills, Payment to Vendors, Telecom Infra Service Providers and Local Cable TV Operators bills etc., resulting  in decline in revenue of Kerala Circle and Non-maintenance of Operations due to heavy financial crunch caused disrepute and dissatisfaction amongst the Subscribers.

OPEN SESSION:

An Open session has also been arranged at 12 Noon followed by Delicious Lunch.  Com.Shaji CS Kerala Welcomed all the dignitaries and members to the Open session. Com.S.Sivakumar, GS, AIBNLEA,  PGM (Finance) Kerala Shri.K.K Vel , PGMT Thiruvananthapuram Shri.S.S Thampi and GM(A/HR) Shri S.Sathesh  have graced the session with their admirable presence and thought provoking speeches .

Our dynamic GS Com.S Sivakumar portrayed the real shape of present BSNL and explained the solutions to the problems being faced by BSNL He mentioned that at the time of formation of BSNL, assurance given to the BSNL Unions through Cabinet decision that the Govt. will take care of the financial viability of the BSNL. Our Association Central Head Quarters Office bearers met Hon’ble Minister of Communications Shri. Ravi Shankar Prasad ji and Hon’ble Minister of State for Communications Shri Sanjay Shamrao Dhotre ji, and requested to honour the assurance given through Cabinet decision and extend adequate immediate Financial Support to BSNL and revival of BSNL. Hon’ble Minister of Communications Shri. Ravi Shankar Prasad ji assured that that the revival package to BSNL is under active consideration.

 

Our Association has also written a letter to Hon’ble Prime Minister Shri Narendar Modi ji requesting adequate Financial Support to BSNL, immediate revival of BSNL , allotment of 4G Spectrum and demanded the Govt. to refund back 58000 Crores to BSNL , which has taken against various taxes ,  refund of interest paid on unutilized BWA spectrum and excess payment of Pensions contribution etc., Compensation for Maintenance Expenditure of 17000 Rural Telephone Exchanges to the tune of Rs.19,000 crs and immediate payment of USOF/ ADC charges in the form of the Rural Deficit Charges for the Services provided by the BSNL in the LWE/NE/Rural/Far flung/Tribal/Hilly Areas and Wage revision of BSNL Employees as per 3rd PRC recommendation.

 

The Hon’ble Minister for Communications Shri. Ravi Shankar Prasad ji declared in the Parliament and stated in the interview to the Media that BSNL is the National Asset and operate in Strategic areas that concern Defence and Home Affairs and BSNL is in forefront of giving free Services at the time Natural Calamities. A revival package is being worked out to make them more competitive and we will try to ensure that there is least pressure on the Government. We hope on the assurance of the Hon’ble Minister for Communications that the revival package and financial support will be given to BSNL to safe guard the BSNL, in the larger interest of the Nation and people.

He further mentioned that the Finance Ministry is strongly opposing the BSNL Revival Plan & VRS Proposal and continuance of the BSNL as a Strategic PSU for providing Telecommunication Services and Finance Ministry is of the opinion that No Financial Support will be given to BSNL. According to the reliable sources, it is further learnt that the Finance Ministry raised so many objections instead of giving positive comments on the revised cabinet draft despite Group of Ministers & PMO has given a green signal on the proposal for the revival of BSNL.  Finance Ministry is opposing all the proposals of the BSNL Revival Plan. It seems that Finance Ministry is of the opinion that BSNL cannot be revived & has to be closed immediately and no revival package is required for the BSNL.

He opined that the stand of the PMO and the Group of Ministers will play a vital role for the revival of BSNL and AIBSNLEA strongly feel that it will be achieved only through the Political decision and unity among all the Unions and Associations. AIBSNLEA is trying to meet the Cabinet Ministers/ GOM in this regard and also in touch with all the AUAB leaders for immediate conduct of AUAB Meeting to discuss further course of action.

He mentioned that the need of the hour is to maximize the revenue and advised that all employees should come forward and work together to achieve the various targets given by the BSNL Management within  the available resources and mentioned that AIBSNLEA requested the BSNL Management to come forward to conduct periodical meetings with the General Secretaries of the Recognized Unions and Associations to get better results & coordination between Management & Employees for the betterment of the BSNL. and further suggested that the strategies to be evolved to come out of the present crisis, the working pattern of the BSNL Executives/ Non-executives in the changed scenario for better utilization of BSNL Manpower in Marketing & other outdoor activities to compete with the other Private Operators to be discussed with the Representatives of the Recognized Unions and Associations of BSNL for the betterment of the Company and to regain its original pristine glory.

 

He also explained  about all the HR issues, the current status of DGM(T), DGM(F), CAO, SDE Promotions, FR 22(I)(a)(1) Pay Fixation Court cases/Pay Recovery in respect of Ex.Officiating JTOs, 30% SAB, Scrapping of MTRR, Pay anomaly  in r/o Electrical/Civil/Architect wing JTOs  etc.,

 

The entire house enthusiastically applauded GS AIBSNLEA to his initiatives and sincere efforts to the revival of BSNL through our mighty AIBSNLEA.

Special GB has decided to expel Com.Krishnamohan SDE , CWC member , from the primary membership of AIBSNLEA for a period of three years due to his  continued indiscipline towards AIBSNLEA constitution .

Delayed Salary  for August 2019 :

 

Today CS CVP DS TVM and CEC member Com.Sreejith  met PGM F and enquired about releasing of already delayed August month salary to employees of Kerala circle especially on  our national festival of "ONAM", this month. PGMF emotionally shared his real concern about this sorry stage. We demanded to write a letter  immediately to corporate office demanding releasing of salary on top priority to the most profit making circle Kerala while we are celebrating our national festival,  as a motivation to the employees who have been striving hard to keep up the revenue atop in BSNL .

 

We reminded him the importance of ONAM for Kerala that we had been blessed to drawn ONAM advance salary in past years.PGM F  immediately directed to prepare letter in this regard to corporate office.

 

Pending CAO/DGM-F LA Orders:

We express our concern that the CAO/DGM-F LA orders are not released so far though PGM-F assured the immediate release to this association on our meeting with PGM on 24-08-2019 . PGM replied that the request file for CAO LA  is already forwarded to CGMT in the last week itself . Preparatory works for DGM LA is going on. We requested to release all the orders without delay. 

 

CS CVP DS TVM and CEC member Com.Sreejith  met DGM HR Smt.Ponnammal R and enquired about the progress of relieving executives in the request transfer orders . She replied that some individual requests are being received from among the executives transferred as substitutes. We demanded to take steps to release all executives on request transfers immediately. Further we requested to enable Ernakulam BA to execute high range rotational transfer. DGM replied that HR section is on the job.

Meeting with CMD BSNL: GS, AGS (Finance) & Advisor (HQ) met CMD BSNL and discussed regarding:-

(1) Disbursement of salary for the Month of August 2019:- We enquired about the probable date of disbursement of Salary for August 2019. CMD BSNL informed that he along with Secretary (T) met 5 Bank Authorities including CMDs but no Bank is come forward to give any Loan to BSNL, even on the basis of Letter of Comfort. However, BSNL Management had already written a letter to Secretary (T) requesting for issuing Sovereign Guarantee to BSNL for availing Loan. But CMD opined that Sovereign Guarantee will be issued only by the Ministry of Finance.

 

He further mentioned that we are trying our best but it is not possible to disburse the Salary from BSNL’s own sources since Statutory dues like TDS, GST etc. are also to be paid during first week of September 2019. Hence, from the available sources of Cash flow of BSNL, Management is not in a position to make any commitment regarding the date of disbursement of salary for August 2019. 

 

(2) Revival Package & Financial Status of BSNL - We enquired about the status of BSNL revival package. CMD BSNL mentioned that the Ministry of Finance has not given any clearance on the Revised Cabinet Memo on Revival Package of BSNL submitted by DoT since the proposal for taking over of BSNL Debts including outstanding bills through SPV has been dropped in the PMO meeting. Hence, the clarity will be known only after the clearance from the Ministry of Finance.

(3) Achieving of targets given by the BSNL Management:  CMD BSNL advised that all should come together and work hard and no stone left unturned by  each employee to achieve the various targets given by the BSNL Management to maximize the Revenue and increase the Cash Flow. We requested CMD BSNL to allot funds for small requirements in order to retain the existing Customers/ Maintenance of Services, towards Electricity bills, Hiring Vehicles bills and Mtce., and Labour Contractors bills etc. CMD BSNL mentioned that funds are being released to all the Circles on piecemeal as per the availability of the funds.   

(4) Request transfers in the cadre of DGM (T):- We requested that those DGMs who have already completed more than two years may be considered for request transfers on ‘own cost basis’ to their Home Circles as they have obeyed & honoured the transfer orders issued by the BSNL Corporate Office. In this regard, GS AIBSNLEA has already written a letter to CMD BSNL which may kindly be considered as the DGMs are facing much problems in their old age of 58+. CMD BSNL assured that the cases will be reviewed again.

CS writes to CGMT Kerala   expressing our sincere regards to circle management in releasing the pending request transfers in the cadre of JTOs. It is very pertinent to point out that some more JTOs transfer requests are pending to be released and requested to release the same without delay as you have consented. We further request your kind office to release these JTOs immediately to their parent BAs.

 

Also requested to stop immediately the fresh transfer order issued on long stay basis in company cost to JTOs having their average age around 55 years are waiting for taking the proposed VRS package and find substitute from JTOs completing their Phase-I training this month .

Yesterday on 21-08-2019, CS Com.Shaji  ACS Com.Pushparajan DS TVM Binu R and Com.Harilal had an agenda meeting  with GM(A/HR) &GM(Kollam BA ) Shri.Sathesh R on the Unlawful and  unfortunate withholding of pensionary  benefits of erstwhile O-JTOs in some BAs of Kerala Circle uncaring rather challenging  the corporate office’s  and subsequent Kerala Circle office’s  clear directions in black and white to no recovery till further direction from corporate office (Letter. No .3-8/2010-Estt-IV    Dated 3rd June,2016   and No. HR-III/2-5/JT0(O) pay fixation/2012/part-I/52  dated  16/8/2016.) 

 

Smt.Ponnammal R  DGM(HR) , Smt Sreelatha S DGM(ERP&CSC)  ,   Smt. Sudha P Nair AGM (HR)  , Shri. Mukunthan K CAO (Taxation) and Shri. Muraleedharan S AGM (Legal-II) have also  been present as per the instruction of GM.

 

       As per Corporate office order No.5-4/2004/Pers-IV dt. 13.5.2004 JTO screening test qualified TTAs who did not get regular promotion were imparted Phase- I Training and were posted on officiating basis in the year 2004-2005. However their pay was restricted vide FR.35 by which an officiating employee gets an additional amount of Rs 1000/- per month.  OJTOs in Kerala filed cases in High court of  Kerala for their eligible Fr 22 1 (a) 1 pay fixation. The Hon  court directed BSNL to award the eligible   pay fixation  of Fr 22 1 (a) 1. Though BSNL had challenged the same in Hon Kerala HC pay has been  continued in Kerala Circle. The case in  HC continued till July 2017. Mean while OJTOs of Other Circle filed cases to get their  pay  parity with Kerala OJTOs in various courts in 2010 itself. Naturally have won the benefit of  Fr 22 1 (a) 1 at all levels of courts from CATs, PCAT to  Delhi HC. Finally Hon SC on SLP(C) No. 4553/2012 in PCAT OA No.1282/2010 directed  BSNL to   extend pay parity to all other OJTOs in other circles at par with OJTOs of Kerala . However Hon SC had given the liberty to BSNL for recovering the excess pay,  if BSNL arguments  against awarding of  FR 22 1 (a) 1 will be upheld in the  case filed against  OJTOs in Kerala HC (14 writ petitions)  . The Hon. Ernakulam HC DB through WPC NOs : 7723 23850 , 1735 of 2010 and OP (CAT) No:2107 against TA NOs : 84 to 97/2008   On 15th September 2017 HC  judgement favourable that “ The finding rendered by  the Tribunal that fixation has to be effected based on FR 22 (1) (a) (1)  is perfectly within the four walls of law and is not assailable “

 

Even though Hon SC had already ordered (Through SLP (C) 4553/2012)that Kerala HC order would be final in this case. BSNL once again tried to file another SLP in Hon SC in july 2018 ( SLP 19274/2018, 19271/2018,19310/2018 AND 19304/2018) against Kerala HC order and these cases were dismissed by SC  in favor of OJTOs. After a long legal war of 13 years from 2005 to 2018 and failing all the cases in all levels of courts,  Fr 22 1 (a) 1 pay fixation accepted by BSNL management and accordingly an order issued on 18th Sept 2018. (No-3-8/2010-Estt-IV dtd 18/09/2018 ) . In this generalized order issued for implementing Fr 22 1 (a) 1 pay and now all along India it is implemented undisputedly.

 

Officiating JTOs and 2nd PRC pay fixation :     Corporate office issued an order dtd 22/12/2015 (Letter No-3-32/2013/Estt-IV   DTD 22/12/2015 ) for the pay calculation for  post 2nd PRC period  . As per this order officiating JTOs to be reverted to substantive cadre and pay fixation to be done as per model calculation mentioned in this letter w.e.f 01-01-2007. In Kerala the officiating process has been started from year 2004 and continued till 2016 July . The  OJTOs have been drawing JTO IDA pay during this period. They had not been reverted to TTAs in 01-01-2007. As per this belated order the pay is lesser than what they are already in from 01-01-2007. So AIBSNLEA Challenged this order in Hon Principal CAT New Delhi vide OA 100/892/2016.  Principal CAT  issued an interim order for non recovery of pay till finalization of the case. On the basis of interim order corporate office issued an order on 03/06/2016 for non recovery of pay (No:3-8/2010-Estt-IV dtd 03/06/2016). This order was fully endorsed  by  Kerala circle to All heads of SSAs that “ RECOVERY MAY NOT BE EFFECTED TILL FURTHER ORDERS FROM CORPORATE OFFICE”  No:HR-III/2-5/JTO(O) Pay Fixation/2012/part-1/52 dtd 16/8/16). It is very clear that recovery of any amount may not be made from the officiating JTOS until the finalization of OA 100/892/2016. This court case is not finalized till date. Next hearing date is 12/09/2019. What withholding happening in Kerala while an employee is retiring amounts to Recovery only.

 

All our arguments have been very patiently listened by GM Shri.Sathesh very empathetically. GM replied it is a very genuine case. As long as the corporate office clear guidance is not there for recovery , no recovery must not be made and the withholding can also be avoided . GM has informed that, for some more clear clarification on the matter one letter is send to corporate office  . He assured to give instructions to BAs to release the amount withheld and to stop any such withholding from pentionary benefits till corporate office directed to do so. We extended sincere regards to GM Shri.Sathesh  for his very positive and employee helping  standpoint he has been showcasing  . We have also extended sincere thanks to all the officers present from management side.

Revival of BSNL:-

Chairman and GS met the Senior Officers in DoT and enquired about the outcome of the Meeting held in PMO convened by the Principal Secretary to PM Shri Nripendra Misra Ji on 20.08.2019. The queries raised by the Ministry of Finance on Revival Plan of BSNL has been discussed in detail in the meeting wherein Group of Secretaries including Secretary (Telecom) Shri Anshu Prakash ji, CMD BSNL Shri PK Purwar ji were also present. The PMO intervene in the matter to resolve the bottleneck raised by MoF on the proposed revival package of BSNL. It is reliably learnt that after detailed discussions the following decisions have been taken:-

 

1) VRS Package to BSNL Employees: VRS Package is eligible for BSNL Employees who are attaining the Age of 50 years & above.

a) The Employees opting VRS will get cash payment of Ex- gratia amount in single go or maximum in 5 instalments on optional basis for availing Income Tax benefit.

 

b) The formula for VRS Package is (Ex-gratia + Pension) or 125% of the Salary (Pay + IDA), whichever is less.

 

c) The Employees having 40 months Service left will get full Salary benefits.

 

d) Leave Encashment & Pension (without Commutation) will be paid at the time of VR but the Gratuity and Commutation Value of Pension Payment will be deferred till they attain the age of Superannuation. During the intervening period from the date of VR to the date of attain the age of Superannuation, Employees will get interest @ 8% on their Gratuity amount.

 

e) The Ex-gratia amount for VRS will be paid in Cash by BSNL by issuing of Bonds on the basis of the Sovereign guarantee to be given by the DoT. 50% of interest liability on bonds will be born by Govt.

 

Through this process, Govt. is estimating that the present staff strength will be reduced to 62000 from the present strength of 1.60 lakhs.

 

2) The roll out of age from 60 years to 58 years: The roll out of age from 60 years to 58 years in respect of BSNL Employees will be followed by VRS.

3) 4G Spectrum allocation to BSNL: Rs.14,000 Crores will be borne by the Govt for 4G Spectrum allocation to BSNL.

4) BSNL Land Monetization proposal:  The proposal for monetization of BSNL Land, OFC & Towers has been accepted which will be monitored by a Committee consisting of the officers from BSNL, MTNL, DoT and DIPAM.

5) Proposal for SPV for land monetization and merger of BSNL & MTNL is dropped: 

 

Minutes of the Meeting is expected by today evening/ tomorrow morning and accordingly the revised Cabinet Note will be put up to Hon’ble Minister of Communication Shri Ravi Sankar Prasad ji with in day or two for approval and further circulated to the concerned Ministries. It is expected that Cabinet approval for the Revival Package of BSNL will get within the 1st or 2nd week of September 2019, if all the things go smoothly. 

 

It is also reliably learnt that window for VRS Package will be opened for One Month and all the process will be settled within two months.

 

AIBSNLEA is of the firm opinion that as a stakeholder and one of the Major Recognised Associations in BSNL, we should be called for discussion before finalization of VRS Proposal. As per AIBSNLEA 6th AIC decision, we demand the BSNL Management that the VRS Proposal should be linked with 3rd PRC fitment. AIBSNLEA strongly hope that the BSNL Management will call us for discussion in this regard.

However, as per the 6th AIC decision AIBSNLEA will strongly oppose the move of roll out of retirement age from 60 to 58 years.

AUAB calls Protest Lunch hour Demonstration on 21.08.2019 (tomorrow) against the reduction of retirement age from 60 to 58 years:-

AUAB has reliably learnt that the BSNL Board of Directors meeting is scheduled to be held on 21.08.2019, wherein the agenda of reduction of retirement age of BSNL employees from 60 to 58 is likely to be discussed. We are receiving the news from various sources that the Govt. is considering the proposal of roll out of retirement age of BSNL Employees from 60 to 58. It is totally unwarranted and it is against the assurance given by the Union Cabinet in the year 2000 at the time of Corporatization of BSNL. All the DoT recruited employees are enjoying the facilities of age of superannuation at 60 years w.e.f. 31.05.1998. In view of this, we have to strongly protest the move of the BSNL Board to reduce the retirement age from 60 to 58.

 

Hence, AUAB calls upon the entire Executives and Non-Executives of BSNL to hold lunch hour demonstrations on 21.08.2019 (tomorrow) to protest against the proposed move of the BSNL Board to reduce the retirement age from 60 to 58.

 

All the Circle Secretaries/ District Secretaries are requested to coordinate with the constituent Unions/ Associations of AUAB and make the Protest Lunch Hour Demonstration on 21.08.2019 a Grand Success.

Meeting with Member (Finance), DCC, DoT

Com. S. Sivakumar GS AIBSNLEA along with AGS (Fin) and Advisor (HQ) met Shri. P.K. Sinha Ji Member (Finance) and  greeted him  on assuming the High office of Member (Finance) in Digital Communications Commission, DoT by presenting Bouquet. AIBSNLEA congratulated the new Member (Finance) and discussed regarding:-

A) Revival of BSNL: We enquired the Member (Fin) regarding the present status of the Revival Package of BSNL. Member (Finance) mentioned that the Cabinet Memo for Revival Plan is under consideration of Finance Ministry and he personally requested the Officers of Finance Ministry for early clearance of the proposal. He also mentioned that DOT is trying to get the Cabinet approval of Revival Package of BSNL before the end of this month.

B) Immediate Financial Support to BSNL:-  We further requested for: 1) Extending immediate Financial Support to BSNL for the maintenance of the Services.

2) Refunding of Govt. dues to BSNL viz

a) Interest paid on BWA Spectrum.

b)  Excess payment of Pension contribution to the tune of Rs. 2700 Crs.

c)  Compensation for Maintenance of 17000 Rural Telephone Exchanges to the tune of Rs.19,000 Crs.

d)  And immediate payment of USOF/ ADC charges in the form of the Rural Deficit Charges for the Services provided.

Member (Finance) mentioned that DOT is considering for the immediate Finance Support to BSNL as well as refund of Govt. dues viz., Compensation of Rural Deficit Charges from USO Fund and refund of excess paid Pension Contribution. He also mentioned that a High Level Meeting is scheduled to be held on 19.08.2019. Regarding refund of Pension Contribution, he further mentioned that the Ministry of Expenditure is positive.  

C) Extension of Soft Loan to BSNL for its Capital Expenditure till the Monetization of Assets is effected:Member (Finance) mentioned that DOT is considering the Sovereign Guarantee for the grant of Loan to BSNL.

We handed over the copy of the letter addressed to Hon’ble Prime Minister of India in this regard.  

D) Immediate Financial Assistance to Flood affected Circles:- We requested the Member (Fin) for immediate allotment of funds to BSNL for the restoration of Services in the flood affected Circles viz., Maharashtra, Karnataka, Kerala and Tamil Nadu. We have also handed over the letter in this regard. Member (Fin) mentioned that we are aware of the situation and DOT is considering for immediate necessary support.

AUAB calls on to organise Lunch Hour Demonstrations and Gate Meetings on 07-08-2019:

A meeting of the AUAB was held yesterday the 01.08.2019, at NFTE’s office, New Delhi. The meeting was presided over by Com. S. Sivakumar, General Secretary, AIBSNLEA. General Secretaries / Representatives of BSNLEU, NFTE, SNEA, AIBSNLEA, AIGETOA, BSNL MS, BSNL ATM, TEPU and BSNLOA attended. The meeting expressed it’s extreme unhappiness that the Unions and Associations of BSNL are being completely kept in the dark, with regards to the so called revival package of BSNL. The meeting also expressed it’s deep concern about the deterioration of BSNL’s services due to lack of working capital. The meeting took serious exception to the repressive measures being taken by the BSNL Management, to deny legitimate trade union activities in BSNL. After serious discussions, the meeting decided to organise countrywide lunch hour demonstrations and gate meetings on 07.08.2019, on the following demands:-

Demands:

>>>Honour the commitments given by the Union Cabinet in the year 2000, to ensure BSNL’s financial viability.
   (a) Extend immediate financial support to BSNL, for the maintenance of the services.
     (b) Extend soft loan to BSNL for it’s capital expenditures.
>>>Remove the total ban imposed on capital expenditure by BSNL. Allow field units to carry out capital expenditure, where revenue is assured.
>>>No retrenchment. Honour the commitment given on job security at the time of formation of BSNL.
>>>Stop repressive actions for even legitimate trade union activities.


All the Circle / District Secretaries of AIBSNLEA are requested to effectively organise the lunch hour demonstration and gate meeting, by coordinating with the other constituents of the AUAB.

CS Com.Shaji , CP Com.Vijayakumar , CFS Com.Biju Gopal , ACS Com.Pushparajan , CVP Com.Rajan and DS TVM Com.Binu had an agenda meeting with CGMT Kerala Dr.PT Mathew on 30-07-2019 , Wednesday evening . GM (A/HR) Shri. Sathesh R was also present all along the meeting . The meeting was very fruitful. The following points have been discussed.

 

No dumping of MSAN (Multi Service Access Node) equipments to Kerala:

It is learned that BSNL has placed APO for 5600 Nos of MSAN (Multi Service Access Node) equipments and out of that 660 numbers  are to Kerala circle for  providing VDSL and GPON ports. We requested CGMT to assess the VDSL market and our practicability to extend VDSL connections before accepting the equipments with VDSL ports . So much of unloaded NGN BB ports are available with all NGN exchanges. While Kerala trying for a break even, at least during this FY dumping of these equipments may pull down the financial performance of our Circle. CGMT shared our concern and replied that Kerala Circle request for very minimum equipments only.

 

Availability of at least one  BSNL staff in every exchanges :

In the very competitive telecom market , BSNL is blessed with a plenty of telephone exchanges at almost all important places. We suggested the need of at least one BSNL staff per exchange to maintain the customer base and expanding the same. The multiple difficulties due to the staff unavailability are discussed. CGMT assured to do the same without delay.

 

withholding of pension benefits of erstwhile O-JTOs in Kerala :

It is very unfortunate that withholding of pension benefits of erstwhile O-JTOs started happening recently in some BAs of Kerala Circle challenging Kerala Circle office clear directions in black and white as Letter No. HR-III/2-5/JTO(o) Pay Fixation/2012/Part-1/52dated 16/08/2016  .Kerala Circle released the letter based on Corporate Office Letter on 03-06-2016 obeying various court directions . The wrong and confusing fixation of pay of O-JTOs period under FR221a1 in connection with 2nd PRC ; CO Letter no 3-32/2013/Estt-IV is already challenged in PCAT ND by AIBSNLEA. It is coming up for hearing on 12th Sept 2019. For all the erstwhile O-JTOs pay revision as on 01.01.2007 ( 2nd PRC)  can only be done on the JTO pay scale of 9850-200-14500 as it was done for others employees . AIBSNLEA CHQ , in many times , requested Corporate office through detailed letter to issue instruction for revision of pay as on 01.01.2007 for the officiating JTOs with respect to the basic pay they were drawing in the pay scale of 9850-14500.

Hon. CAT/HC and SC are already verdicted very favorably to fix the pay of these officiating JTOs as FR 22(1)(a)(1) without the restriction of FR35. Subsequently,  BSNL has extended the pay fixation benefit on officiating promotion under FR22(1)(a)(1) in the pay scale 9850-14500. Thus naturally no legitimate ways for either withholding or recovery of any single paisa from the pension benefits of these executives.

After long discussion on the matter , we requested CGMT to issue clear instructions to all BAs to not withheld /recover any amount from pension benefits of erstwhile O-JTOs and  release all the amount withheld from pension benefits , if any . CGMT directed GM(A/HR) to issue instructions to BAs in this regard and get more clarifications from Corporate office if needed.  

 

Pending requests transfer orders  for   LICE JTOs who had been posted  in Feb 2017 :

We requested to release all the JTOs. Almost all of them can be released without any substitute since sufficient JTOs are available .In  Thrissur around 5 JTOs joined back after their long stay tenure . Thus all the requesters from Thrissur could  have been released . Many times we have requested the same at all levels of DGM/GM/CGM. CGMT assured to release them shortly.

 

Pending high range Company coat transfer to  bring  back two year tenure completed executives in Ernakulam BA :

This pending matter is discussed with CGMT and we requested to do the same as per the directions from corporate office that CGMT can exercise the provision. On our strong request , CGMT directed GM (A/HR) to do the same.

 

Unprecedented date of joining of LDCE JTOs in the F/N of 31/12/2017 (Sunday) instead of 01/01/2018 at Ernakulam BA: 

The matter of a large anomaly in our circle is discussed seriously and the trailing letter is submitted to CGMT. Copy of this letter is submitted to GM(A/HR) and DGM(HR) 

 

Sub:-  Unprecedented permission for date of joining of LDCE JTOs in the F/N of 31/12/2017 (Sunday) instead  of the legitimate date 01/01/2018 at Ernakulum BA challenging all rules and regulations in BSNL : no action rather helplessness from Kerala Circle against the wrong doing  propelling individual / association  to move court against the stoic silence of Circle management reg

 

Kindly recall the matter in subject that many times we have submitted to your kind notice but no action has been initiated from your office, so far. As per the letter AGM(AdmnLr. No.ST/EK-214/LDCE/LICE/2016-17/JTOs/109  dtd  30/12/2017, Ernakulam BA has issued posting order to 10 LICE JTOs  who have completed their induction training w.e.f.25/09/2017 to 02/12/2017 from RTTC TVM/ CTTC Indore and field training from 04/12/2017 to 30/12/2017 at ENK BA are permitted to join on Sunday , 31/12/2017  on mysterious reasons . Even though the cadre is technical and they were posted to various field units, no controlling officer will be available in the office on a closed holiday for their reporting and also they were not assigned any duty on that day.  .

 

As you are aware of, after training almost all executives/non-executives are relieved from training centre on the F/N of Saturday , if not second Saturday and they can join on subsequent Monday only . It is learned from circle office that , after the wrongful doing of  Ernakulam BA , many requests seeking permission to join on Saturday are turned down citing the prevailing rules not permitting the joining on Sunday. Hence, we strongly request your good office to either revert the joining date of these 10 JTOs to the eligible date of 01/01/2018 or permit all executives/non-executives who have joined on Monday after their basic training to join on Sunday to enjoy benefits if any. Otherwise it will initiate an exodus of litigations of such cases right from the beginning of DOT/BSNL. Further, Circle Office Kerala only would be responsible for the same 

 

Sir, we request your good office to have an enquiry into the background that leads the  serious lapse of clear nepotism challenging all the BSNL rules and regulations for the better performance of Kerala Circle . Kindly share the findings of the lapses to the undersigned.

 

After wide discussion, CGMT convinced the real mysterious irregularity happened at Ernakulum BA and directed GM(A/HR) to issue immediate directions  to PGM Ernakulam to clear off the wrong doing .

We submitted that understandably the file for the same is with CGMT for some time and requested to release the promotion orders without delay. CGMT assured to release the orders shortly.

 

Pending AO-CAO LA promotion orders :  

We requested to release the promotion orders. CGMT replied that no file is pending in this regard . All DS are requested to assess the vacancies in your BA and initiate the process of sending the request to circle office .

 

All other pending cases were also discussed. We extended sincere gratitude to CGMT Dr.PT Mathew for his kind consideration to all our grievances.

 

Later we met GM (A/HR) Shri.Sathesh R and elaborated all the points those CGMT directed GM(A/HR) to act. GM assured to take up all the matters without delay.

REVIVAL OF BSNL & MTNL :  It is reliably learnt that DoT has finalized a revised Cabinet Memo for the Revival of BSNL and MTNL on the basis of the Group of Ministers recommendation  and the same was approved by the Hon’ble MOC. The Cabinet Memo has been sent to all the concerned Nodal Ministries for comments and will finally be sent to the Cabinet for consideration and approval. The Salient features of the Cabinet Memo are:-

 

1) VRS Package to BSNL/MTNL employees: VRS Package to BSNL/MTNL employees who are attaining the Age of 50 & above wherein they will get 25% more than the Gujarat Model towards Ex- gratia and Ex-gratia will be paid in cash as detailed below.

a) The Employees opting VRS will get cash payment of Ex- gratia amount in single go or maximum 5 instalments on 
   optional basis for availing Income Tax benefit.
b) The formula for VRS Package is (Ex-gratia+Pension) or 125% of the salary, whichever is less.

c) The Employees having 40 months Service left will get full Salary benefits.  

d) Leave Encashment & Pension (without Commutation) will be paid at the time of VR but the Gratuity and Commutation Value of Pension Payment will be deferred till they attain the age of Superannuation (i.e., 60 Years) or after 5 years. During the intervening period from the date of VR to the date of attain the age of 60 Years, Employees will get interest @ 8% on their Gratuity amount.  

e) The Ex-gratia amount for VRS will be paid by BSNL/MTNL by issuing of Bonds on the basis of the Sovereign guarantee given by the Govt. of India. 50% of interest liability on bonds will be born by Govt.

 Through this process, Govt. will ensure reduction of about 70% staff.

 

2) The roll out of age from 60 years to 58 years: After implementation of VRS, the roll out of age from 60 years to 58 years in respect of BSNL/MTNL employees will be effective from 01.01.2020.

 

3) 4G Spectrum allocation to BSNL/MTNL: Rs.14,000 and Rs.7,000 crs +GST  will be borne by the Govt for 4G Spectrum allocation to BSNL/MTNL.

 

4) Merger of BSNL & MTNL: The debts of BSNL/MTNL will be transferred to the Special Purpose Vehicle (SPV) created for this purpose and after zero debt of both the Companies BSNL and MTNL will be merged. The Special Purpose Vehicle will take care of the Capital expenditure of the Company. The Debt/Loan of BSNL as on date Rs.19000 Crs and anticipated Debt/Loan to the tune of Rs.4000 Crs. will  be taken over by the  Special Purpose Vehicle with equivalent Land parcels.

 

5) Monetization of Assets of BSNL/MTNL: Monetization of Assets of BSNL/MTNL will be done by the respective PSUs in consultation with the Committee being formed with the approval of the Hon’ble MOC which will have DoT/BSNL/MTNL/DIPAM Officers and the funds will be utilized only for BSNL/MTNL.

 

But DoT has not invited the Recognised Associations and Unions of BSNL who are the equally Stake holders of the Company for discussing about the Revival Plan of BSNL , even though AIBSNLEA as well as AUAB have written the letters to the Hon’ble MoC for inviting us for discussions regarding the Revival Package. However, keeping in view the present scenario & above developments, AUAB has decided to conduct the meeting on 01.08.2019 to discuss about the future course of action.

 

AIBSNLEA will strongly oppose the roll out of Retirement Age from 60 years to 58 years which is in violation of Absorption terms and conditions of BSNL Employees and threat to Job Security.

REVIVAL  OF BSNL &MTNL :  It is reliably learnt that DoT has finalized a Cabinet Note draft for the Revival of BSNL and MTNL and has submitted to the Hon’ble MOC for approval. Thereafter it will be sent to all the concerned Nodal Ministries for comments and will finally be sent to the Cabinet for consideration and approval. The Salient features of the Cabinet Note are

3) 4G Spectrum allocation to BSNL/MTNL: Rs.14,000 and Rs.7,000 crs will be borne by the Govt for 4G Spectrum allocation to BSNL/MTNL.

 

4) Merger of BSNL & MTNL: The debts  of BSNL/MTNL will be transferred to the Special Purpose Vehicle (SPV)created for this purpose and after zero debt of both the Companies BSNL and MTNL will be merged. The Special Purpose Vehicle will take care of the Capital expenditure of the Company.

 

5) Monetization of Assets of BSNL/MTNL: Monetization of Assets of BSNL/MTNL will be done by the respective PSUs in consultation with the Committee being formed with the approval Hon’ble MOC which will have DoT/BSNL/MTNL/DIPAM Officers and the funds will be utilized only for BSNL/MTNL.

 

AIBSNLEA will strongly oppose the roll out of Retirement Age from 60 years to 58 years which is in violation of Absorption terms and conditions of BSNL Employees and threat to Job Security.

Date of joining of LDCE JTOs in the F/N of 31/12/2017 (Sunday) instead of 01/01/2018:

 

As per the letter AGM(Admn) Lr. No.ST/EK-214/LDCE/LICE/2016-17/JTOs/109 dtd 30/12/2017, posting order has been issued to 10 LICE JTOs who have completed their induction training w.e.f.25/09/2017 to 02/12/2017 at RTTC TVM/ CTTC Indore and field training from 04/12/2017 to 30/12/2017 at ENK BA are permitted to join on Sunday , 31/12/2017  on mysterious reasons , Even though the cadre is technical and they were posted to various field units, no controlling officer will be available in the office on a closed holiday for their reporting and also they were not assigned any duty on that day. It has been conveyed to them that as per presidency of BSNL and permitted rules they could join only on 01/01/2018 .

 

We argued that it will start multiple litigations for a large number of such cases right from the beginning of DOT/BSNL. DGM (HR) totally shared the concern and informed that some individual request seeking permission to join on Sunday/holidays reached circle office at many times and those seeking were outrightly turned down stating the prevailing rules . Such cases cannot be permitted by rules. The case happened at Ernakulam is unaware and suggested to represent with details . We would represent the case afresh.

 

 

Pending Transfer orders on Request of JTOs and other cadres & High range rotational transfer at Ernakulam BA:

We sought the status of the cases. DGM(HR) replies that as per AIBSNLEA’s  discussion with GM(A/HR) during the last meeting , Circle office is exploring the possibilities of releasing the orders without affecting the working of BAs. We requested to speed up the matter and  madam assured to do the same.

 

 

Regularization of the date of Promotion of AGMs/DEs as 29.6.2018: We sought the delay in releasing the very legitimate order to regularize of the date of Promotion of AGMs/DEs as 29.6.2018 irrespective of their date of joining duty to avoid the discrepancies among the first order and subsequent orders from AGM (Pers.I) BSNL CO, New Delhi Letter dated 4.7.2018, 5.7.2018 & 6.7.2018. 

 

DGM(HR) replied that as per the request of AIBSNLEA , competent authority approved the correction on date . The subsequent order to be released to CO/BAs is ready and submitted to GM (A/HR) for information. It will be released to all field units today or by tomorrow. Later we met GM (A/HR) and he assured to release the orders without delay.

Congrats comrades…

The pending transfer orders of AO/JAO and AO to CAO (LA) orders are released without anymore further delay due to the timely intervention of AIBSNLEA at PGM-F level. We extend sincere thanks to PGM F Shri.KK Vel  for his kind intervention to fulfill the  assurance to us on 02-07-2019 .  AO-CAO (LA) orders are released partially. CAO-DGM(LA) orders are also pending . We are on our efforts to release these orders .

 

Now the only pending transfer orders are that of LICE JTOs . We submitted all the details to the CGMT , GM(A/HR) and at DGM(HR) level that almost all of them can be relieved without substitute due to availability of sufficient executives at the BAs. For example in Thrissur BA recently 6 executives of JTO/SDE cadres joined. Hence, all the transfer requesters from this BA can be relived immediately.  It is understood that circle office is exploring the possibility. Hopefully these transfer orders would be issued shortly

AIBSNLEA team  met  Shri P K Purwar , CMD BSNL  and welcomed / felicitated him on assuming the High Office of CMD,  BSNL . we assured him our best cooperation for turning out BSNL and to achieve its pristine glory . On the issue of Revival of BSNL / MTNL CMD mentioned that  Secretary (T) also met Cabinet Secretary yesterday and discussed the Revival plan of BSNL on that basis matter will go to Digital Commission and  with the recommendation of DC, matter will go to Union Cabinet for consideration and approval. Hwe further mentioned that he has taken over the charge of CMD BSNL on  very critical situation when BSNL Revenue has drastically come down and the loss this FY 2018-19 will be about Rs 14000 crores . wage payment liability  is  also around  Rs 14000 crore . Now we have to take certain steps to reduce the expenditure and concentrate on operation and maintenance of BSNL network . salary payment will be the second priority. In this process people have to ready for some sacrifice .He further mentioned that  the Revival plan of BSNL /MTNL  has now been finalized. He appealed for extending support during this critical period.

CS Com.Shaji and CVP Com.Rajan  met PGM F on 01/07/2019 and expressed our strong resentment on not issuing pending transfer orders of AOs who have completed two years of tenure as assured by PGMF. We submitted that the ERP release of executives in engineering cadre,  who have already under order of transfer after tenure completion , has been done sharply by administration as assured to AIBSNLEA. In accounts vertical very minimal transfers only happening occasionally and that too delaying beyond assurances not seems fair. Orders for DGM LA are also not happened as agreed.

PGM F patiently listened all our arguments and shared our concerns. He stated that he has given clear instructions to the concerned as assured to AIBSNLEA and having hope that already orders are issued. He assured to look into the lapses and release the orders without delay.

Meeting with PGM (Pers.), BSNL CO: GS, President met PGM (Pers) and discussed regarding the status of DE to DGM (T) Promotion. PGM(Pers)   mentioned that the Legal opinion has been obtained from the BSNL Panel Advocate wherein he has opined that clearance from the Hon’ble CAT, Chandigarh is required to be taken before issuing Promotion orders since the MA has already been filed. However, BSNL’s Advocate has opined that in case the Applicants give Affidavit of No objection in the Hon’ble CAT, then BSNL can proceed for Promotions.

Com.GS spoke with Com. Naresh Thakur , one of the Applicant and convinced him that since all the Applicants are being covered in the DE to DGM(T) Promotion on Adhoc basis they should consider to file Affidavit for No objection to allow Promotion of DGMs. Com.Naresh Thakur and others in his case has agreed to give Affidavit for No objection. Com. Pritam Chand and others have also been requested by Com.Naresh Thakur to submit Affidavit for no objection to allow DGM (T) Promotions on Adhoc basis. In case the Affidavits for NOC are given by the applicants by tomorrow then the Promotion orders of DGM (T) will be issued immediately.

Meeting with CGMT Kerala:

CS and ACS met CGMT Kerala Dr.PT Mathew on 20-06-2019 and discussed about the prevailing service issues of BSNL Kerala. We expressed our heartfelt sorrow on the present hard time BSNL is passing through due to some reasons  for shutting down of BTS by  infra providers  due to non-payment of rents , unavailability of  labors for the maintenance of BSNL services , unavailability of vehicles etc . CGMT patiently listened our wordings and shared all our concerns. We extended our sincere appreciation to CGMT  Dr.PT Mathew  on his relentless efforts to keep up the  access networks  in these difficult periods by extending uninterrupted services to beloved customers through  migrating shut down BTS to other  infra providers , at least partially ,  while some circles are just mute spectators on this issue.

 

We requested to explore shutting down of the non-profitable BTS/Exchanges to reduce the debt of Kerala Circle in the situation wherein no financial support from the concerned. On an average BSNL spends Rs.45,000 per month  per BTS but the earning falls below Rs.10,000 in some locations . Same is the case of some telephone exchanges. How can we bare the bleeding without financial assistance from the concerned? CGMT directed us to escalate the difficulties to CHQ level for a speedy solution that revitalize our BSNL .

 

We discussed all the pending HR issues viz

ERP relieving of all the request transfer orders of SDE/JTO released in April 2019 , Considering request transfer of  LICE JTO 2013-14 . We suggested that all these JTOs who are requested for transfer can be released without substitute as more than 500 numbers of JTOs as LICE ,DR ans Rule 8 . We submitted the full details of the statistics to him ,  Regularization of the date of Promotion of AGMs/DEs as 29.6.2018 , Pending PA-PS promotion orders etc. CGMT was very positive on all the request from our side.

 

Meeting with PGM(F) Kerala Circle :

CS , ACS , CVP , DS TVM , DFS CO and Com. Srejith (JTO PG ,CO) CEC Member  met PGM-F Shri. KK Vel  on 20-06-2019 and discussed the financial stage of BSNL and pending HR issues of Accounts Comrades.

 

PGM (F) well portrayed the dilapidated financial condition of BSNL and that of Kerala circle. We could only share his concerns. He exhorted to earn more revenue by all possible ways to come out of this present crisis.   

 

We requested to release the pending transfer orders of AOs . He assured to release the orders in this month itself . PGMF added that the promotion orders for CAO to DGM(LA) is under process  on our request and the same will be released in this month .  DGM(F) Shri.Kumar was also present .

 

 

Meeting with GM HR/Admin Kerala Circle :

CS , ACS , CVP , DS TVM , DFS CO and Com. Srejith (JTO PG ,CO) CEC Member met GM(A/HR) , Kerala Circle , Shri. R. Sathesh on 20-06-2019. GM was very positive on all our request  . We requested to relieve in ERP  for all the pending request transfer orders of JTO/SDE released in April 2019. GM assured to do it on 29-06-2019 . We requested to regularization of the date of Promotion of AGMs/DEs as 29.6.2018 as it was done for all other subsequent SDE-AGM promotion orders. The same has been already done by other circles. He assured to release the regularization order without delay. On the request transfer orders of LICE JTO batch 2013-14, we requested to release the orders .GM  assured to consider it after consulting CGMT Kerala .

 

Meeting with DGM HR Kerala Circle :

CS , ACS , CVP , DS TVM , DFS CO and Com. Srejith (JTO PG ,CO) CEC Member met  DGM(HR) Smt. Ponnammal R and appraised about the meeting with CGMT and GM(HR) . Madam assured to execute all the commitments without delay.

Status of JTO to SDE Promotion case at Hon’ble High Court Ernakulam:

The Review Petition filed by the BSNL for the JTO to SDE Promotion case in the Hon’ble High Court Ernakulam came up for final hearing on 20.6.2019. From BSNL Corporate Office, New Delhi DGM (Pers-S.M) & and AGM(Pers-Legal) were deputed to Ernakulam. Senior Lawyer from New Delhi argued the case on behalf of BSNL. Arguments were completed and the Judgement is reserved. The proceedings on the Contempt Petition are stayed till the Judgement is delivered.

Meeting with Shri Ravi Shankar Prasad ji,  Hon’ble of  Minister for Communications, Law and Justice and Electronics and Information Technology:

GS and President met Shri Ravi Shankar Prasad jiHon'ble Minister of Communications, Law and Justice and Electronics and Information Technology, New Delhi and welcomed / felicitated him on assuming the High Office of Hon’ble Minister of Communications, Law and Justice and Electronics and Information Technology and requested for early 'Revival of BSNL'. GS and President met Shri Sanjay Shamrao DhotreHon’ble  State Minister for Communications, New Delhi  and   welcomed / felicitated him for assuming the High Office of Hon’ble of State Minister for Communications.

We have invited the Hon’ble MOSC as Chief Guest for our 6th All India Conference scheduled to be held at Vijayawada. Hon’ble MOSC replied that he was pre occupied due to Parliament session and it is very difficult to attend the Conference.

GS explained in detail about the present financial status of the BSNL viz nonpayment of Electricity bills, Vendor bills, Rent bills, Mtce., work bills, Housekeeping bills etc.,  and dip in Revenue  & cash flow and requested for the 1)  immediate  Financial support to BSNL 2) Allotment of  4G Spectrum and 3) Revival of BSNL. He also explained about our long pending demands of non-settlement of 3rd PRC with 15% fitment benefits, Pension revision and Pension Contribution on actual basic pay.

After patient hearing Hon’ble MOSC replied that the DOT and the Govt. is working out the Revival Plan of BSNL and directed us to come with suggestions and alternative solutions in writings for discussions to sort out the financial crisis of the BSNL. But Hon’ble MOSC is non committal about 4G Spectrum allotment to BSNL.

Meeting with PGM (Pers.), BSNL CO: GS, President and AGS ( F) met PGM (Pers) in the presence of DGM(Pers.SM) and discussed regarding

(a) DE to DGM Promotion- We requested to expedite the CPC from DE to DGM Promotion on Ad-hoc basis. PGM (Pers) mentioned that Pers. Branch has released the Seniority list of DE/AGM(T) Regular, including DGM (T) Adhoc, working on the post as on 01.05.2019 and promoted prior to 01.04.2018 as per Rule 206 for promotion to DGM (T) Adhoc in the Public Domain after approved by the Competent Authority and now the CPC from DE to DGM to fill up about 1350 DGM (Engg.) posts i.e., the vacancies up to the month Dec 2019 has been taken into account to conduct CPC . He also mentioned that as per the legal opinion of CGM ( Legal), MA is being filed in the Hon’ble Chandigarh CAT vacation Bench working at Hon’ble PCAT New Delhi along with DE/AGM (T) Regular Seniority list as an urgent petition to take clearance from the Hon’ble CAT, Chandigarh. After the clearance from the Hon’ble CAT, Chandigarh, the CPC from DE to DGM (Adhoc) will be conducted. We pleaded the PGM (Pers) that CPC from DE to DGM is to be conducted only on Adhoc basis and hence it may be conducted immediately and promotion orders can be issued subject to outcome of the various Court cases. After detail discussion, PGM (Pers) assured to look in to the matter and conduct the CPC shortly.

(b) Utilization of MT Quota 336 CAO Posts- We requested to take the approval of BSNL Management Committee for utilization of 336 MT Quota CAO Posts for Ad-hoc promotions. PGM (Pers) directed the DGM(Pers) to process the MC Note for approval in this regard.

(c) Consideration request transfers in the cadre of DGM (T): 
We requested PGM (Pers) to consider the request transfers in respect of DGMs who have completed two years tenure and also in the verge of retirement. PGM (Pers) assured to look in to the matter. 

(d) Change of Reporting Structure of E.Z.N.C. from West Bengal Telecom Circle to Kolkata TD - Consideration of retention of of Executives as per their options:  We requested PGM (Pers) to consider the options received from 18 Executives from WB Circle for retention at WB Circle due to change og Reporting Structure of EZNC from WB Circle to Kolkata TD. PGM (Pers) assured to look in to the matter. 

(e) Allowing option in pay fixation  to JAOs who came through 10% LICE quota: We requested the PGM (Pers.) to allow  exercising the option in the pay fixation for JAO 2010  Batch 10% quota LICE candidates from the date of promotion  as already given to JAOs of 40% of LICE quota 2010 batch.  PGM (Pers.) informed that the matter is pending in Establishment Cell for comments. He assured an early action in this regard.

CHQ President Com.Sivakumar ji attended the GB & Retirement facilitation for the retired comrades   hosted by Ernakulam BA on 07.06.2019 at YMCA Hall Ernakulam . CP Com. Vijayakumar and CS Kerala Com.Shaji V were also  attended the successful GB .

CHQ President in his hour long speech explained all the activities being carried out at CHQ level under the relentless leadership of Com.Prahlad Rai , GS AIBSNLEA . All the thousands of promotion orders of executives are released by the dedicated and sincere efforts of AIBSNLEA. The continuous efforts of CHQ to release the pending promotion orders of DE to DGM ,  AO to CAO , JTO to SDE etc and Extension of FR 22(1) (a) (i) benefits to the Ex. Officiating JTOs w.e.from 1.1.2007 , Regularization of the date of Promotion of AGMs/DEs as 29.6.2018,  Diversion / utilization of  50% MT (internal ) of CAO post quota to the seniority quota, Post 2007 batch pay anomaly, Long pending Pay anomaly of the executives in civil wing were also explained .

 

CHQ president convinced the house about the single-handed efforts of AIBSNLEA for the whole executive community of BSNL. He exhorted to convince these facts to all executives of BSNL .

Meeting with GM(A/HR)…..

 

CS Com.Shaji   and  CVP Com.Rajan  met GM(A/HR)  Shri. Sathesh and discussed about the long pending reliving of the executives (JTO/SDE) who are on request transfer as per the transfer order released by circle office in April 2019. We have reminded him the very long pending request.  We further reminded that during last year the executives transferred are relieved forcefully in ERP just after one month but this time it has not been happened even after around 2 months period . GM listened all our arguments very empathetically and assured to relieve them without delay.

 

While discussing the long pending request of AIBSNLEA to release all the request transfer orders of executives who have completed two years of service , especially the transfer orders for the first batches of LICE JTOs , GM assured to consider the requests without delay based on the powers authorised to the CGMT Kerala  by corporate office . We extended our sincere regards to both CGMT and GM(HR) in anticipation.  

 

Meeting with PGM(F)…..

 

CS Com.Shaji  , CVP Com.Rajan and DFS Com.Salih met PGM(F) Shri.K K Vel and discussed on the financial position of BSNL Kerala . The real portrait of the financial position of BSNL is quite disheartening. He requested to explore all possibilities to add more and more revenue to the survival of BSNL . We assured to do our level best.

 

We requested to release all the request transfers of accounts officers who have completed 2 years . PGM assured to release it in June itself . PGM also assured to release promotion orders of DGM(F) and CAO  against vacant posts in BAs  without delay. AIBSNLEA has been requesting for the same.

Meeting with DGM (Pers-SM): GS, President and met DGM (Pers-SM) and discussed regarding CPC from DE to DGM(Engg.) . we requeted to expedite CPC from DE to DGM on Adhoc basis. DGM( Pers-SM) mentioned that as per the Hon’ble CAT Chandigarh direction , the seniority list of Desis being finalized .and being submitted to the competent authority for approval shortly . He assured that as soon as the DE seniority list finalized the CPC process will be completed .

 

Meeting with Sr.GM (Estt): GS, President met Sr.GM (Estt) on 17.05.2019 and discussed regarding

 

a)     Cancellation of GTI Nominations erroneously given and requested for Refund:  We requested for Cancellation of GTI Nominations erroneously given by the Executives in various Circles while opening of ESS Portal and refund of the wrongly deducted amount in March 2019 Salary on the basis of the list of Executives of various Circles furnished by AIBSNLEA  and Various Circles. Sr.GM (Estt) confirmed that a Committee headed by Sr.GM(Estt.) & Members as GM(SR), GM(CA) and GM (Trg.) along with association representatives has been constituted to discuss the matter in consultation with LIC authorities to get refund the GTI payment wrongly paid by some executives. We requested to convene the meeting at  the earliest to resolve the issue. Sr.GM(Estt.) assured an early action in this regard.

     b) Extension of FR 22(1) (a) (i) benefits to the Ex. Officiating JTOs w.e.from 1.1..2007: We requested Sr.GM (Estt) to generalize the BSNL CO order dated 15.11.2018 regarding the fixation of Pay under FR-22 (1) (a) (i) with effect from 1.1.2007 to the officials, who were screening test passed & were officiating in the grade of JTO, to all Circles instead of limiting to some Circles alone and we also requested to withdraw the wrong Fixation order dated 22.12.2015. Sr.GM (Estt) further assured to discuss the matter with the concerned DGM(Estt) for early settlement and advice us to explain the matter in detail to concern DGM(Estt.).

DE to DGM promotion:

AIBSNLEA is making sincere efforts for DE to DGM promotion to fill-up all vacant DGM posts on Adhoc basis. Accordingly Pers. Cell of BSNL CO has initiated the process of DE to DGM promotion by calling APAR and VCR. All the APAR/ VCRs  of the eligible DEs have been received in Pers. Cell. The approval for conducting CPC from DE to DGM yet to be received by Pers. Cell from the competent authority. The seniority list of SDEs have been finalized by Pers. cell on the basis of rule 206 and has been submitted to the competent authority for approval. After the approval on SDE seniority list,  the DE seniority list is finalized and will be submitted to the competent authority for approval. As per the direction given by Hon’ble CAT Chandigarh CPC will be expedited on finalization of DEs seniority list.

 

The CPC will be expedited after the approval of the competent authority   on SDEs and DE seniority list only. Thus promotion orders from DE to DGM may be expected in the next week only.

 

Some associations is demanding DE to DGM promotion on regular basis ignoring the fact that the DGMs promoted on regular basis will not be governed by EPP and will be deprived from getting time bound promotion in E6 grade which is due in most of the cases in the month of October 2019. Most of the DEs are at present stagnated in the E5 grade, and on getting E6 grade under EPP they will be benefited by Two increments. In case these DGMs are promoted for regular basis  then they will be govern by BSNL MSRR provisions only and will be entitled for next time bound promotion in E7 grade  after 5 year as Jt. GM.

 

Thus these regularly promoted DGMs will be debarred to get benefit of Time bound promotion in E6 grade under EPP.  The fact remains that most of the DGMs being promoted in CPC will retire within 5 years in the grade of E5 only. In this manner these executives will be getting two increment less in their pay as well as pensionery benefits.

 

Some Association is claiming that let these promotion order be issued on regular basis thereafter they will get modified /amended the BSNL MSRR / EPP provisions. It is pertinent to mentioned that this association is well aware of  present ruling position then why they kept mum so far for amending the rules and how they are confident to get amended these rules immediately . it seems this association is interested to put these DGMs in Financial loss for their whole life for which reasons are best known to them. AIBSNLEA knowing all these facts is demanding DGM promotion on adhoc basis immediately and DGM regular promotion after Nov 2019.

 

DOP&PW advice to DOT on VRS in BSNL / MTNL: It is understood that DOP&PW has given advice to DOT on implementation of VRS in BSNL/MTNL i.e. VRS scheme proposed by DoT is as per DPE guidelines and is relevant for the employees of PSUs, who do not get pension under CCS Pension Rule on Volunteer Retirement. The pension of BSNL/ MTNL employees is regulated by CCS Pension rule and the same is paid by the Govt. from Consolidate Fund of India. Rule 37 A of CCS (P) Rule provides for volunteer retirement after completion of 10 years combined qualifying service these employees of BSNL/MTNL could be encouraged to go on volunteer retirement under the existing rule 37 A instead of offering the Ex gratia in addition to the normal pensionary benefits available in terms of rule 37 A of CCS (Pension) rules.

 

In accordance with the rule 37 A of those rules, their pension is also be paid by the Govt. DoT may, therefore, examine in consultation with DoPT whether, instead of offering them a Special Volunteer Retirement Scheme (VRS), these employees could be transferred to surplus cell for redeployment in DoT or other Govt. Departments of the Central Govt. for the remaining period of their service in accordance with the scheme of DoPT for redeployment of the surplus staff.

 

From the above, it seems that DoP&PW is not in favour of imposing VRS to those employees who have taken absorption in BSNL/MTNL and opted for combined service and are governed for Govt. pension under rule 37 A. Hence, AIBSNLEA demands DoT/ Govt. to extent financial support to BSNL/MTNL for their growth , maintenance & operations as per the recommendation given by the GoM earlier in 2013-14.

CS and DS TVM met GM(A/HR) , Kerala Circle , Shri. R. Sathesh  and requested to relieve off all officers who are under order of transfer in ERP without delay . He replied that some executives are already relieved. He assured to consider our request after contacting BA heads.

 

Regularization of the date of Promotion of AGMs/DEs as 29.6.2018: We requested to regularize of the date of Promotion of AGMs/DEs as 29.6.2018 irrespective of their date of joining duty and extension of subsequent benefits if any with respect to the date of Promotion on 29.6.2018 pursuant to the instructions contained in AGM (Pers.I) BSNL CO, New Delhi Letter dated 4.7.2018, 5.7.2018 & 6.7.2018.  As of now all the  AGMs/DEs promoted on the first list stands en block junior to all other AGM/DEs joined subsequently . As per the latest Apex court direction, the date of joining is the criteria to fix seniority. GM assured to look into the matter on deserving merit.

 

Release of transfer orders on request of two year completed LICE JTOs : We requested to issue the transfer  orders due to availability of sufficient JTOs in the BAs. Moreover these unlucky JTOs requested transfer belongs the first JTO batch. All the subsequent batches of JTOs luckily got posting in their parent BA. This is a matter deserving appreciation to management, but the seniors are not brought back yet to parent BA is an unhappy situation. GM assured to discuss the matter with CGMT for a fruitful result.

CS , CVP and DS Pathanamthitta Com.Abhilash met DGM(HR)  Smt. Ponnammal R and enquired about the status of pending Financial up gradation orders .  DGM(HR) replied that as demanded by this association , all the pending Financial up gradation orders up to E3-E4 have been released for the  VCs received . Fresh VCs are called for the pending cases. DSC , Department Screening Committee , for E4-E5 and E5-E6 to be chaired  by CGMT .  DSC for E4-E5 and E5-E6 has also been convened. Almost all the cases are considered.  E4-E5 and E5-E6 up gradation orders will be released this week itself. All the pending cases will be released subsequently.

 

We requested to initiate ERP release of all the executives who are under order of inter BA transfer so that they can join back to parent BA without delay. This practice is being followed in Kerala Circle. DGM(HR) assured to take up the matter .
