: CHQ News Meeting with CMD BSNL
and Director(HR) BSNL Board: GS, President, AGS(Fin) and CS
Kerala met CMD BSNL and DIR(HR), while discussing the AO to CAO
Promotion orders we requested to generalize the BSNL CO order dated
15.11.2018 to all Ex Officiating JTOs. In this regard AIBSNLEA submitted a
letter to the DIR (HR) which was immediately marked to Sr.GM (Estt) for
discussion. CS Kerala
requested for allotment of sufficient funds for Kerala Circle for its growth
since it is a profit making Circle. On this issue CMD BSNL and DIR (HR)
mentioned that funds are being allotted to all the Circles on pro rata basis. |

: CHQ News Status of Court Cases: (a) DE to DGM (Engg.) Promotion case: DE to DGM (Engg.) Promotion case is heard today in the Hon'ble CAT
Chandigarh. Hon'ble CAT is ready to amend the order already issued by the
Hon'ble CAT Chandigarh and accepting for DE to DGM promotion on Adhoc basis.
But the Applicant's Advocate argued that Seniority List as per Catch up rule
to be prepared by BSNL and to be submitted to the Hon'ble CAT Chandigarh
since no Seniority List is available for AGM Grade. BSNL Counsel argued that
as per the latest Judgement of Hon'ble Supreme Court of India Catch up rule
need not to be applied for promoting 800 DEs to DGM on Adhoc basis, however
he assured that Eligibility List will be prepared and submitted by BSNL.
Hon'ble CAT Chandigarh has given one week time for the submission of DE
Eligibility List by the BSNL and the case is listed for next Hearing on
26.11.2018 (b) FR 22 (I) a (1) Pay fixation case of erstwhile Officiating
JTOs: OA No.100/892/2016 filed by AIBSNLEA in respect of FR 22 I (a)
(1) Pay fixation case of erstwhile Officiating JTOs is listed for hearing in
the Hon'ble PB CAT New Delhi today 19.11.2018 for final argument. Due to
paucity of time the case could not be heard and listed for next hearing on
21.02.2019. The contempt case filed by AIBSNLEA for the payment of Arrears
vide FR 22 (I) a ( 1) in respect of Ex Officiating JTOs is listed for hearing
in the Hon'ble PB CAT New Delhi on 30.11.2018. Today Executives
assembled in BSNL Corporate Office, New Delhi: AIBSNLEA BSNL
Corporate Office, New Delhi executives assembled in the office of Sr. GM(FP),
Director(HR), BSNL Board, CMD BSNL Offices to express their serious
concern against not issuing AO to CAO promotions, JTO(T) to SDE(T) promotions
& consideration of all the proposals of upgradation in all disciplines.
Sr. GM(FP) was reluctant to meet & discuss the matter. Then GS, President
along with other office bearers met Director(HR) and expressed the concern on
the above issues. Director(HR) mentioned that she has already directed
Sr.GM(FP) to process the case of AO to CAO promotions in the line of 2nd legal
opinion issued from Sr. Advocate for promotions and advised to meet Sr.GM(FP)
& CMD BSNL for further necessary action. Thereafter when Sr.
GM(FP) did not met and discussed the matter, AIBSNLEA representatives met CMD
BSNL & apprised the developments wherein some officers of BSNL Corporate
Office are stopping the promotions. CMD BSNL after detailed discussions
assured to discuss the matter with Director(HR) for issuing AO to CAO
promotions against vacant posts. CMD further informed that 3 days before he
has already cleared 17 nos. CAO to DGM(Fin.) promotion orders. We
extended thanks to clearing CAO to DGM(Fin.) promotions. We requested to fill
up 5000 vacant SDE(T) posts. CMD mentioned that let the contempt case in
Hon'ble CAT Kerala be decided ,promotion orders from JTO(T) to SDE(T) will be
issued. We further requested
to consider upgradation of the posts in the next higher grade to the eligible
executives for promotions in all the disciplines. CMD BSNL assured that let
the existing vacancies in CAO cadre & SDE(T) cadre be first fill up
thereafter immediately upgradation proposals will be considered. Click here

Successfully implemented the Rally on 14.11.2018 throughout India: As per the
call given by AUAB, rallies were successfully conducted throughout India for
the implementation of Five point Charter of demands. In New Delhi more than
2000 Executives & Non Executives of BSNL Corporate Office New Delhi, NTR,
NTP, Haryana, Rajasthan, and UP (W) Circles were actively participated
in the rally from BSNL Corporate Office to Sanchar Bhawan. At the end
of the rally, GS AIBSNLEA and other General Secretaries of the AUAB addressed
the gathering. After the
rally the AUAB Leaders met PS to Hon'ble MOSC (I/C) Shri.Saket Kumar, IAS,
and submitted memorandum addressed to Hon'ble MOSC(I/C) and discussed in detail.
PS to Hon'ble MOSC (I/C) assured to appraise to Hon'ble MOSC (I/C) regarding

Kerala was called for submitting our views on Revival of BSNL by the team IIM
Ahmadabad engaged by DOT for submitting revival plan for BSNL , yesterday on
02-11-2018. The IIM Team Comprise of Madam Prof: Rekha Jain , Prof: Ajay Pandey , Prof:Vishal Guptha and Shri.Miheer
Agnihothri . AIBSNLEA
got the first opportunity to submit
our views . We submitted all the relevant points to the IIM team for
the revival of BSNL in a very delightful way. Total interaction was there from
all team members to all our
suggestions and all points were noted after amiable discussions. Our presentation and discussions were
lasted for one hour. CS
Com V. Shaji , CEC Member TVM Com.Rajan and ADS CO Branch Com.Sherafudeen
were in AIBSNLEA Side . Shri.Robin Poddar GM(A/HR) and Shri.Satheesh Jt GM
were there as BSNL Management representatives. AIBSNLEA
clearly emphasizes that allotment of 4G spectrum and award of 3rd
PRC to BSNL employees with 15% benefits will be the two pillars to fix the
first stepping stone for the revival of BSNL .While submitting our view no
recommendation for VRS/CRS , committee sought clarification . As of now BSNL
suffering to meet funds for disbursing salary, now how can we expect a good
VRS package from BSNL employees ? , we replied. We further replied to the
comment , if DOT give money for VRS package ?, DOT must pump capital for
constructive activities of BSNL like 3rd PRC and 4G spectrum not
destructive activities like CRS/VRS.
While asking why are we against non-absorbers in BSNL , we submitted that
BSNL has very talented officers including absorbed ITS/IES and absorbed
officers in Finance department burning
for getting timely salary at least ,
the non absorbers simply enjoying facilities of BSNL those are barred for others, along with 7nth CPC benefits . In addition, they
are blocking promotion avenues of absorbed officers by occupying higher
posts. We
discontent another association’s suggestion that training only motivate
employees than 3rd PRC . Though training will definitely motivate
employees , the need of the time is 3rd PRC and 4G spectrum.
We
thank our hard core member and TVM branch office bearer Com.Noushad Lal ( DR JTO ) , a very dynamic faculty member
at RTTC Trivandrum for contributing very creative suggestions to the revival
of BSNL. We

with him on the omission of JTOs
(RY 2012) from JTO (T) to SDE (T) promotion under 67% SFC Quota due to
Discrepancy in Recruitment Year Allotment .( This
association Letter to CGMT No. AIBSNLEA/Kerala /2017-20/CHQ/130 dated
05-08-2018 and Letter No.
AIBSNLEA/Kerala
/2017-20/CHQ/136 dated
03-10-2018). DGM HR informed that as per the latest corporate office
order the RY is reconfirmed as 2012. We submitted the said order is to close
our legitimate demand of fixing RY as done in Chennai Telecom Circle. We
requested to take necessary actions on fresh individual requests of the
affected comrades to GM(Pers) Corporate office lighting the realities .
Already GS AIBSNLEA has written to Director
(HR),BSNL Board, regarding this matter . DGM assured to do the needful after discussing
with GM (A/HR). Regarding the Non consideration of 34 JAOs posted against the notified vacancy
of 2012 internal competitive exam (40%
category) to the recent AO promotions while all their fellow 2012-VY JAOs
were considered .( This association Letter to CGMT No: AIBSNLEA/Kerala /2017-20/CHQ/143 dated
10-09-2018) , DGM (HR) replied that a meeting of DGMs of HR/Fin/Legal had a
view that the matter can only be settled according to the finalization of SLP . We
discontented the decision and submitted that ways are there to regularize
these 34 JAOs if circle office desires. Already GS AIBSNLEA has written to Director
(HR),BSNL Board, regarding this matter . We decided to continue the discussion with
GM(A/HR) and with all concerned
DGMs at circle office. CS, DS TVM , CEC Member Com.Rajan and DFS CO Com.Muhammed
Salih met DGM(F) Shri.Kumar and discussed
the status of pending issues of Accounts department . We requested to send a befitting reply to corporate
office on the long pending transfer cancellation of Com. Sheril Ajith

GM (Pers) and discussed regarding A) JTO to SDE (T)
Promotion: We
requested GM (Pers) for the immediate issuance of Promotion order from JTO to
SDE for the 5000 vacant posts in the cadre of SDE (T). GM (Pers) informed
that the exemption application of CMD BSNL personal appearance in the JTO to
SDE Promotion Contempt case in the
Hon'ble CAT Ernakulam has been filed and the case is listed for
hearing on 29.10.2018 after the clearance
from the Court for CPC from JTO to SDE (T) will be expedited. BSNL has also
filed review Petition against the Hon'ble
High Court Kerala Judgement. B) AO
to CAO Promotion: We
resented against the delay in the process of promotion from AO to CAO on the
pretext of legal opinion. The stay order was vacated by the Hon'ble CAT
Chandigarh one and half month before but the promotion orders are not being
issued. GM(Pers) informed that a meeting is being hold by Director (HR) today
to discuss the matter and some break through will be made in this direction
to issue AO to CAO Promotion orders immediately. C)
CAO to DGM (F) Promotion: We
requested GM (Pers) to get approved CAO to DGM(F) CPC minutes
from CMD BSNL which is kept pending for more than one month. We explained the
GM (Pers) that no Contempt case or Stay is pending in any Court for the CAO
to DGM(F) Promotion and the CAO to DGM(F) CPC was conducted after the
approval MC of the BSNL Board. After detailed discussion GM (Pers) assured to
discuss the issue with the CMD for getting early clearance. AIBSNLEA efforts in
getting released about 13000 executives promotion orders through CPCs before
implementation of proposed CPSU Cadre hierarchy : After the
Membership verification AIBSNLEA was granted the 2nd Majority Association
status and later support Association. Even after winning in the 17 Circles and
losing in 14 Circles, AIBSNLEA was granted support Association status on the
basis of total votes secured. Against this AIBSNLEA filed a case in the
Hon'ble High Court Allahabad which is still pending for decision. After the
referendum the so called Majority Association impressed upon the Management
that they should only be discussed all the issues no other Association should
be heard or allow to function. This created great disunity among the
executives and Management very successfully divided the executives to their
convenience. So called majority Association instead of killing of other
Associations should have taken efforts with all Associations to bring them
together on the common issues for the betterment of executive cadres but they
avoided this. Present Status of
promotions through CPCs & CPSU CH: In view of
the Court cases on TES Group “B' seniority the promotions were held up. To
overcome with this situation AIBSNLEA proposed to implement CPSU cadre
hierarchy in the year 2012 and to achieve this AIBSNLEA, SNEA and
AIGETOA launched agitation programs in February 2013 under the banner of
United Forum of BSNL Executive Associations and thereafter a Committee headed
by the then PGM (FP) Shri S.R. Kapoor was constituted to discuss the
matter. AIBSNLEA, SNEA and AIGETOA were the members of the committee. But due
to serious difference of opinion between the staff side and management side
members of the committee could not submit the report. Again second time
the then PGM (SR) Shri N.K. Narang was made the Chairman of the committee but
this Committee also failed to submit the report. In the year -2015 after the
Joining of New CMD Shri Anupam Shrivastava the matter was further raised and
he was kind enough to further reconstitute the Committee headed by the Shri.
M.A .Khan the then ED (NB), GM (Estt.) and GM (EF) were official side members
and AIBSNLEA, SNEA and AIGETOA were the staff side members. After marathon
meetings Mr. Khan Committee submitted its recommendations. AIBSNLEA
constantly persuaded for the implementation of Khan Committee recommendations
but meanwhile BSNL Management started the MV process of Executive Association
which derail the process. Pers. Cell BSNL C.O. was not at all interested to
implement Khan Committee report on CPSU Cadre hierarchy and ignored the views
of other Executive Associations and in collusion with so called
majority Association diluted the Khan Committee report and tried to limit
functional promotions up to Sr. SDE level only etc. Against this
dilution AIBSNLEA strongly protested with CMD BSNL, Director (HR)
and they appreciated the concern of AIBSNLEA and directed PGM (Pers.) to
discuss the matter with AIBSNLEA wherein AIBSNLEA demanded Khan committee
implementation in the true sense i.e.
PGM (Pers.) after
detailed discussions incorporated some suggestions of AIBSNLEA
i.e. functional promotion up to AGM level, Jt. DGM designation E-5 grade AGMs
and bench marks on numerical basis etc. This got approved by the MC and
thereafter BSNL Board. AIBSNLEA persuaded
up to level of JS (Admin), DoT cum Govt. Nominee Director in BSNL Board for
improvement in Draft CPSU instead of the implementation of half cooked policy
with severe Bottlenecks . which yielded result as Board while giving approval
to CPSU cadre hierarchy directed to complete the ongoing CPCs before
implementation of CPSU CH. BSNL Board
approved the CPSU Cadre hierarchy with date effect from its date of
notification i.e. prospective date. It created path hole in CPSU Cadre
hierarchy concept and most of the existing executives are not benefited with
this policy. However, knowing this fact AIBSNLEA convince the BSNL Management
to held CPCs to promote all the eligible executives to the next grade on
functional basis before implementation of the CPSU Cadre hierarchy. BSNL
Management appreciated AIBSNLEA concern and conducted CPCs in all the cadres
and promoted about 13000 executives to the next higher grade on functional
basis. This could not be tolerated by the so called majority Association and
they protested against holding of CPCs and demanded to implement CPSU cadre
hierarchy only. But they failed and to create a road block and they demanded
parity among all the cadres which was not immediately possible as in all the
Cadre there was difference from DoT legacy. To stall the process of
CPCs filed contempt cases against CMD and Director (HR) for issuing
promotions. It frustrated the Management and finally all the promotions
through CPCs are stalled. AIBSNLEA is still trying that as soon as the
contempt cases are settled promotions should be made available through CPCs
immediately to benefit the executives' monitory and status. Now so called
majority Association is claiming that due to their pressure on CPSU Cadre
hierarchy, CPCs has taken place which is beyond truth. |

17-10-2018 The
biennial GB and Open Session of TVM branch of Kerala have been completed enthusiastically at
Hotel Chirag Inn , Trivandrum with the auspicious presents of AIBSNLEA
stalwart Leader Com.Prahlad Rai and CHQ President Com.Sivakumar along with
the guest of honor Shri.SS Thampi ITS , PGMT Trivandrum BA. Open
Session started by lighting the traditional lamp was welcomed by Com.Rajan DS
TVM . He elaborated the associational activities has been carried out for the
benefits of branch members and Thanked PGMT for the relentless support
extended to AIBSNLEA for all the genuine grievances submitted on his table.
Also he extended profound gratitude and thanks to circle body for the total
support in all activities of TVM branch. In the presidential address
Com.Ajayakumar DP endorsed the support of both Circle body and PGMT TVM and CE Civil , Kerala Circle. CS
Com.shaji narrated the wholehearted
support extended by GS and CHQ President to circle body in each and every
matters of Circle body taken up with CHQ including the latest matter of FR 22
1 a1 anomaly . He viewed that all BSNL employees are pushed to stress by
authorities in many ways lastly by discontinuing the basic medical benefits.
He narrated the healthy relations
AIBSNLEA having with circle management for solving the grievances of our
beloved members and expressed special thanks to PGMT TVM for the very
favorable epithetical consideration for employees grievances while holding
the post of CGMT Kerala CHQ
president in his half an hour long speech explained all the activities being
taken out by CHQ by our beloved and dynamic leader Com.Prahlad rai along with
him including 3rd PRC implementation , stoppage of the formation of Tower company
through court , 30% superannuation benefits to BSNL DRs , Contemptuous order
on FR221a1 , anomalies of 2nd
PRC and all . He informed that CHQ is hopeful in releasing the very pending
AO-CAO promotions within a couple of week time . GS
in his hour long speech opened the treasure of knowledge of the events in
BSNL and the fighting of AIBSNLEA to accomplish benefits for BSNL executives.
He beautifully portrayed the reasons for the present bleeding stage of BSNL
and the role of AIBSNLEA has been doing marvelously for protecting the
viability of BSNL . He explained the time line of activates he has
done so far for the much awaited 3rd PRC ending with the very
fruitful meeting with Hon’ble minister of Communication (I/C) Shri.Manoj
Sinhaji . He assured to continue his fight till the materialization of 3rd
PRC . Entire house reciprocated his efforts with applause full of energy. He
touched all the pending HR/Service matters . Regarding pending CPCs he opined that AIBSNLEA could
release more than 12000 long pending promotions and we are on the move to
complete all CPCs before the implementation of CPSU Cadre Hierarchy . He is

fortnight. AIBSNLEA is perusing for the release of DE to DGM , JTO to SDE and

Circle and Circle Management on holding up the top position revenue making
circle in BSNL . PGMT
Thiruvananthapuram thanked all speakers for their good words. He recommended
every employee to take all out efforts to improve revenue by marketing FTTH
and other services. He reminded the importance of earning more revenue for
the stability of BSNL and thereby enjoying more benefits to employees . PGMT stressed the need for enhancing our working style to
uphold the latest slogan “ BSNL AT YOUR DOOR STEPS” though
a good number of employees in TVM BA are striving hard already for customer

, CP , ACS Com.Manoj Viswanath , DS TVM and Com.Subramanyam CEC Member from
EKM BA Met CGMT and discussed pending HR/Service matters . GM(A/HR) was also
present the meeting . Meeting was very cordial and fruitful. CGMT remarked
about the alarming fall of BSNL revenue and suggested to brainstorm for ideas
to bring more revenue for a safe survival.
Some of the issues discussed are … Imperfections
in the Corporate office Letter No. 3-8/200-Esst-IV(pt.) dated 18/9/2018 for Fixation
of Pay under FR- 22(1)(a) (i) : We
submitted the mistakes and deficiencies associated with the corporate office
letter. The letter is neither in line with Supreme Court direction nor
favorable to the erstwhile O-JTOs. We informed that our association has
written to Smt. Suiata
Ray, Director (HR), BSNL Board pointing out the flaws in the letter
for Fixation of Pay under FR- 22(1)(a)
(i) to the officials and we expect release of final corrected letter . CGMT directed GM
(A/HR) to take care of the matter. Omission of JTOs (RY 2012) from JTO (T) to SDE (T)
promotion under 67% SFC Quota due
to Discrepancy in
Recruitment Year Allotment .( This association Letter to CGMT No.
AIBSNLEA/Kerala /2017-20/CHQ/130 dated 05-08-2018 and Letter No. AIBSNLEA/Kerala /2017-20/CHQ/136
dated 03-10-2018): The
matter is submitted to CGMT in detail with all letters in reference. We
requested to look into the anomalies regarding the allotment of RY as RY 2012
even for candidates belongs to VY 2003 . CGMT assured to look into the
details. The matter was also discussed
with GM(A/HR) before CGMT Meeting . Later we met DGM(HR) and submitted the
grievance . DGM assured to extend all possible helps . He agreed for a

Promotion against available 5 vacancies : We requested to
fill up the vacancies as only the DPC pending. CGMT mentioned that some
clarification expected from corporate office
regarding the number of vacancies . CGMT directed GM(A/HR) to speed up
the matter . GM assured to do the same. We further submitted that after March
2016 , no DPC was conducted and eligible officers are retiring hurt . Request
to cancel the request transfer of DS Alappuzha . ( This association Letter to GM A&HR No:
AIBSNLEA/Kerala /2017-20/CHQ/143 dated 05-09-2018): We
requested CGMT to consider the request to cancel the request transfer of DS
Alappy . After discussing the case in detail , CGMT was kind enough to
consider our request and directed GM(A/HR) to reconsider the case favorably. Non consideration of 34 JAOs posted against the notified vacancy
of 2012 internal competitive exam (40%
category) to the recent AO promotions while all their fellow 2012-VY JAOs

10-09-2018) : CGMT listened the matter in detail and assured to look into

Meeting with Shri Manoj Sinha Ji, Hon'ble Minister of State for
Communications (I/C), Govt. Of India: GS,
President, AGS (Fin) and AGS(DR) met with Hon'ble MOSC (IC) Shri Manoj
Sinha Ji for early settlement of various issues viz. (i)
Implementation of 3rd PRC with 15% fitment benefit in BSNL(ii) Revision
of pension of BSNL Pensioners (iii) Payment of pension contribution on actual
basic Pay (iv) Allocation of 4G spectrum to BSNL (v) Payment of pension
through existing Banking CPCs instead of CCA Hon'ble
Minister mentioned that BSNL should have serious approach towards Its
Revival. BSNL has to grab the opportunity through "BSNL Wings" and FTTH
connections and increase its revenue as finally burden will come only on
BSNL. BSNL should increase its CFA customer base from 1 crore to 1.5 crore
during next 8 months to increase its revenue. In mobile segment there is
stiff competition. We insisted that about 20 lakhs people
dependent on BSNL and are watching with hope towards Hon'ble Minister. We
requested that Hon'ble Minister can only decide the fate of these 20 lakh
people as approach of Bureaucracy is always as per line of rule book. After
detailed discussions, Hon'ble Minister assured that after arrival of
Secretary (T) from US tour on 14.10.2018, he will hold a meeting with
Secretary (T) and CMD, BSNL. Unions and Associations may
also be invited for aforesaid meeting and try to resolve issues at earliest.
On our pleading Hon'ble Minister assured to give good news within this month
itself. We
provided all the letters addressed to Hon'ble MOSC (IC) on above issues
which he marked to Shri Saket Kumar , PS, (IAS) to conduct above meeting . |

08-10-2018 : CHQ News Meeting
of AUAB : Today All Unions and Associations of BSNL hold its
meeting at NFTE CHQ Office at New Delhi. On behalf of AIBSNLEA GS &
President attended the meeting. Com. C.Singh, GS, NFTE presided the meeting.
AUAB expressed its serious concern against the non-implementation of the
assurances/directions given by the Hon'ble MOSC (I/C) in the meeting with
AUAB held on 24.2.2018. Also expressed dissatisfaction against the poor
response of the BSNL Management in this regard. After detail discussions AUAB
unanimously decided to serve the Notice of Trade Union Action Programmes as
under: i)
Press release/Press Conference at CHQ/Circle/SSA levels on 29.10.2018 high
lighting the demands. ii)
One full day Dharna at BSNL CO/Circle/SSA levels on 30.10.2018. iii)
Rallies at Circle and SSA levels and submission of Memorandum to the
respective CGMs/GMs on 14.11.2018. iv)
To intensify the Agitational Programme in terms of Indefinite Strike will be
decided after 30.11.2018 in case the AUAB demands are not settled. v)
AUAB decided to issue protest letters to CMD regarding a)
Outsourcing of Passive Infra Maintenance of Non BSNL Sites amounting Rs.1800
Crores per Annum and b)
Repatriation of excess ITS Officers against the Sanctioned Strength to DOT as
per the Hon'ble High Court Delhi Judgement of in diminishing order. All
the Unions and Associations of BSNL will be requested by AUAB Leaders to come
together and fight collectively on the common demands. The demands are as
under 1)
3rd PRC implementation with 15% fitment 2)
Pension Revision 3)
Pension Contribution on Actual Basic Pay instead of Maximum Pay. 4)
Immediate Allocation of 4G Spectrum to BSNL. All
the Circle Secretaries/District Secretaries are requested to implement make
the Agitational Programme successfully. |
