The issues related to the Revival of BSNL i.e. Allotment of 4G spectrum to BSNL, Monetization of BSNL non-core Land,  VRS and roll out of the age from 60 years to 58 years, implementation of the recommendations of 3rd PRC, Pension Revision, Financial Viability of BSNL as per the decision taken by the Group of Ministers, at the time of formation of BSNL, Letter of comfort for BSNL's proposals for taking Bank loans, Sovereign Guarantee, immediate Financial support to BSNL, Expeditiously fill up all vacant posts of BSNL Board of Directors and Repatriation of excess ITS officers to DOT have been discussed in the informal meetings with, Secretary (T), Member (Finance),CMD BSNL and other Sr. Officers of DoT as well as of BSNL.

AIBSNLEA is deeply committed and has the clear Vision to achieve the Dreams and Aspirations of young BSNL Recruits i.e., PAY, PENSION & PROMOTIONS, Due to continuous efforts of AIBSNLEA for so many years 25% SAB, Rs.22820, E1+5 Increments, GTI with lowest premium and Mega Promotions for 14000 Executives were achieved.

GS writes to the Director (HR) regarding grant of relaxation in marks to the candidates appeared in the JTO LICE held on 26.05.2019 as well as review of results of SC & ST candidates and Awarding of Grace Marks for the Vacancy Year 2017-18 due to very poor results...               <<<Click here for GS Letter to Dir (HR)>>>

GS brought to the notice of Director (HR) in several Agenda Meetings held from Jan., 2020 to May., 2020 that due to very high standard of questions, combined with a large number of out of Syllabus/ambiguous/wrong questions, only 154 candidates have got passed, out of the total 741 candidates appeared in the LICE i.e., 21% only.

It is also a matter of serious concern that not even a single candidate was passed in as many as 5 circles and the result is also very poor in respect of SC/ST candidates. Only 26 SC Candidates and 18 ST candidates have passed from 8 Circles out of 28 Circles. It is pertinent to mention that not even a single SC or ST candidate was passed in other 20 Circles.

It is also worth to mention that all the candidates have entered through highly

Competitive Exam for the Direct Recruitment to the Cadre of JE in BSNL.

In Post-VRS Scenario as on 01.02.2020, the posts of JTOs are vacant to the tune

of 14828. Out of that the 50% vacancies available for LICE quota are 7414.

However, through the above said LIC Exam, only 154 candidates have passed i.e.,

only 2.08% vacancies can be filled up. 

Like that 1684 SC Vacancies and 1065 ST Vacancies are available for the LICE  quota but through the above said LICE , only 26 SC & 18 ST candidates only have passed Exam i.e., only 1.6% vacancies can be filled up.

GS AIBSNLEA requested-

 

1. 1. To provide relaxation of 10% marks in Group-A, 15% marks in Group-B and 15% marks in aggregate and

 

2. 2. To review the results of SC & ST candidates and award Grace marks

 

So as to render Natural justice to the affected candidates and to boost their morale in the current situation of BSNL, where these young energies will make the difference.

Due to the consistent efforts of AIBSNLEA, a New Committee has been formed during the first week of June, 2020 under the chairmanship of GM (Rectt.) BSNL CO to review the results and award the grace marks. GS further requested the Director (HR) to speed up the submission of the Committee Report and declaration of review results.

Grant of 5 (five) Advance Increments on the minimum revised E1 IDA Pay Scale of Rs.16400-40500 to the SRD JTOs  & DRs Specially abled  2010 batch, LDCE JAO 2013 batch  DR JAOs of 2015, 2018 batch, DR JTO of 2017 batch  LDCE JAO 2016 batch and LDCE JTOs  of 2016 & 2017 batches.

To the Kind attention of all Post 2010 Batch DR/LDCE JTOs & JAOs Batches:

Dear Friends! AIBSNLEA is the only Association continuously taking up the issue of E1+ 5 increments to the post 2010 JTO/JAO DR & LDCE  at different level for quite long time due to non approval  of E2 Scale by the DoT. GS, AIBSNLEA has written to the BSNL Management about this anomaly and explained about huge difference in Pay to the tune of Rs 10000/- between the two sets of Executives recruited after 01.01.2007 onwards which created widespread resentment among the young Executives. The young DR and LDCE JTOs/JAOs  were demoted to a lower Pay scale and placed in E1 scale provisionally.

Due consist and continuous  efforts of AIBSNLEA , BSNL Board approved the grant of 5(five) advance increments on the minimum of the revised E1 pay scale of Rs. 16400-40500 to the directly recruited JTOs of 2007 and 2008 batch and directly recruited JAOs in respect of whom result declared in 2010 have been ordered to be fixed at Rs.19020/- and subsequently  BSNL Board approved the same for JAO 2010 LICE batch (both 10% Quota & 40% Quota) i.e., the pay of such JAOS has been fixed in the revised E1 pay scale of Rs. 16400-40500/- by granting one notional increment @ 3% of their existing pay in the feeder grade or at Rs. 19020/- by way of granting five advance increments on the minimum of the revised E1 scale, whichever is higher.

Like that due to continuous persuasion of AIBSNLEA with the BSNL Management, the grant of 5(five) advance increments on the minimum of the revised E1 pay scale of Rs. 16400-40500 to SRD JTOs 2010 batch and LDCE JAOs 2013 batch has been considered and approved by the MC of the BSNL Board. But the approval of BSNL Board is kept pending for the past so many years due to BSNL Restructuring Plan.

AIBSNLEA brought to the notice of the CMD, BSNL that the initial Pay of DR JTO Specially abled 2010 Batch, DR JAOs of 2015, 2018 Batch, DR JTOs of 2017 Batch, LDCE JAOs of 2016 batch and LDCE JTOs of 2016 & 2017 batch recruited/appointed as per the same Recruitment Rules as of DR JAO 2010 Batch was fixed at Rs.16400/- only and they are deprived from getting of 5 Advance increments; which is clear disparity and serious anomaly among the similarly placed JTOs/JAOs. The difference in basic pay of DR JTO Specially abled 2010 Batch, DR JAOs of 2015, 2018, DR JTOs of 2017, LDCE JAOs 2016 and LDCE JTOs 2016 & 2017 batches become Rs 2620/- (Rs,19020– Rs.16400) comparing to the DR JTOs of 2007 batch, 2008 batch and JAOs of 2010 LDCE batch. If other allowances are added, the real difference in salary today will be around Rs 10,000/-. On implementation of 3rd PRC, the difference will further increase and continue with time due to increase in IDA and annual increment. Further all are facing major losses in the form of career progression (time bound promotion), retirement benefits like E.P.F., Gratuity etc., due to discrimination of the initial basic pay compared to other similarly placed JTO/JAOs. 

AIBSNLEA in it’s letter also mentioned that they will get E-2 Scale as per the time bound EPP after 6 years only since they are placed in Rs.16400- 40500 Scale and they have not touched the next Scale within 4 years (as per the BSNL EPP) due to non grant 5(five) Advance increments. Whereas the earlier 2007&2008 DR JTO batch, 2010 DR JAO and 2010 LDCE batches  have got E2 Scale in 4 years which is the great injustice  and discrimination.

Due to implementation of VRS-2019 in BSNL and sudden outbreak of the present pandemic situation, the immediate propulsion faced by the Executives, especially the younger ones are hard to believe. They have already labeled themselves as silent fighters, who fought not only for their livelihood but also to run the Dreams of Indian Telecommunication amidst the most turbulent condition. Surprisingly, these energetic, educated and committed brigades have continuously been deprived in many spheres relating to their career in BSNL service. The financial difference between their of their senior counterparts due to Pay loss of Rs 10,000/- per month is unimaginable and unfair too.

In view of the foregoing,  AIBSNLEA fervently appeal to the CMD BSNL to kindly intervene in the matter and cause to issue necessary instructions to the Officers concerned to extend E1+5 increments to SRD JTOs 2010 batch, DR JTO Specially abled 2010 Batch, LDCE JAOs 2013 batch, DR JAOs of 2015, 2018 batch, DR JTOs of 2017 Batch, LDCE JAOs 2016 and LDCE JTOs 2016 & 2017 batches so as to increase the morale of the Young Executives.....<<<Click here for letter>>>

What are the reasons for delay in JTO to SDE (T) Promotion?

Those who are singing the tunes of themselves being the saviors of Youngsters have gone to the Court and stalled the Promotions from JTO(T) to SDE(T) under  Seniority Cum Fitness 67% Quota. Due to this Court Case, thousands of BSNL recruited JTOs including 2001 Batch onwards are still waiting for their first promotion for the last 6 to 20 years

Friends, all are aware that due to consistent efforts of AIBSNLEA, 2090 JTO (T) s were promoted as SDE (T) through 2015 LDCE for the vacancy year 2010-11 on 25.06.2018.

All India Eligibility List published by BSNL CO during Feb’ 2015 to grant promotions to the cadre of SDE (T) under 67% seniority cum fitness quota was challenged by some of the Office bearers  of so called Saviors  Association in the Hon’ble High Court of Kerala. The Hon’ble High Court of Kerala vide their judgment dated 05.06.2018  set aside the above said AIEL and directed to redraw an integrated AIEL on the basis of date of joining without considering training centre marks. BSNL published an AIEL on 14.06.2018 by bifurcating the earlier AIEL which only consists of JTOs recruited up to the year 1999 and accordingly, granted promotion to the cadre of SDE (Telecom) for 67% Seniority cum Fitness quota on 15.06.2018. Due to the Court directions, BSNL issued promotion orders only for 3147 JTOs even though another 4500 vacancies were available for the vacancy year 2009-10 and 2010-11. In this DPC, BSNL has promoted JTOs recruited for 1995 (partial), 1996, 1997, 1998 and 1999 (partial) recruitment years for the vacancy years 2009-10 and 2010-11. Though more than 4500  of SDE vacancies were available during June- 2018, but could not be filled up as the Eligibility list of JTOs recruited from 2001 onwards  have to be re-casted as per the directions of Hon’ble  High Court of Kerala w.r.t. Date of Joining, in view of the case filed by the activists of so called Saviour Association.

A contempt petition was then filed against the promotion orders dated 15.06.2018, by some of the Office bearers of the so called Saviors Association which is still pending for disposalDue to the Contempt petition   filed by the activists of the so called Saviour Association against CMD BSNL, another 4500 vacancies could not be filled after June, 2018.   

Hence the JTO (T) to SDE (T) Promotions were badly delayed for more than two years due to Court cases filed by the so called Saviors of Youngsters which created serious resentment, de-motivation and demoralization among the Young JTOs of 2001 to 2008 batch.

BSNL filed a Review Petition against the judgment dated 05.06.2018  since  the Hon’ble High Court of Kerala in its judgment had made the training centre marks irrelevant, which is not in consonance with the DoP&T guidelines. The above said review petition is still pending for disposal.

So Comrades! Please understand who is behind the stalling of due Promotions.   Those who were gone to the Court and stalled the Promotion in the name of Contempt Petition are not come forward to withdraw the same in the interest of thousands of BSNL Recruits but they are now shedding the Crocodile Tears that JTO(T) to SDE(T) Promotions are delayed. 

Friends! Please identify the true colours of so called Saviors Association who have killed the Carrier Prospective of BSNL Recruits.

We request the whole BSNL Recruits to think, introspect and decide!

GS writes to Shri P. K. Purwar, CMD BSNL regarding Conduct of 2nd MVP for Executives in the midst of Covid19......

AIBSNLEA is very confident to get more than 10,000 Votes and become a No.1 Association with a great show in the event of an 2nd MVP conducted at any time, at the same time AIBSNLEA is the only Association worried and more concerned about the personal safety of all the BSNL Executives and their families , than winning any Election (2nd MVP).

AIBSNLEA intimated the CMD through this letter that as per the reports obtained from the Circle Secretaries of various Circles throughout  India, that the Pandemic is growing exponentially and the State and Central Governments are struggling hard to control its spread by introducing all types of restrictions to save valuable human lives. Now, it is declared by the State Govts., including Kerala that Covid-19 is peak through Communal Spreading..  Hence,  we cautioned that

 The BSNL Management will be squarely held responsible for spread of COVID-19 pandemic and it’s after effect on the lives of our BSNL Executives if it continued with its plan to go ahead with the proposed 2nd  MVP on 18th August 2020.     

If conduct of 2nd MVP leads to any mis-happenings or untoward incidents, it will be the Sole responsibility of the BSNL Management.

And AIBSNLEA is  doubting  that whether the 2nd  MVP will be conducted by the BSNL Management in a free and fair manner.

General Secretary, SEWA BSNL, Shri. N.D. Ram ji raised various points vide SEWA BSNL Lr. dated 06.7.2020 for the commitment of AIBSNLEA for safe guard the interest and welfare of SC/ST employees as per the Constitutional Provisions. AIBSNLEA positively responded vide our Lr. dated 6.7.2020 as detailed below… and fervently appeal the GS, SEWA, Chief Patron, President and all the front line Leaders and Office bearers of SEWA BSNL to kindly Support AIBSNLEA in the ensuing 2nd MVP so as to become a Majority No.1 Association in BSNL and assure that AIBSNLEA will raise the voice on the issues of SC/ST employees in BSNL with the Management in the days to come like earlier.

1.  AIBSNLEA will always support Reservation Roster for SC/ST employees in BSNL as per the Constitutional Provisions.

2.  AIBSNLEA will support the Own Merit Concept for SC/ST in BSNL as per the DOP&T guidelines.

3.  AIBSNLEA also support, if any Relaxed Standard Proposal comes in BSNL and Lesser Evaluation for SC/ST employees in BSNL.

4.  AIBSNLEA is the only Executive Association in BSNL given the views to the BSNL Management on 03.11.2017 & 15.11.2017 against Para 7.2 of CPSU CH draft proposal regarding SC/ST Roster vide our letter No. AIBSNLEA/CHQ/CPSU/2017 dated 15.11.2017 and in this letter it was categorically suggested by the AIBSNLEA that Roster for SC & ST employees should be implemented as per the existing DOP&T guidelines in all the promotions under CPSU CH. The copy of the letter has also forwarded to the GS/SEWA as well as the President/SEWA (Now Chief Advisor SEWA) through email on 16.11.2017 itself.

The same was appreciated by all the Leaders in the CWC meeting of SEWA BSNL held at Chennai during Dec’ 2018, wherein GS, AIBSNLEA Com. S.Sivakumar participated (in the capacity of the then CHQ President, AIBSNLEA)

The above said AIBSNLEA (views on CPSU CH proposal) Lr. dated 15.11.2017 is a documentary proof that AIBSNLEA is always safe guarding  the interest of all the SC & ST brothers working in BSNL and we, the AIBSNLEA Leaders always maintained good relation with SEWA Leaders with respect and affection.

Comrade GS, AIBSNLEA had a detailed discussion with GS, SEWA BSNL Respected Shri N.D. Ram ji and Chief Patron of SEWA BSNL Respected Shri P.N. Perumal ji explaining the unconditional support of AIBSNLEA extended to SEWA BSNL for  the past 4 years and GS AIBSNLEA categorically mentioned that AIBSNLEA is only Executive Association supported the views of SEWA BSNL vide Para 7.2 of CPSU CH draft proposal during Nov’ 2017 and subsequently AIBSNEA reiterated its stand before the  Committee on CPSU CH on 27.9.2018:

AIBSNLEA reiterated its stand which was communicated vide Letter dated 15.11.2017 in Para 7.2: “ AIBSNLEA is of the opinion for implementation of roster on Promotion as per the existing DOP&T directions and  as per the  Judgment of the Hon'ble Supreme Court of India delivered on 26.9.2018. It should be mentioned in the CPSU Cadre Hierarchy”

Again AIBSNLEA insisted the Dir HR and PGM (F) to consider the views of AIBSNLEA regarding CPSU CH through various meetings held on 08.11.2019 & 31.10.2019. GS further informed the SEWA BSNL Leaders that AIBSNLEA is the only Association never gone to the Court against any Promotions of any Executives and against the SC/ST Executives Welfare and sought the esteemed support of SEWA BSNL to AIBSNLEA in the ensuing 2nd MVP.

GS SEWA BSNL & Chief Patron SEWA BSNL assured that the views and response will be placed in the Governing Body meeting scheduled to be held during the last week of July’2020.

A) DE to DGM (T) Promotion: We requested to expedite the issuance of DE to DGM (T) promotion orders. Director (HR) mentioned that the queries raised by the CMD BSNL has been replied and discussed with the CMD BSNL yesterday (07.11.2019). Director (HR) assured that as and when the receipt of the approval from the Competent Authority, the DE to DGM (T) Promotion Orders will be issued.

We further requested Director (HR) to post all the promoted DGMs on “As is where is” basis as assured by BSNL Management to the AIBSNLEA and SNEA representatives during the discussions held on 25.10.2019. Director (HR) assured to post the promoted DGMs   on “As is where is basis”.

B) Filling up of all vacant posts of Group ‘B’ and Group ‘A’ in various disciplines & implementation of Khan Committee report in True Spirit:- We requested-

i) To fill up all vacant Gr.A and Gr.B Posts in all disciplines and up gradation of the posts where eligible officers are more than the vacant posts and issue promotion orders before the implementation of VRS, the CPSU Cadre Hierarchy and abolition of Sanctioned Posts and the RRs.

ii) SC& ST roster to be followed in the Non post based Functional  Promotion as per the existing DOP& T guidelines and subject to pending verdict in the Hon’ble Apex Court as per the suggestions under Para 7 of proposed CPSU Cadre Hierarchy

iii) Restoration of Eligibility criterion for STS promotion as 5/7 years instead of the proposed 12 years in the CPSU CH.

iv) Implementation of Hon’ble Supreme Court Judgement on Seniority in respect of TES Gr. B seniority before implementation of VRS and CPSU Cadre Hierarchy

v) Reduction of Stringent Bench marks to avoid huge droppings

vi) Stopping of non post based functional promotion in the name of non Substantive cadre post of Sr.SDE/Sr.AO which increases the stagnation period of SDE/AO and equivalent cadres etc.,

We have already submitted the views/ suggestions/concerns of AIBSNLEA in this regard. Director (HR) after patient hearing assured to look in to our suggestions before taking final view in this regard.

a) DE to DGM (T) Promotion: GS requested for the early issuance of the DE to DGM (T) promotion orders. PGM (Pers) mentioned that all the VCRs have been received and work is in final stage.  He assured that after the receipt of signed copy of the Hon'ble Chandigarh CAT Order and approval of the Competent Authority, the Promotion orders will be issued.                                               

b) Filling up of all vacant Gr. A and Gr. B Vacant posts & implementation of Khan Committee report in true Spirit. We requested:

i) To fill up all vacant Gr.A and Gr.B Posts and up gradation of the posts where eligible officers are more than the vacant posts and issue promotion orders before the implementation of VRS, the CPSU Cadre Hierarchy and abolition of Sanctioned Posts and the RRs.

15.11.2017http://www.aibsnleachq.in/IMAGES/new.gif Meeting with PGM (Pers.) to discuss the CPSU Cadre Hierarchy proposal: GS, President, AGS (HQ), AGS (Fin), and AGS (DR) had meeting with PGM (Pers.) on CPSU cadre hierarchy. The meeting was scheduled as per direction of the Management Committee of BSNL Board. GM (SR), Jt. GM (Pers) and DGM (Pers-II) were also present in the meeting.  AIBSNLEA submitted its detailed Para wise response to the draft policy approved by BSNL Management committee.

PGM (Pers) had apprised that purpose of the MC‘s direction to discuss with associations to make policy more employee and organization centric. He requested that AIBSNLEA should support the policy to break the stalemate in the promotions of executives in BSNL.

AIBSNLEA made it clear that we are never against the CPSU hierarchy rather we have been demanding it to implement in the true sense and as per Khan Committee recommendations.  We further clarified that our suggestions are to safe guard the interest of the entire executives and it will give value additions to it. In view of this Pers. Cell should carefully go through our views / suggestions with open mind without any prejudice. Then point by point discussion was held. 

While discussion, We emphasized that AIBSNLEA is of the opinion for implementation of roster on Promotion as per the existing DOP&T directions and  as per the  Judgment of the Hon'ble Supreme Court of India delivered on 26.9.2018. It should be mentioned in the CPSU Cadre Hierarchy” we strongly  opposed the MT recruitment, ignorance of  the weightage to seniority, reduction of sanctioned strength, increase in eligibility condition from of 7 to 12 years for the promotion of SDE/AO to DE /AGM/CAO, Time bound promotion in SG-JAG grade should be in E7 instead of E6 etc.

PGM (Pers) appreciated our concern in this regard and impress upon to consider MT Recruitment to full-fill the management requirement immediately but we categorically told that AIBSNLEA is firm on its stand and will not accept MT Recruitment at STS level which will block the career progression of executives. Today the meeting started at 15.00 hrs as per the schedule and continued till 18.00 hrs thereafter, PGM (Pers.) mentioned that he will study the submissions made by AIBSNLEA point by point and thereafter he will discuss the matter with AIBSNLEA again on 22nd and 23rd Nov, 2017.

Comrades! Please Think-over!

What are the reasons for delay in JTO to SDE (T) Promotion? Those who are singing the tunes of themselves being the saviors of Youngsters have gone to the Court and stalled the Promotions from JTO(T) to SDE(T) under  Seniority Cum Fitness 67% Quota. Due to this Court Case, thousands of BSNL recruited JTOs including 2001 Batch onwards are still waiting for their first promotion for the last 6 to 20 years

Friends, all are aware that due to consistent efforts of AIBSNLEA, 2090 JTO (T) s were promoted as SDE (T) through 2015 LDCE for the vacancy year 2010-11 on 25.06.2018.

All India Eligibility List published by BSNL CO during Feb’ 2015 to grant promotions to the cadre of SDE (T) under 67% seniority cum fitness quota was challenged by some of the Office bearers  of so called Saviors  Association in the Hon’ble High Court of Kerala. The Hon’ble High Court of Kerala vide their judgment dated 05.06.2018  set aside the above said AIEL and directed to redraw an integrated AIEL on the basis of date of joining without considering training centre marks. BSNL published an AIEL on 14.06.2018 by bifurcating the earlier AIEL which only consists of JTOs recruited up to the year 1999 and accordingly, granted promotion to the cadre of SDE (Telecom) for 67% Seniority cum Fitness quota on 15.06.2018. Due to the Court directions, BSNL issued promotion orders only for 3147 JTOs even though another 4500 vacancies were available for the vacancy year 2009-10 and 2010-11. In this DPC, BSNL has promoted JTOs recruited for 1995 (partial), 1996, 1997, 1998 and 1999 (partial) recruitment years for the vacancy years 2009-10 and 2010-11. Though more than 4500 thousands of SDE vacancies were available during June- 2018, but could not be filled up as the Eligibility list of JTOs recruited from 2001 onwards  have to be re-casted as per the directions of Hon’ble  High Court of Kerala w.r.t. Date of Joining, in view of the case filed by the activists of so called Saviour Association.

A contempt petition was then filed against the promotion orders dated 15.06.2018, by some of the Office bearers of the so called Saviors Association which is still pending for disposalDue to the Contempt petition   filed by the activists of the so called Saviour Association against CMD BSNL, another 4500 vacancies could not be filled after June, 2018.   

Hence the JTO (T) to SDE (T) Promotions were badly delayed for more than two years due to Court cases filed by the so called Saviors of Youngsters which created serious resentment, de-motivation and demoralization among the Young JTOs of 2001 to 2008 batch.

BSNL filed a Review Petition against the judgment dated 05.06.2018  since  the Hon’ble High Court of Kerala in its judgment had made the training centre marks irrelevant, which is not in consonance with the DoP&T guidelines. The above said review petition is still pending for disposal.

So Comrades! Please understand who is behind the stalling of due Promotions.   Those who were gone to the Court and stalled the Promotion in the name of Contempt Petition are not come forward to withdraw the same in the interest of thousands of BSNL Recruits but they are now shedding the Crocodile Tears that JTO(T) to SDE(T) Promotions are delayed. 

Friends! Please identify the true colours of so called Saviors Association who have killed the Carrier Prospective of BSNL Recruits.

We request the whole BSNL Recruits to think, introspect and decide!

AIBSNLEA was formally launched on 1st May’ 2004 by merging 10 separate Associations representing different disciplines of Group ‘B’ and Group ‘A’ promoted officers.

AIBSNLEA is the only Association actually represents all the Streams/ Cadres (Telecom/Finance/Civil/Electrical/Arch/TF/PA/PS/OL/CSS etc.) in BSNL and taken up the issues pertaining to the Executives of all the Streams since last 16 years without any biased manner.

AIBSNLEA is committed with its core strength for the development of the BSNL as well as to protect the Service Benefits and Legitimate Rights of their Members.

Don’t be confuse by misleading messages and propaganda in Social Media by the vested interest groups.

AIBSNLEA is always working for safe guarding the interest of its Members/Executives.

AIBSNLEA very strongly and very quickly taken up the burning issues relating to the Executives including our Young BR/DR Comrades for early settlement through letters and continuous dialogue with the Management.

All the Circle Secretaries/ District Secretaries are advised to conduct meetings through Video Conferences, wherever necessary, and motivate the Activists to collect and submit the membership forms to the concerned DDO before 15th July’ 2020 duly filled in by the new members in each Circle/SSA/Branch etc.,

All the CHQ/CWC Members/Circle/SSA/Branch Office bearers, activists and members are requested to interact with each and every Executive, explaining the Achievements, Progress and Status of the issues taken up by AIBSNLEA CHQ/Circle as listed below:

Achievements of AIBSNLEA

1. Mega Promotions
- Mile Stone created in the History of DoT & BSNL- AIBSNLEA Vision and Positive approach benefited thousands of Executives by Promotion through CPCs, which is a Major breakthrough and Achievement of AIBSNLEA: Due to consistent untiring and dedicated efforts of AIBSNLEA, CPCs were conducted in all disciplines to fill up all the vacancies in almost all Cadres resulting about 14,000 Executives have been promoted in June-July, 2018 and Nov,2018 which has given a great relief and Morale booster to the Executives who were waiting for their promotions years together. It is a mile stone in the History of DOT and BSNL.

On the pretext of various pending Court cases, BSNL Management is not conducting CPCs. AIBSNLEA has written to the Management for the immediate filling up all the vacant JAG, STS Group ‘A’ & Group ‘B’ Grade posts in all disciplines in BSNL on Regular basis through CPCs before the implementation of the proposed VR Scheme and before any Notification of CPSU Cadre Hierarchy on the prospective date to avoid humiliation among the Sr. Executives.

AIBSNLEA is only Association persuaded and convinced the Management that CPCs in BSNL can also be conducted on the similar lines on which the other Departments are conducting the CPCs on the basis of Hon’ble Supreme Court’s Judgment in the case of Nagaraj on SC/ST roster implementation: BSNL Management considered our request and decided in the BSNL MC to initiate CPCs in all disciplines on the same line of other Departments. Mean-while Hon’ble Supreme Court also delivered the Judgment allowing SC/ST roster implementation in promotions which was also endorsed by DoPT. This further smoothens the way for conducting CPCs in BSNL. In the SDE(T) Promotions all the vacancies could not filled up due to the Court cases at Ernakulum and Chennai. Only 5237 JTOs were promoted as SDE in 2018.

2. 30% Superannuation benefits to directly recruited employees as per DPE guidelines:
 AIBSNLEA requested CMD BSNL, Director (HR/EB) and ED (Finance) to resolve superannuation benefits to directly recruited employees as per DPE guidelines and BSNL should contribute 12% as Superannuation Benefits in respect of Direct Recruits to fulfill the limit of 30% contribution. The remuneration committee of BSNL Board recommended to start a Superannuation benefit Trust to directly recruited BSNL employees with a contribution of 3% initially and further it can be reviewed on the basis of financial health of the Company. DoT issued the Presidential Directives in this regard and BSNL Management created a Trust and other formalities in this regard. On our persuasion BSNL Board has increased the contribution from 3% to 5% but we are continuously demanding 12% contribution. CMD BSNL assured to increase further 2% in the contributions to the Superannuation benefits by March, 2019 but remain pending due to Financial Crunch in BSNL. AIBSNLEA will continue its efforts in this regard.

3. JAO 2010 Batch option case: Due to hard and continuous persuasion with deep commitment and understanding of the issue results in getting released the order allowing JAO 2010 Batch (Departmental 40% Quota) to exercise their option for fixation of pay in the revised pay from the date of promotion in the grade of JAO, as one time dispensation.

4. Group Term Insurance for the BSNL Executives:
 It is our major achievement and relief for all the Young Comrades AIBSNLEA attended all the meetings with the Committee members constituted to discuss the methodology for induction of Group Term Insurance (GTI) for its executives. Implementation of GTI Scheme for BSNL Executives has been finalized & MoU between LIC & BSNL is finalized & signed between LIC & BSNL on 27.12.2019. The Scheme has already been implemented w.e.f. 01.03.2019 with annual Premium of Rs.9440/- for a coverage of Rs.50 lakh for all the Executives up to 50 years of age.

5. Reversion of 2001 Recruited JTOs Passed LDCE 2007: Due to AIBSNLEA continuous persuasion with the Management a Committee has been formed and Committee Report is likely to be placed before the Management. We will continue our efforts in this regard.

6. Rs. 22820/- Pay Fixation case of JTOs/JAOs post recruited 2007:
 AIBSNLEA along with AITEEA requested CMD BSNL for the removal of pay anomaly in this regard. Accepting our request CMD, BSNL constituted a Committee headed by PGM (PF) Smt. A. Panda to examine the issue and submit the report. We also gave presentation to the Committee and the Committee has submitted its report to the competent authority for consideration. We are pursuing with Director (HR) and CMD BSNL for the resolution of the issue. We have explained that already some Pay Anomaly Cases of JTOs 2005 batch, JAO 2010 batch and Asstt. of CSS cadre have been settled by BSNL Management. In the same line this issue also needs settlement but case remains pending.

7. Management Trainees Recruitment Rule-2009: AIBSNLEA consistent efforts yielded results in getting deferred MT Exam – 2015 but some Executives Associations and Non-Executives Unions are continuously making efforts for MT recruitment. Our considered opinion is that since young and talented executives having B Tech/M Tech, CA/ICWA, MBA qualifications at the level of JTO / SDE are available in BSNL, hence there should not be any lateral induction above JTO cadre. The lateral induction above the JTO cadre will block the career progression of these young talented executives available in BSNL. But the BSNL Management has further notified MT Recruitment from Internal Quota by conducted the exams on 17th March, 2019. Against this AIBSNELA has protested. Management has to scrap the MTRRs to provide smooth career progression to the existing executives of BSNL.

8. E1+ 5 increments benefit to JTOs/JAOs: Management Committee of the BSNL Board approved E1+5 increments benefits to the SRD JTOs 2010 batch and JAOs 2013 batch but it is pending for BSNL Board Approval, our efforts are continue. Like that AIBSNLEA continuously pursuing with the Management for grant of E1+5 increments to the DR JAOs 2015 & 2018 batch LDCE JAOs 2016 batch and LDCE JTOs  of 2016 & 2017 batches...

9. Due to consistent efforts of AIBSNLEA, the FR22(1)(a)(i) benefits extended to the Ex. Officiating JTOs w.e.f. 1.1..2007.

10. Withdrawal of Additional Increment in the same scale on functional promotion under EPP: DoT vide its letter dated 05.07.2017 withdraw additional Increment in the same scale on functional promotion under EPP.
 Against this, AIBSNLEA immediately filed an OA in the Hon’ble PB CAT New Delhi for quashing the order. Even after that, DoT continued to reduce the Pension of the BSNL retiree Executives, against this AIBSNLEA filed a Contempt Petition in the Hon’ble PB CAT New Delhi. Thereafter DoT stopped reducing the pension/ revising the Pay fixation by obtaining an under taking from the retiring executives, DoT has filed Writ Petition in the Hon’ble High Court of Delhi wherein AIBSNLEA has filed a caveat. The case was heard and Posted for next hearing in April 2020. Due to COVID-19 Lock down it is not yet heard.

11. AIBSNLEA is actively Participated in all the Agitation calls given by AUAB and regularly attending the meetings to discuss the issues related to the Revival Plan, Financial viability of BSNL, allocation of 4G spectrum to BSNL, Monetization of non-core Land, the issues of revision of Pay, Pension and Payment of pension contribution on actual basis instead of maximum of the pay scale, BSNL MRS etc. To get settled the demands, AUAB launched series of agitation calls including 3 days strike and March to Sanchar Bhawan etc., in all the Agitational Calls AIBSNLEA was in fore front and actively participated and succeeded by getting Revival Plan Approved by the Union Cabinet on 23.10.2019 with a) 4G spectrum and 18% GST free of cost, b) No financial implication for BSNL on VRS, c) Land monetization for loan repayment and development, d) Rs 8,500 Crore Bond for Restructuring of loan. Contentious issues like E2 & E3 Pay Scale will be settled before BSNL & MTNL Merger.

12. Tower Subsidiary formation:
 Govt. of India with the Union Cabinet approval dated 12.09.2017 has created a Subsidiary Tower Company fully owned BSNL. The company has been registered in the name BSNL Tower Corporation Ltd. on 04.01.2018. But, DoT arbitrarily appointed Shri Amit Yadav, JS (Admn), an IAS officer, as the CMD of the Subsidiary Company which created apprehension that Govt. may any time sell out the Subsidiary Company through strategic business partner. Against this, AUAB protested organizationally and decided to protest legally also. Accordingly, AIBSNLEA filed a case in the Hon’ble High Court of Delhi resulting BTCL still not in operation.

13. Pension Contribution on Acutal basic Pay instead of Maximum of the Pay Scale: AIBSNLEA continuously pursuing with DoT, DoPT and Dept of Expenditure for the Pension contribution on actual basic pay instead of maximum of the pay scales as per F.R 116.

14. Modification in BSNL MSRR regarding Pay fixation from E5 to E6 to DGM (Adhoc):
 AIBSNLEA succeeded in getting approved from BSNL Board the modification in BSNL MSRR regarding Pay fixation from E5 to E6 to DGM (Adhoc). Many stagnating Executives are benefited by this.

15. Promotion from DGM (Adhoc) to DGM (Regular): Due to consistent efforts of AIBSNLEA, Promotion Orders have been issued from DGM Adhoc to Regular. It is the AIBSNLEA Achievement i.e. 1st time in the history of BSNL.

16. Centralization of TR Activities:
 We strongly protested against the decision of the BSNL Management to transfer all TR work to Circle Office and requested that it has to be reviewed immediately as it is not practical. We suggested that for very small SSAs, it can be centralized at BA level but medium and larger SSAs, TR work should be continued with the SSA for effective bill collection and persuasion, settling of billing related complaints, Outstanding Pursuit, handling of EB Customers etc., Management is very much convinced on our suggestions and assured to review the policy.

17. SLA based Outsourcing of CFA and OFC works: Management has already issued orders for the SLA based Outsourcing of works. In most of the SSAs, EOI are not finalized and manipulations by the Contractors are being reported from many places because of the Clusters and Operation & Mtce., is not monitored and maintained properly. We continuously provided the feedback to the Management in this regard.

18. e-DPC/e-APAR: 
AIBSNLEA has taken up the issue of early conduction of DPC through e-DPC resulting e-APAR got introduced in BSNL in February’ 2017 in ERP Module for the year 2016-17 for streamlining e-DPC related work. As a result, e-DPC was introduced and successfully conducted for DGM (T) Promotion in Feb.’ 2020.

19. 3rd PRC Implementation with full fitment benefit: We could convince the BSNL full Board resulting it has been recommended by BSNL Board with 15% fitment for the Executives. Due to performing continuous losses by BSNL, the recommendation is pending for seeking relaxation on Affordability Clause in DoT.

20. Standard Pay scale of E2 and E3:
 AIBSNLEA will continue its efforts to get implemented the BSNL’s earlier proposal sent to DoT on 06.06.2016 and 12.06.2017 to provide justice to all the Executives in order to remove their Pay Anomaly and Stagnation. DoT referred the case to DoE and DPE for the clarification to introduce parallel Pay Scales of E1A and E2A in BSNL but DPE and DoE has replied that it is the prerogative of the Administrative Ministry/ PSU to decide the Pay Scales of Executives in the Pay Band available.

21. Govt. funding for Ex-Gratia on VRS: AIBSNLEA demand of payment of Ex-Gratia to the VRS optees by the Govt. from Budgetary Support instead of raising Bonds by BSNL has also been accepted finally.

22. Withdrawal of ambiguous CDR IPMS Score Card for CFA Segment.

23. Implementation of CPSU Cadre Hierarchy
 - Change of Designations on each Time Bound up-gradation on functional basis: On our persuasion, Management Committee of BSNL Board directed PGM Pers. to discuss and take the views of all the Stake holder Executive Associations and thereafter bring to BSNL MC for clearance. Accordingly, PGM (Pers) conducted meetings with all the Stake holders, wherein AIBSNLEA submitted its views/suggestions emphasizing the implementation of Khan Committee report in true sense i.e. Time Bound Non-Post Based functional promotions should be available up-to AGM level, senior SDE should not be inducted as functional post, all AGMs/ CAOs completed 4 years of regular service should be designated as Jt. DGM and the bench mark for promotions should be on numerical basis to minimize the droppings, the residency period from SDE to DE / AO to CAO should be 5 years instead of 12 years, reference point for implementation of CPSU CH should be date of last CPC conducted or the year of Recruitment and implementation of SC/ST roster as per DOPT instructions etc. Among these suggestions, Management considered some suggestions i.e. Time Bound Non-Post Based functional promotions made available up-to AGM level, AGMs/ CAOs completed 4 years of regular service are to be designated as Jt. DGM and the bench mark for promotions are on numerical basis. AIBSNLEA efforts are continuing for the consideration of remaining suggestions i.e. senior SDE should not be inducted as functional post, the residency period from SDE to DE / AO to CAO should be 7 years instead of 12 years and implementation of SC/ST roster as per DOPT instructions etc. BSNL Board has approved the CPSU CH w.e.f. 01.07.2018.

Congratulations !!! Ministry of Finance has given approval of Sovereign Guarantee of Rs. 15,000 Crs. (8500 Crs to  BSNL and 6500 Crs to MTNL) for restructuring of their existing debts/loans and meeting some CAPEX requirements for launch of 4G services.This is one of the proposals approved by the Union Cabinet on 23.10.2019 as part of Revival Plan.

GS attended and addressed in AUAB meeting on dated 06.07.2020. The meeting decided to organise the following programme of action: -
(1) All the employees are called upon to wear black badge on 16.07.2020. Black flag demonstrations are to be organised by the employees during lunch hour on 16.07.2020, against the cancellation of BSNL's 4G tender and against the road blocks being created in the rolling out of BSNL's 4G services.
(2) A memorandum is to be submitted to all the MPs during the period from 13.07.2020 to
31.07.2020, urging upon them to intervene in favour of BSNL’s expeditious rolling out of 4G network, as well as the early revival of BSNL.
(3) Twitter campaign is to be organised on 05.08.2020, demanding immediate rolling out of 4G network by BSNL and implementation of the assurances given in the Revival Package.

Demands:

(i) BSNL should immediately be allowed to roll out it’s 4G Services.
  a) BSNL should take immediate actions to upgrade the 4G compatible BTSs.
  b) Add on order for 4G equipments as per Phase VIII.4 tender should be issued  immediately.
  c) In the matter of procuring new equipments and upgrdation, there should not be any
      discrimination, between BSNL and other private telecom service providers.
(ii) The Government should immediately implement the decisions contained in BSNL’s Revival Package, like extension of Sovereign Guarantee for the issuing of Bonds.
(iii) Urgent measures should be undertaken by the BSNL Management for immediately improving the quality of service.
(iv) The Management should ensure that the salary payment of the employees is made on the last working of every month.
(v) The Management should immediately take steps to ensure that the employees get cashless treatment from empanelled hospitals during Covid 19 pandemic. The Management should pay Rs.10 lakh to the family of the employees who die due to COVID -19. Based on the instructions issued by the DoT, the Postal Department has already introduced such a scheme to it’s employees.

GS, AIBSNLEA writes to Shri P.K.Purwar, CMD BSNL  and requested for immediate  issuance of Regular Promotions  in all the Streams/Grades  in order to fill up the huge vacuum created due to VRS-2019 and to maintain the vast BSNL Telecom Network fault free and the Administrative Offices efficiently.  AIBSNLEA strongly oppose any look-after arrangement in higher grade

Thousands of Executives in Higher Scales are working in the entry level of

JTO equivalent grades for 5 to 30 years and waiting for their 1st promotion

i)JTOs recruited from 1988 in Arch wing,

ii) JTOs recruited from 1997 in Electrical and Telecom Factory wings,

iii)Thousands of JTOs in Telecom wing from 1999, 2001 to 2008, 2010,2013 etc.,

iv)JTOs recruited in 1998 in Civil Wing are waiting.

Like that:

SDE(C)s are waiting for EE(C) promotion from 1998

SDE(E)s are waiting for EE(E) promotion from 2000

SDE(TF)s are waiting for AGM(TF) promotion from 2001

SDE(T)s are waiting for AGM(T) promotion from 2004

AOs are waiting for CAO promotion from 2008.

Like that promotion from PA to PS, PS to PPS and CSS Cadres are also held up.

It is observed that, BSNL Management was deliberately dragging the Promotion and putting the career of the Young Executives at great risk. At the early stage of their career itself, they are getting de-motivated and demoralized. But to our surprise, there are no hurdles in the Promotion at the Top level. It is pertinent to mention that Un-interrupted promotions orders were issued in the grade of GM and CGM level, in some cases excess promotions were also given at GM and CGM level for which BSNL Management is not having any reluctance at all. Even on their last working day, some ITS Officers were given promotion, we welcome that. But thousands of Absorbed BSNL Executives were retired without getting due promotion when there was no hindrance for giving them promotion.

When a Group A Officer in BSNL gets Time bound Promotion along with designation change from E4 to E9 Scale with the designations of Asst General Manager ->Dy General Manger ->Jt GM ->Addl GM in 17 years and then GM to Sr GM also, but a JTO(T) joined in 1999 ,2001 to 2008, 2010 and 2013 is still continuing as JTO, JTO(Arch) joined in 1988 still continuing as JTO, JTOs recruited from 1997 in Electrical and Telecom Factory wings are continuing as JTOs and JTOs recruited in 1998 in Civil Wing are continuing as JTOs.

All the Executives are expected that the due promotion will be given during the implementation of VRS. But even 5 months after the VRS, nothing is moving in  BSNL CO and making the situation very worst. There is a huge stagnation in promotion among different wings.

Most of the Executives are drawing Two to Four Stages in the higher Scales than their Substantive Scale/Grade viz., a JTO of E-1 Scale is drawing E-4/ E-5 (AGM/DGM) scale and a SDE or AO equivalent of E-2 scale is drawing E-5/E-6 (DGM/SG-DGM) Scales and waiting for their Regular Promotions from years together. Since the Executives are already working/drawing the higher scales, promotion is not going to make any financial implication either to BSNL or DoT. The regular promotion orders can be issued from among the Executives working in higher scales.

 

AIBSNLEA strongly oppose any look-after arrangement in higher grade but we demand immediate promotions on ‘Regular Basis’, considering the post VRS vacuum. If immediate steps are not taken, Services will be severely affected since the Executives are reluctant to take higher responsibilities on short-term/temporary basis.

Today, AIBSNLEA, the only Association actually represents all the Streams/ Cadres in BSNL and taken up the issues pertaining to the Executives of all the Streams with utmost sincerity and  without any biased manner since last 16 years filed the nomination for participating in the Second MVP.  

AIBSNLEA CHQ today insisted the BSNL Management to ensure the following for the conduction of 2nd MVP in a free and fair manner,

1)  Special Permission to be obtained from Ministry of Home Affairs and Ministry of Health for continuous extensive travel by the Central Head Quarters Leaders/Circle Secretaries in Flights/Trains/Buses throughout India for 2nd MVP Campaign without quarantine since MHA has notified compulsory quarantine for those who are travelled by Flights, Trains and buses from one State to another and Inter Districts from 5 to 14 days according to the Pandemic situation in the concerned State/District.

2)  Since Mass gathering and conduction of meetings for 2nd MVP canvassing has also banned by the MHA, hence Special Permission is to be obtained from the MHA/ concerned State Authorities i.e., from Chief Secretaries/Director General of Police/ District Collectors for conducting 2nd MVP Canvass meetings at District Head Quarters/State Capital, wherein Central/Circle/District Office bearers will participate. It is pertinent to mention that our members are working in the SSAs and SDCAs throughout India hence 2nd MVP Campaign should reach each and every Voter, as every Voter wants to listen their Leaders.  It is our Democratic Right to canvass for the 2nd MVP throughout India and it should not be restricted.

3)  100% BSNL Executives are not able to reach the Polling booths on the day of polling since Public Transport, Metro, Local Train Services are not available in many places. Hence, Vehicles should be provided by the BSNL Management to those executives not able to come to Polling Booths for casting their votes.

4)  Special Permission to be obtained from Ministry of Home Affairs and Ministry of Health and concerned State Authorities for the movement of BSNL Executives from the containment Zones and Hot Spots for canvassing and to reach the Polling Booths to cast their votes.

5)  MHA has recently issued new guidelines on June 29, 2020 for Unlock-2, wherein many restrictions are continued till 31.07.2020 and may be further extended for August 2020, also.

6)  If conduction of 2nd MVP leads to any mis-happenings or untoward incidents, it will be the Sole responsibility of the BSNL Management and Special Insurance Coverage should be arranged for all the Executives before the conduction of 2nd MVP since there is a serious Life threat due to Covid-19.

All the Circle Secretaries/ District Secretaries are advised to form Committees and conduct meetings through Video Conferences, wherever necessary with the involvement of Organizing Secretary/CHQ Office bearers, and motivate the Activists to collect and submit the membership forms to the concerned DDO before 15th July 2020 duly filled in by the new members in each Circle/SSA/Branch etc..

All the CHQ/CWC Members/Circle/SSA/Branch Office bearers, activists and members are requested to interact with each and every Executive, explaining the Achievements, Progress and Status of the issues taken up by AIBSNLEA CHQ/Circle.

All the members are requested not to be misguided by the Malice/Mischievous Propaganda/Campaign in the Social Media by the vested interested groups/Mongers. 

We request all the BSNL Executives to analyze the facts, approach of AIBSNLEA on the issues of all disciplines, quick action thereon by AIBSNLEA, and then cast your vote in favour of AIBSNLEA so that the future of the Executives is secured and BSNL is saved

AIBSNLEA was formally launched on 1st May’ 2004 by merging 10 separate Associations representing different disciplines of Group ‘B’ and Group ‘A’ promoted officers.

AIBSNLEA is the only Association actually represents all the Streams/ Cadres (Telecom/Finance/Civil/Electrical/Arch/TF/PA/PS/OL/CSS etc.) in BSNL and taken up the issues pertaining to the Executives of all the Streams since last 16 years without any biased manner.

AIBSNLEA is committed with its core strength for the development of the BSNL as well as to protect the Service Benefits and Legitimate Rights of their Members.

Achievements of AIBSNLEA as a Supporting Association after 1st Membership Verification

1. Mega Promotions
- Mile Stone created in the History of DoT & BSNL- AIBSNLEA Vision and Positive approach benefited thousands of Executives by Promotion through CPCs, which is a Major breakthrough and Achievement of AIBSNLEA: Due to consistent untiring and dedicated efforts of AIBSNLEA, CPCs were conducted in all disciplines to fill up all the vacancies in almost all Cadres resulting about 14,000 Executives have been promoted in June-July, 2018 and Nov,2018 which has given a great relief and Morale booster to the Executives who were waiting for their promotions years together. It is a mile stone in the History of DOT and BSNL.

On the pretext of various pending Court cases, BSNL Management is not conducting CPCs. AIBSNLEA has written to the Management for the immediate filling up all the vacant JAG, STS Group ‘A’ & Group ‘B’ Grade posts in all disciplines in BSNL on Regular basis through CPCs before the implementation of the proposed VR Scheme and before any Notification of CPSU Cadre Hierarchy on the prospective date to avoid humiliation among the Sr. Executives.

AIBSNLEA is only Association persuaded and convinced the Management that CPCs in BSNL can also be conducted on the similar lines on which the other Departments are conducting the CPCs on the basis of Hon’ble Supreme Court’s Judgment in the case of Nagaraj on SC/ST roster implementation: BSNL Management considered our request and decided in the BSNL MC to initiate CPCs in all disciplines on the same line of other Departments. Mean-while Hon’ble Supreme Court also delivered the Judgment allowing SC/ST roster implementation in promotions which was also endorsed by DoPT. This further smoothens the way for conducting CPCs in BSNL. In the SDE(T) Promotions all the vacancies could not filled up due to the Court cases at Ernakulum and Chennai. Only 5237 JTOs were promoted as SDE in 2018.

2. 30% Superannuation benefits to directly recruited employees as per DPE guidelines:
 AIBSNLEA requested CMD BSNL, Director (HR/EB) and ED (Finance) to resolve superannuation benefits to directly recruited employees as per DPE guidelines and BSNL should contribute 12% as Superannuation Benefits in respect of Direct Recruits to fulfill the limit of 30% contribution. The remuneration committee of BSNL Board recommended to start a Superannuation benefit Trust to directly recruited BSNL employees with a contribution of 3% initially and further it can be reviewed on the basis of financial health of the Company. DoT issued the Presidential Directives in this regard and BSNL Management created a Trust and other formalities in this regard. On our persuasion BSNL Board has increased the contribution from 3% to 5% but we are continuously demanding 12% contribution. CMD BSNL assured to increase further 2% in the contributions to the Superannuation benefits by March, 2019 but remain pending due to Financial Crunch in BSNL. AIBSNLEA will continue its efforts in this regard.

3. JAO 2010 Batch option case:
 Due to hard and continuous persuasion with deep commitment and understanding of the issue results in getting released the order allowing JAO 2010 Batch (Departmental 40% Quota) to exercise their option for fixation of pay in the revised pay from the date of promotion in the grade of JAO, as one time dispensation.

4. Group Term Insurance for the BSNL Executives:
 It is our major achievement and relief for all the Young Comrades AIBSNLEA attended all the meetings with the Committee members constituted to discuss the methodology for induction of Group Term Insurance (GTI) for its executives. Implementation of GTI Scheme for BSNL Executives has been finalized & MoU between LIC & BSNL is finalized & signed between LIC & BSNL on 27.12.2019. The Scheme has already been implemented w.e.f. 01.03.2019 with annual Premium of Rs.9440/- for a coverage of Rs.50 lakh for all the Executives up to 50 years of age.

5. Reversion of 2001 Recruited JTOs Passed LDCE 2007: 
Due to AIBSNLEA continuous persuasion with the Management a Committee has been formed and Committee Report is likely to be placed before the Management. We will continue our efforts in this regard.

6. Rs. 22820/- Pay Fixation case of JTOs/JAOs post recruited 2007:
 AIBSNLEA along with AITEEA requested CMD BSNL for the removal of pay anomaly in this regard. Accepting our request CMD, BSNL constituted a Committee headed by PGM (PF) Smt. A. Panda to examine the issue and submit the report. We also gave presentation to the Committee and the Committee has submitted its report to the competent authority for consideration. We are pursuing with Director (HR) and CMD BSNL for the resolution of the issue. We have explained that already some Pay Anomaly Cases of JTOs 2005 batch, JAO 2010 batch and Asstt. of CSS cadre have been settled by BSNL Management. In the same line this issue also needs settlement but case remains pending.

7. Management Trainees Recruitment Rule-2009: 
AIBSNLEA consistent efforts yielded results in getting deferred MT Exam – 2015 but some Executives Associations and Non-Executives Unions are continuously making efforts for MT recruitment. Our considered opinion is that since young and talented executives having B Tech/M Tech, CA/ICWA, MBA qualifications at the level of JTO / SDE are available in BSNL, hence there should not be any lateral induction above JTO cadre. The lateral induction above the JTO cadre will block the career progression of these young talented executives available in BSNL. But the BSNL Management has further notified MT Recruitment from Internal Quota by conducted the exams on 17th March, 2019. Against this AIBSNELA has protested. Management has to scrap the MTRRs to provide smooth career progression to the existing executives of BSNL.

8. E1+ 5 increments benefit to JTOs/JAOs: Management Committee of the BSNL approved E1+5 increments benefits to JTOs/JAOs but it is pending for BSNL Board Approval, our efforts are continue.

9. Due to consistent efforts of AIBSNLEA, the FR22(1)(a)(i) benefits extended to the Ex. Officiating JTOs w.e.f. 1.1..2007.

10. Withdrawal of Additional Increment in the same scale on functional promotion under EPP: DoT vide its letter dated 05.07.2017 withdraw additional Increment in the same scale on functional promotion under EPP.
 Against this, AIBSNLEA immediately filed an OA in the Hon’ble PB CAT New Delhi for quashing the order. Even after that, DoT continued to reduce the Pension of the BSNL retiree Executives, against this AIBSNLEA filed a Contempt Petition in the Hon’ble PB CAT New Delhi. Thereafter DoT stopped reducing the pension/ revising the Pay fixation by obtaining an under taking from the retiring executives, DoT has filed Writ Petition in the Hon’ble High Court of Delhi wherein AIBSNLEA has filed a caveat. The case was heard and Posted for next hearing in April 2020. Due to COVID-19 Lock down it is not yet heard.

11. AIBSNLEA is actively Participated in all the Agitation calls given by AUAB
 and regularly attending the meetings to discuss the issues related to the Revival Plan, Financial viability of BSNL, allocation of 4G spectrum to BSNL, Monetization of non-core Land, the issues of revision of Pay, Pension and Payment of pension contribution on actual basis instead of maximum of the pay scale, BSNL MRS etc. To get settled the demands, AUAB launched series of agitation calls including 3 days strike and March to Sanchar Bhawan etc., in all the Agitational Calls AIBSNLEA was in fore front and actively participated and succeeded by getting Revival Plan Approved by the Union Cabinet on 23.10.2019 with a) 4G spectrum and 18% GST free of cost, b) No financial implication for BSNL on VRS, c) Land monetization for loan repayment and development, d) Rs 8,500 Crore Bond for Restructuring of loan. Contentious issues like E2 & E3 Pay Scale will be settled before BSNL & MTNL Merger.

12. Tower Subsidiary formation:
 Govt. of India with the Union Cabinet approval dated 12.09.2017 has created a Subsidiary Tower Company fully owned BSNL. The company has been registered in the name BSNL Tower Corporation Ltd. on 04.01.2018. But, DoT arbitrarily appointed Shri Amit Yadav, JS (Admn), an IAS officer, as the CMD of the Subsidiary Company which created apprehension that Govt. may any time sell out the Subsidiary Company through strategic business partner. Against this, AUAB protested organizationally and decided to protest legally also. Accordingly, AIBSNLEA filed a case in the Hon’ble High Court of Delhi resulting BTCL still not in operation.

13. Pension Contribution on Acutal basic Pay instead of Maximum of the Pay Scale:
 AIBSNLEA continuously pursuing with DoT, DoPT and Dept of Expenditure for the Pension contribution on actual basic pay instead of maximum of the pay scales as per F.R 116.

14. Modification in BSNL MSRR regarding Pay fixation from E5 to E6 to DGM (Adhoc):
 AIBSNLEA succeeded in getting approved from BSNL Board the modification in BSNL MSRR regarding Pay fixation from E5 to E6 to DGM (Adhoc). Many stagnating Executives are benefitted by this.

15. Promotion from DGM (Adhoc) to DGM (Regular): 
Due to consistent efforts of AIBSNLEA, Promotion Orders have been issued from DGM-Adhoc to Regular. It is the AIBSNLEA Achievement i.e. 1st time in the history of BSNL.

16. Centralization of TR Activities:
 We strongly protested against the decision of the BSNL Management to transfer all TR work to Circle Office and requested that it has to be reviewed immediately as it is not practical. We suggested that for very small SSAs, it can be centralized at BA level but medium and larger SSAs, TR work should be continued with the SSA for effective bill collection and persuasion, settling of billing related complaints, Outstanding Pursuit, handling of EB Customers etc., Management is very much convinced on our suggestions and assured to review the policy.

17. SLA based Outsourcing of CFA and OFC works:
 Management has already issued orders for the SLA based Outsourcing of works. In most of the SSAs, EOI are not finalized and manipulations by the Contractors are being reported from many places because of the Clusters and Operation & Mtce., is not monitored and maintained properly. We continuously provided the feedback to the Management in this regard.

18. e-DPC/e-APAR: 
AIBSNLEA has taken up the issue of early conduction of DPC through e-DPC resulting e-APAR got introduced in BSNL in February’ 2017 in ERP Module for the year 2016-17 for streamlining e-DPC related work. As a result, e-DPC was introduced and successfully conducted for DGM (T) Promotion in Feb.’ 2020.

19. 3rd PRC Implementation with full fitment benefit:
 We could convince the BSNL full Board resulting it has been recommended by BSNL Board with 15% fitment for the Executives. Due to performing continuous losses by BSNL, the recommendation is pending for seeking relaxation on Affordability Clause in DoT.

20. Standard Pay scale of E2 and E3:
 AIBSNLEA will continue its efforts to get implemented the BSNL’s earlier proposal sent to DoT on 06.06.2016 and 12.06.2017 to provide justice to all the Executives in order to remove their Pay Anomaly and Stagnation. DoT referred the case to DoE and DPE for the clarification to introduce parallel Pay Scales of E1A and E2A in BSNL but DPE and DoE has replied that it is the prerogative of the Administrative Ministry/ PSU to decide the Pay Scales of Executives in the Pay Band available.

21. Govt. funding for Ex-Gratia on VRS:
 AIBSNLEA demand of payment of Ex-Gratia to the VRS optees by the Govt. from Budgetary Support instead of raising Bonds by BSNL has also been accepted finally.

22. Withdrawal of ambiguous CDR IPMS Score Card for CFA Segment.


23. Implementation of CPSU Cadre Hierarchy
 - Change of Designations on each Time Bound up-gradation on functional basis: On our persuasion, Management Committee of BSNL Board directed PGM Pers. to discuss and take the views of all the Stake holder Executive Associations and thereafter bring to BSNL MC for clearance. Accordingly, PGM (Pers) conducted meetings with all the Stake holders, wherein AIBSNLEA submitted its views/suggestions emphasizing the implementation of Khan Committee report in true sense i.e. Time Bound Non-Post Based functional promotions should be available up-to AGM level, senior SDE should not be inducted as functional post, all AGMs/ CAOs completed 4 years of regular service should be designated as Jt. DGM and the bench mark for promotions should be on numerical basis to minimize the droppings, the residency period from SDE to DE / AO to CAO should be 5 years instead of 12 years, reference point for implementation of CPSU CH should be date of last CPC conducted or the year of Recruitment and implementation of SC/ST roster as per DOPT instructions etc. Among these suggestions, Management considered some suggestions i.e. Time Bound Non-Post Based functional promotions made available up-to AGM level, AGMs/ CAOs completed 4 years of regular service are to be designated as Jt. DGM and the bench mark for promotions are on numerical basis. AIBSNLEA efforts are continuing for the consideration of remaining suggestions i.e. senior SDE should not be inducted as functional post, the residency period from SDE to DE / AO to CAO should be 7 years instead of 12 years and implementation of SC/ST roster as per DOPT instructions etc. BSNL Board has approved the CPSU CH w.e.f. 01.07.2018.

PGM(Pers), Sr GM(Estt), GM(SR) and GM(Restg) also present in the meeting. Com S Sivakumar, GS/AIBSNLEA, Com Sebastin K, GS/SNEA, Com Rajpal, AGS/AIBSNLEA  and  Com A.A Khan, President/SNEA  participated in the meeting. The meeting went on for more than three and half hours.

Brief of meeting:

a) Regular promotions to all Grades for all the eligible Executives instead of LA arrangement. There is no financial implications for promotions:

In the last meeting held on 05.05.2020, it was concluded that due to court cases and reservation related issues, implementation of Non-post based Time Bound promotion policy OR CPSU Hierarchy approved by the BSNL Board on 28.05.2018 will be expedited and Pers. section will work out on that. We explained that due to various court cases, promotions are held up for years together and to overcome that, CPSU Hierarchy is approved by the BSNL Board on 28.05.2018. It is as per the terms and conditions mentioned in the Presidential orders issued to the Executives at the time of absorption in BSNL. The promotion orders issued in June, 2018 also under litigations and Hon CAT/Chandigarh declared the AO and DE promotions PROVISIONAL and directed BSNL to review the promotions. JTO to SDE promotion also under litigation at CAT/Ernakulam. Hence no other option left for BSNL to give promotions.

We were very firm on our demand for promotion w.e.f. 01.07.2018 itself as it will ensure parity in promotions and protect the seniority with those promoted in June 2018 and counting of 2 years service for the future promotions. Due to litigations, JTO to SDE promotion is pending since 2011 except some promotion in 2018. Almost all the promotions held up between 2015 to 2018 due to reservation issue. To compensate those damages, Management itself proposed CPSU Hierarchy w.e.f. 01.01.2017 itself but Board approved it w.e.f 28.05.2018. We explained that earlier also, EPP and SDE RR amendment etc., implemented retrospectively. i) EPP approved and notified on 18.01.2007 but implemented from 01.10.2000 onwards with all consequential benefits from 01.10.2004. ii) SDE RR amendment notified on 08.05.2018, effectively from 28.08.2015, the Board approval date.

BSNLMS RR notified in 2009 and promotion to AGM/CAO/EE grade given after 10 years of BSNL formation.

Under the same Administrative Ministry (DoT), TCIL and BBNL is giving promotions through Non-post based Time Bound promotion OR CPSU Hierarchy.

On the reference to DoT, DIR(HR) got it clarified from the letter sent to DoT that BSNL is seeking only guidance from DoT, not approval OR concurrence.

We categorically told the Management that Look After arrangement cannot be continued like this and the Executives are to be given Regular promotion. Otherwise, in the near future, we will be forced to make appeal to our members not to accept LA promotion which will create operational issues in the field.

Finally after detailed discussion, it is decided that Director (HR) will brief the CMD and other Board members about the policy approved by the Board and the need for its implementation as no other option left for BSNL to give promotions. A presentation will be given to the Management Committee of the Board on the policy in 2 weeks time as all Board members are new.

b) DGM(T/F) Adhoc to DGM(T/F) Regular promotion. Relaxation in qualifying service for DGM(T) and DGM(F) promotion as the Executives are already working as DGM on LA basis:

On DGM(T/F) Adhoc to Regular promotion, we demanded their regular promotion. Now the number of vacancies are much higher than the eligible AGM/CAOs. On DGM(T) Adhoc to Regular promotion, Management informed about the seniority revision and legal aspects will be examined for giving regular promotion. Since there is no seniority issue, DGM(F) Adhoc to Regular promotion may be processed.

Due to abnormal delay in promotions to AGM and CAO Grades, sufficient AGM and CAOs are not available for promotion to DGM Grade. More than 90% of the posts are lying vacant. At the same time Management utilising their service as DGM by LA arrangement. We demanded their regular promotion as DGM by relaxing the qualifying service. Al of them got sufficient experience as AGM/CAO by LA/Officiating/regular service. Management accepted that there is operational requirement and in principle agreed our demand. Finalization of number of DGM posts through Restg., will be finalized by this month end. Thereafter proposal will be moved.

c) Agenda meeting for Non recognized Associations:

We strongly objected the Management action and told DIR(HR) that there is no need for Membership Verification at all as there is no distinction between Recognized/ applicant /non-applicant Assns. All are given meetings even on Policy matters and Management is using them against the Recognized Associations making Membership Verification and Recognition Rules irrelevant. The very purpose of Membership Verification was to end multiplicity of Associations but it is defeated by the Management. Due to the Divide and Rule policy of the Management, resolution of the HR issues are getting delayed and the Executives are suffering.

Management explained that no Agenda meeting is given to any other Association other than Recognised Association. All the meetings given to other Associations are only informal. It will be taken only as a feedback to the Management. On important matters and Policy matters, Management will consider the opinion of the Recognised Associations only, as per the Recognition Rules.

d) Hike in SAB contribution and payment of SAB contribution:

We demanded hike in Superannuation Benefits (SAB) contribution as assured by the Management earlier and payment of SAB contribution to LIC from August, 2019 onwards. SAB is the Social Security for the BSNL directly recruited employees and it has to be given top most priority after Salary, we demanded. Since the SAB contribution payment to LIC is pending, the VRS optees retirement claim from Superannuation Fund also not settled so far.

On pending payment of SAB contribution, Management agreed to take up with the concerned. Hike in SAB contribution will be examined by the Management, it is assured.

e) Pending Modification in DGM(T) promotions – majority of them worked outside the  Home Circle and came back after 3 years:

We explained that as AGMs they were worked outside the Home Circle and came back to their Home Circle after 3 years. Again on DGM promotion, they have been transferred out from their Home Circle. As all are worked outside, they may be posted in the same Circle itself. Management informed that the cases will be considered.  

f) Reversion of 2001 Rect JTOs promoted as SDEs in LDCE 2007:

We requested to complete the process in a combined manner and a meeting with the Committee at the earliest. After discussions, it is decided to have the Committee meeting this week itself.

CS Com.Shaji , CVP Com.Rajan and DS CO Com.Sreejith had a pre appointed meeting with Shri. C.V  Vinod ,  CGMT Kerala and had discussion on the following matters , yesterday on 08-06-2020.


Exclusive SDE/JTO FTTH at Cluster Level:

As CFA sector based CU pairs has been shifting down the line to the state of the art technology FTTH, one exclusive SDE/JTO FTTH and one JE under him is very much essential for holding up the life of BSNL CFA sector through Fibre . It would be better to extend BSNL direct FTTH to customers, if feasible, than to Exclusive LCO / Other LCOs, though average per line installation charges , including modem , are high .  Deadly competition, cross-promotion marketing and life-saving predation in this FTTH sector, naturally  recommend BSNL to have own foot in this sector too at maximum possible extend .

 

Lack of proper response / working of clarity servers ; resultant frustration to concerned :

Work orders are not getting generated on time and they are not getting conveyed to the next work group on time. The normal time delay for updating to the next workgroup is normally less than a minute has now been taken for more than 30 minutes. Occasions are there to wait for hours for a service order to get closed which normally take less than two minutes. CGMT shared our concern and commended the issue is taken up with ITPC. Understandably aging of the servers and resultant load unbalancing causes the discomfort while using services. Hopefully, the issues will be settle down

 

Long pending AO-CAO (LA) orders :

We expressed our strong concern over the non release of CAO- LA orders though many BAs like Thrissur have requested the same to circle office with proper justification. It is very much essential for the load balancing and performance of accounts/finance vertical of Kerala Circle. CGMT informed that the file is now with PGMF and orders may be released. Later the matter is discussed with PGMF and requested to release the CAO LA orders. PGMF assured to release it and we further requested PGMF to release the file without holding it for long.

 

Posting of an Accounts Officer in Lakshadweep:

For the betterment of BSNL services one Accounts Officer belongs to Lakshadweep shall be posted there. CGMT was very positive to accept the request as the officer is native of the island   and proactive in executing all kinds of works for the benefits of BSNL. CGMT agreed to process the request after receiving report of the concerned PGM.

 

Heavy recovery from erstwhile O_JTOs on erroneous pay fixation :

When the matter is discussed CGMT, he replied that the file decision is not favourable. We demanded the details of the decision and CGMT assured to share the same within a couple of days.

Meeting with Shri S K Gupta, Director (Fin) on 03.06.2020

General Secretaries of AIBSNLEA and SNEA and President/SNEA met DIR (Fin) and had discussions on the following issues:

1. Fund availability and payments: We draw the attention of the Director (Fin) regarding various pending payments like labour, Rentals, SAB dues etc. The labour payment is due for more than one year. Director (Fin) informed that the cash collection improved during May 2020 and BSNL could collect Rs 1,400 Cr. The cash collection during April 2020 was Rs.1,150 Cr only. First priority will be for allotment of funds for maintenance and Statutory payments. For labour payments, 15Cr will be allotted today (03.06.20), DIR (Fin) informed. Regarding May, 2020 Salary disbursement, it may be feasible next week end.

2. Promotions to various Cadres: We draw his attention to the huge stagnation and shortage of Executives in many Cadres and sought his intervention. The Executives are working in higher scales and they can be promoted as per the policy approved by the BSNL Board within no time. DIR(Fin) also felt that major works are getting suffered due to shortage in Key posts and assured to discuss with DIR(HR) for early promotions.

3. Drastic post reduction: We strongly protested against the decision of the BSNL Management to transfer all TR work to Circle Office and requested that it has to be reviewed immediately as it is not feasible. We suggested that for very small SSAs, it can be centralised but medium and larger SSAs TR work to be continued with the SSA for effective bill collection and persuasion, settling of billing related complaints, Outstanding Pursuit, handling of EB Customers etc., DIR(Fin) very much convinced on our suggestions and noted down all the points and assured to discuss with DIR(CFA) and CMD. In this regard, AIBSNLEA has already written a letter to CMD BSNL with a copy to Director (Finance) for review the policy.

4. SAB dues payment to LIC: We brought to the notice of DIR (Fin) that SAB dues payment to LIC is pending since August 2019. Some VRS optees cases also not settled as the dues are not paid to LIC. We demanded immediate payment of contribution to LIC. DIR(Fin) assured to examine the matter and do the needful.

5. Monthly Review Meeting with Recognized Associations and Unions: We appraised DIR (Fin) about the meeting of Recognized Assns. and Unions with CMD and sharing of Monthly Revenue and Expenditure details with the Stake Holders and monthly review meeting with the Recognized Assns. and Unions so as to improve the efficiency of the Company and maximisation of Revenue and controlling of unnecessary expenditure. DIR(Fin) appreciated our concern and mentioned that  the Management is reviewing the monthly revenue and expenditure and planning for Revenue Maximisation and he assured that after the completion of the work it will be shared with Stake Holders for discussion.

6. Consideration of Request transfers of Accounts Personnel from BSNL CO to their Home Circles: Dir(Fin) mentioned that those who are opted for BSNL CO will be posted to BSNL CO as substitutes for the Accounts Personnel requested for transfer to their Home Circles and assured that the Accounts Personnel will be relieved from the BSNL CO after the lifting of COVID-19 Lockdown.

CGMT Kerala averted the threat of outsourcing all the categories of CSCs (Type-I , Type-II  and Type-III) thereby stopping  all the possibilities : of  taking full database of all BSNL heavy callers would have been used against the benefits of BSNL , of reducing working strength of Executives (SDE/AO/JTO/JAO)  and non-executives already working in CSCs , of blocking BSNL Employees to have direct communication with beloved Customers as CSCs are the only formal window remaining for the same etc....

AUAB Kerala has taken up the matter with CGMT and CGMT issued clarification letter to the corporate office directions to see that every effort should be explored to run Type-I and Type-II CSCs with BSNL Employees.

Terms Of Reference (TOR) of the committee announced:

During the discussion with the Committee members by both GSs regarding the issue of reversion of 2001 Rect JTOs passed the LDCE 2007, Committee members informed that they are waiting for the Terms Of Reference of the Committee. We brought this to the notice of DIR(HR) and PGM(Pers), next day itself.

We requested to include: examining the eligibility of 2001 rect JTOs passed the LDCE 2007 with reference to SDE RR 2002 and the clarifications issued with reference to LDCE 2007. Now BSNL CO issued the TOR as we suggested. The focus is on resolving 2001  rect issue, segregating them from 2002 rect JTOs.

It is a great breakthrough in the case. So far the eligibility was examined by BSNL and the court cases defended based on the 30.07.2010 clarification issued during LDCE 2010 and the clarifications issued on 16.04.2007 and 10.07.2007 during LDCE 2007was not at all considered or produced in the court.<<<Click here for the term of reference>>>

Drastic cut in number of posts on the anvil in the name of Restructuring:

It is learned that through Restructuring and Review of Assets, BSNL Management  is considering drastic reduction in the combined strength of AGM and DGM equivalent Grades in all the Streams (Telecom, Finance, Civil, Electrical, Arch, TF, PPS and CSS) and AGM+DGM number in all the Streams combined together will be about 3300 – 3500. The present combined sanctioned strength of AGM+DGM is 8953. In other words, drastic reduction of posts proposed, by about 65%. The final figure will be divided in some ratio between AGM and DGM. If it happens, then it will stop almost all the promotions to AGM and DGM Grade in all Streams as we are apprehending.

This is in the name of Restg. and M/s Deloittee recommendation. The same Consultant M/s Deloittee, in 2014, recommended an increase in the number of AGM (T) posts from 5303 to 6172 and DGM(T) posts from 1331 to 1607. After 6 years, the same Consultant makes recommendation for drastic reduction of posts. This establish that the Consultant is acting on behalf of the Management and what Management  requires, that report  is given by the Consultant, without making any Work Study.

Similar cut in the number of posts can be anticipated in other Grades also (SDE/AO and JTO/JAO equivalents). The provisional norms issued in December, 2019 by Restg. cell indicates that the Circles can work out the revised sanctioned strength of the Circle based on that provisional norms and find out the revised strength.

We may have to go for strong organizational actions in the near future if Management is not coming forward and discussing and settling the matter.

Management is dragging the Promotions to complete the Restg. process, making assurances one after another. Restrg. should not take away the Promotional avenues of the Executives working in BSNL. On review of the Assets, large number of posts will be surrendered in addition to the posts surrendered due to VRS. Knowing the adverse effect of Restg. on Post based promotions, we are insisting for Non-post based Time Bound functional promotion in all the Streams.

Meeting with Shri Arvind Vadnerkar, DIR(HR) on 18.05.2020:

General Secretaries of AIBSNLEA  and SNEA  met DIR(HR) and held discussions about the progress in Promotions to various Grades as per the assurances given in the detailed  Agenda meeting with DIR(HR) on 05.05.2020. It was a follow up meeting.

DIR(HR) informed that he directed the PGM(Pers) to work out on the New Promotion Policy as it has come to the conclusion in the last meeting that Post based promotion is not at all feasible atleast for few years due to the Reservation issue. PGM(Pers) could come to office today after long break due to Nationwide Lockdown. We explained that irrespective of category, ST/SC/OC category Executives are waiting for promotion for years together. For example, 2001 recruited JTOs of SC and OC category and 2002 Rect JTOs of ST category are waiting for promotion to SDE Grade even after completion of 18 to 19 years of service. But as per the New policy, all the JTOs completed 5 years of service, irrespective of ST/SC/OC category will get promotion.

We further explained the urgency for issuing promotion as in almost all the cadres, except AO cadre, more than 60% positions are vacant and in many important grades, it is more than 90%. In this situation how BSNL Revival is possible, we asked.  Director (HR) reassured early action in this regard.

On the Reversion of SDEs of 2007 LDCE, on our continuous pleadings to find out an early solution, Director(HR) arranged a meeting with the Committee on 19.05.2020, tomorrow itself at 4 PM.

CS Com.Shaji and CVP Com.Rajan had an agenda meeting with Shri. C.V.VINOD CGM BSNL Kerala at 9.20AM today. CGMT welcome AIBSNLEA for the meeting and appreciated the employees of Kerala circle for continuing to demonstrate the commitment during these hard times of Covid-19 pandemic crisis in maintaining our network, accounts/finance activities.  Almost all the pending Service/HR issues are discussed. We extended regards to CGMT in writing back to us on our letter requesting him to post IFA/CAO . However , we  expressed our unhappiness to CGMT that our members belongs to accounts wing are very demoted even after a long waiting too that our request for the eligible LA arrangements in IFA and CAO cadres for the balanced working of Kerala Circle has not been fully addressed so far. CGMT explained that as per corporate office guidelines, the TRA activities are centralized and CAO TR post cannot be there with BAs.  We suggested CGMT that Kerala Circle having a good number of LL/BB in all BAs compared to many other circles. Most of our BAs are having more number of LL/BB connections than the total count with many other circles. Moreover, all the TR activities cannot be centralized. We requested to consider the CAO posts in all BAs of Kerala for the effective and highest performance of BAs.

 

After some more discussion, CGMT opinioned that the option calling notification for CAO TR had been withdrawn subsequent to the letter from corporate office on the centralization of TRA activities . Hence, to consider our request, CGMT assured us to write corporate office in this regard.

 

Later CS and CVP met PGM(F) Kerala Circle Smt.Yojana Das and discussed the matter of posting IFA/CAO . We expressed our strong unhappiness to IFA also. PGM(F) assured to discuss the issue with CGMT for an best possible  solution .

Agenda Meeting with Shri Arvind Vadnekar, Director(HR) on 05.05.2020:

General Secretaries of AIBSNLEA  and SNEA  had detailed Agenda meeting with the DIR(HR) on various important HR issues: Sr GM(Estt), GM(SR), GM (Restg) and DGM (Pers)  were present in the meeting. PGM(Pers) joined the meeting over phone. The deadlock situation in promotion to different cadres was the main issue. The discussion took place for more than two hours on the following Agenda points submitted to the management in advance.

a) Undue delay in regular promotions to all the eligible Executives: Even though there is no financial implication, Management is not taking any initiative for regular promotions. At the same time, continuing with Look after arrangement:

From Assn side, both GSs demanded promotion on Time Bound basis as there is no visibility for promotion through any other channel due to the various Supreme Court judgments on reservation. Since Executives are already working in higher scales, we demanded promotion which is just a designation change and no financial implications involved. Management is giving LA for the Executives working in the higher scales but not giving regular promotion. The Executives are not getting the benefit of promotion. We demanded regular promotion along with the Pay scales instead of LA promotion.

At the beginning, the possibility of DPC in different cadres explored by the management and discussed various options. On JTO to SDE promotion, initially management was of the impression that once the Ernakulam case is cleared, promotion is possible. Further management assessed the status of promotion in different cadres: i) JTO(Civil/Elect/Arch) to SDE(C/E/Arch) LDCE is held up due to court case on Reservation, ii) SDE(T) to DE(T) and JAO to AO promotion made in June 2018 challenged in the Hon’ble Chandigarh CAT on Reservation issue and the CAT ordered to review the promotions, declaring the promotion as PROVISIONAL, iii) AO to CAO Promotion held up due to court case on Reservation, iv) SDE(C) to EE(C) Promotion held up due to seniority issue among Diploma and Engg Degree holders. On DE (T) and AO promotions in 2018, Management is waiting for the judgement copy and the course of action is to be decided. Different options also discussed. In any case, DPC for DE and CAO is not possible before the review, Management informed that all the promotions are leading to fresh litigations. DoPT is not giving any direction regarding method of implementation of reservation or endorsing the Hon’ble Supreme Court order on reservation. DoPT asked BSNL to wait for the outcome of remaining SLPs pending in the Hon’ble Supreme Court, BSNL management informed us. In such situation, after taking various Supreme Court orders and the court cases going on into consideration, DIR(HR) come to the conclusion that in the near future, it may not be possible to give any promotion due to the reservation issue. Finally management informed us that for JTO to SDE promotion also, BSNL will not be able to decide due to the reservation issue and go for DPC even if Ernakulam judgment is coming.

When all other options closed, now Management started seriously thinking about the implementation of Time Bound functional promotion upto AGM Grade. Management informed us that they will work on it in the coming days and discussions will be held with us if required. Both GSs once again clearly told the Management that if the Management desires to give promotion, Time bound promotion is the only viable option and work for that.

b) Relaxation in Qualifying service for DGM(T) and DGM(F) promotion as the Executives are already working as DGM on LA basis:

Both GSs demanded relaxation of qualifying service of AGM and CAO for promotion to DGM(T/F). They were working on Officiating/LA basis, long time, before regular promotion in 2018 and having sufficient experience as AGM/CAO. Director also found merit in the case and want to address the huge shortage in DGM cadre. Finally it was assured that  the Management will explore the possibility for relaxation of the qualifying service for DGM(T/F) promotion by taking it to the Board.

c) Implementation of merger of Project/Maintenance Regions and TFs:

Both GSs expressed our serious concern for non implementation of the merger orders. The vehicle, staff and infra available with Project wing is underutilised. Limited staff and vehicle with the Regions are overburdened. Management informed that some Man power planning for Project/Mtce Region is going on and merger will be implemented.

On Telecom Factory, the orders are not implemented properly. So they are facing funding and other issues and the infrastructure is not getting utilised. It is assured to examine the matter by discussing with the concerned Officers.

d) Reversion of 2001 Rect JTOs passed the LDCE in 2008:

Both GSs explained the issue to the Director (HR). Management has to accept its own clarification issued at the time of LDCE 2007, then there is no issue remains, we informed  the Management. Management is of the opinion that it require some relaxations but we told them that no relaxation is required other than the one year relaxation extended to the seniors as per the RR. The Committee formed to examine the matter is asked to expedite and come out with the solution within this month.

e) Modification in DGM(T) promotions  as majority of them are worked outside the Circle and come back 3 years back:

Management agreed to consider it once the lock down is over.

Finally, Director (HR) concluded that Management is keen to give regular promotions and assured to go for the promotions in all the cadres at the earliest.

During this very toughest time, AIBSNLEA request all beloved members and employees of BSNL to take all preventive and control  measures as directed by WHO, Central/State Govt. and other Govt. agencies.

 

The preventive and control measures to be adopted in BSNL Kerala Circle for the safety of our workforce are being well discussed with CGMT Kerala by AIBSNLEA time to time. We are glad to record and express gratitude that CGMT Kerala  Shri. C V Vinod is very proactive on all our submissions to take care of the safety of employees first.

Details of discussions held between CMD BSNL and recognized Unions & Associations BSNL:   Recognized Unions & Associations of BSNL were invited for discussions by the BSNL Management today to discuss regarding restructuring plan and Revival of BSNL. CMD BSNL Sh. P.K. Purwar chaired the meeting. Com. S. Sivakumar, GS AIBSNLEA, Com. Bhagwan Singh, AGS(HQ), GS & President of BSNLEU, NFTE, SNEA participated in the meeting. Sh. Arvind Vadnerkar, Director(HR), BSNL Board and Sh. Manish Kumar, GM(Restructuring) were also participated in the meeting.  

CMD BSNL welcomed all the Leaders of BSNL recognized Unions & Associations and explained about the steps taken by BSNL Management for maximization of revenue.

Business Development

SIM Sales: CMD mentioned that there is 5% increase in SIM Sales in the month of Jan., Feb and March-2020. SIM Sales in Feb.2020 is 18.80 lakhs and in March-2020 is 20 lakhs.

Market Share of BSNL is increasing marginally.

In the BB Sector number of disconnection is very significant and CMD further mentioned that we have to arrest the disconnections of BB.

In the EB Sector revenue is increasing 8 to 10%.

Mobile & Broadband overall initially positive.

Landline:  Phase of disconnections are very less.

New Business: FTTH – 6000 OLTs integrated, due to this customer base and constant partner momentum started.    

In the rural area, exchanges having 10 lines, 15 lines and 20 lines is economically unviable. However, Hon’ble MOC assured for subsidy. In the 20,000 Rural telephone exchanges human interface is planned to be changed with the alternate technology.

He further mentioned that upto 10 Kms in the rural area localized mobile system on revenue share basis will be done with Bharat Air Fiber at a speed of more than 60 Mbps speed.

BSNL Revival Plan: CMD mentioned out of 78569 VRS Optees , 78334 VRS applications were accepted and 198 VRS optees has been expired. As on date 76929 VRS Optees have been sanctioned with Provisional Pension. As on date about 75000 cases processed for PPOs and forwarded to CCAs concerned. Out of that, 26370 PPOs were issued till date.

He appreciated the outstanding efforts taken by the BSNL management with the support of the all the Unions & Associations of BSNL for successful implementation of BSNL VRS-2019. He also conveyed the message of Hon’ble MOC that today Hon’ble MOC will appreciate the efforts and support extended by all the Unions & Associations of BSNL for the successful implementation of the BSNL VRS Plan -2019 in the Floor of the House.

Release of Leave encashment and Ex-gratia payments: CMD BSNL assured that Leave encashment payment and Ex-gratia payment will be paid on 31st March, 2020. Already 77585 VRS cases were processed for the above cited payments. Rs. 4850 crore towards Leave encashment after TDS is being processed in LIC.  Finance Ministry agreed to appropriate Rs. 5000 Crore towards the  first installment of Ex-gratia payment, however, we are the short of 1300 crore towards the payment of Ex-gratia. Hence balance amount of Ex-gratia will be paid in the first week of April, 2020.

Launching of 4G : Central Govt. made provision in the Budget FY:2020-21 towards the cost of 4G license including GST but BSNL is not in a position to take the 4G spectrum immediately due to following reasons:

1. We are having outstanding bills to be payable to the vendors M/s ZTE, M/s Nokia and M/s Erricson  to the tune of Rs. 2000 Crores.

2. M/s Nokia installed 13000 equipment’s in the Phase 8.4 has quoted 3.5 lakh for the software/hardware upgradation from 3G to 4G and 7 lakh for green field which is L-1 subject to the conditions that Rs.300 Cr has to be paid before 31.3.2020 and compensation for Foreign Exchange fluctuation whereas M/s ZTE installed  around 24,000 equipment’s has quoted 7 lakh for the software/hardware upgradation from 3G to 4G and 10 lakh  for green field which is L-2 but the conditions put forth by M/s ZTE is unrealistic. In addition to this the rates quoted by L-1 and L-2 alongwith conditions has not been approved by the BSNL Board since consensuses has not been reached.

3. If BSNL is taken 4G License immediately without procurement/upgradation of  equipment’s we have to pay license fee @Rs. 5.5 crore per day i.e. to the booked in the books of Accounts.

4. However, BSNL Management has proposed to float new Tender for the procurements of 4G equipment’s in the next week. It will take another 8 months for roll out of 4G.

Union and Association’s Leaders expressed their serious concern for the immediate launching of 4G in BSNL to attract more customers and increase the revenue.

Monetization of Assets: CMD mentioned that during the FY our Bank loan including O/s bills comes around 40,000 crore. We further required 10000 to 12000 Crore for 4G launching and Rs. 5000 Crore for OFC maintenance. BSNL is paying Rs. 4000 crore towards bank interest and we can saved Rs. 6500 towards employee cost. Roughly we required 50,000 crore for our annual expenditure but our annual revenue is around Rs. 20000 crore. Hence for the deficit BSNL is depending on Sovereign guarantee bond to the tune of Rs. 8500 crore and monetization of vacant assets.  He further mentioned that in the first week of April,2020, BSNL will get a Rs. 8500 crore Sovereign guarantee from Finance Ministry. 14 assets were identified by BSNL for monetization but DIPAM accepts only 11 assets to the commercial value of Rs. 18,200 Crore for which BSNL is expecting transactional advise within a week. Three MNCs come forward for purchase. Discussions has not been taken place due to COVID-19.

Merger of BSNL – MTNL: CMD mentioned that there is a pressure for the merger of BSNL & MTNL to be completed within six months. Union & Associations Leaders requested CMD BSNL to discuss with the recognized Unions & Associations before the implementation of  merger. CMD replied that merger of BSNL & MTNL  comes under the purview of equity structure of DIPAM, Finance Ministry & DoT. However he assured that suggestions of recognized Unions & Associations will be taken care of and forwarded to DoT.

We expressed our serious concern regarding the non maintenance of vast Telecom Network due to non availability of man power and non-implementation of outsourcing tender. CMD explained that out of 1600 clusters EOI have been opened for 1100 cluster and tender have been awarded for 280 clusters and he personally monitoring the same.  We brought to the notice of CMD, the problems faced by field unit executives for attending the faults in the Primary cables due to non-availability of man power in the post VRS scenario.  We further requested Primary cables maintenance has to be outsourced along with the secondary cable mtce. and also requested to relax the tender conditions and powers has to be delegated to CGMs to utilize the existing staff of BSNL who are having rich experience in attending the faults to participate in the tender.

CMD replied that he was aware of the situation and it will be reviewed shortly.  He further mentioned that due to the non-implementation of the tender in all the clusters more funds has been allotted to all the Circles to meet out the monthly mtce. expenditure and so as to maintain the Telecom Network fault free. We expressed our serious concern against the non implementation of outsourcing tender in CSCs. CMD appreciated our concern and assured to look into.  We requested CMD to issue necessary instructions to the CGMs to provide hand sanitizer in all the CSCs due to COVID-19. CMD agreed to issue instructions.

We requested CMD to fix the time line for the monthly salary disbursement since the net salary from Feb., 2020 onwards comes around Rs. 360 crore only. CMD assured that salary disbursement will be streamlined within two months and Feb., 2020 salary will be paid in last week of March-2020.

Due to paucity of time Man, Power/ Restructuring Plan and other important items could not be discussed. CMD BSNL assured that the meeting will be continued either 19.03.2020 or 20.03.2020. Finally CMD told that we are on the right track and we have to expect the outcome and assured that concerns of Unions & Associations will be taken care of. Finally all the Union/Association Leaders thanked CMD BSNL and Director(HR), BSNL Board for the detailed discussions. The meeting lasted for the two hours.

CS writes to CGMT Kerala that  recovery shall not be permitted from the leave encashment of erstwhile –OJTOs :

 

It is disheartened to learn that many BAs are sharpening knife to carve out the proposed huge reduction from the leave encashment of the concerned JTOs. Since leave encashment of DOT time  is Tax Free  , any recovery  from leave encashment is effectively 30% additional loss to the O-JTOs compared to recovery from any other sources of retirement benefits like exgratia payment /gratuity  benefits as these are  taxable up to  @30% scale. …. …..

CS Com.Shaji , CVP Com.Rajan and AFS CHQ Com.Pushparajan had a meeting with CGMT Shri. C V Vinod at 9.45 AM yesterday on 12 -03-2020 as invited by CGMT . All the pending service and HR issues were discussed. The honest and  Inspiring  attitude of CGMT Kerala towards the service/HR issues   discussed is sincerely appreciated by this association .The meeting concluded around 11.15 AM

 

New FTTH customer addition : 

We expressed the pressure at field in achieving FTTH targets assigned. To achieve targets through BSNL staff,  as of now BSNL hasn’t have sufficient man and materials and tempting to attain some count through LCO .  Apparently the chance of swapping BSNL BB customers to LCO FTTH , if at all happening so ,  is not economical to BSNL and it cannot be entertained . We requested CGMT to adopt some regulatory means to avoid swapping of higher plan BB customer    to basic FTTH BB499 plan through LCOs . CGMT shared our concern and assured to issue instructions.

 

Strengthen FTTH sector on BSNL own feet :

During AUAB meeting AIBSNLEA suggested to take measures to strengthen the FTTH sector by giving maximum connection by BSNL itself , especially in the new era of external plant outsourcing wherein our filed staff those engaged with maintenance of LL are free . The staff, not engaged otherwise, may be engaged with the FTTH BB provisioning sector.

 

Relocate more number of the Wi-Fi hotspots both USO/MDO:

We requested to relocate more number of the Wi-Fi hotspots in potential areas to provide more coverage around telephone exchange /Offices/BTS premises and thereby generating revenue at least to meet OPEX of the services so that we can arrest BSNL bleeding from the Wi-Fi services.    <<<Letter submitted to CGMT >>>

 

CGMT appreciate our proposal and assured to examine it as per guidelines given in the letter. He added that  Dir(CFA) , Corporate Office  has requested promotion of @Rs.2 per day unlimited browsing through Paytm in all the wifi hotspot areas  and  the same needs to be done . He added that he wants to see the service improved.

 

Immediate arrangements  to address  the technical  issues with CACU/LAGU  , arrangements to address the frequent failures of CDOT NGN  LAGU control cards having no support from CDOT , Completing ATs of POI/PRI to shut down Legacy switches  ,need for proper mobile tuning  of mobile network to address coverage issues ,  issues with CSCs being managed by DAS in taking part payments/Other Circle’s Bills/SIM Swapping etc   have also been discussed .

 

Heavy recovery from erstwhile O_JTOs on erroneous pay fixation :

The matter is discussed at length and CGMT assured to give all possible supports. As per discussion AIBSNLEA submitted a new letter with all points in brief.

 

We extend our sincere gratitude towards your magnanimity in listening and empathetically considering the grave case of the matter in subject during this association meeting with  you  today on 12-03-2020. As per suggestion, the following points are put up briefly to your kind notice to understand the case in detail and take the righteous decision to stop the erroneous recovery from the O-JTOs . 

1.       As per the order No- AP-II/Exe.pay.Rvn/09/5   dated 16-03-2009 2nd IDA pay-revision of executive cadre implemented . According to this order Officiating JTOS pay fixed similar to Regular JTOS w.e.f  01/01/2007  (Annexure 1) .

2.       After implementation of non executive pay revision order dated 07/05/2010 ,Kerala circle issued an order regarding erroneous  pay fixation of officiating JTOS on 11/10/2012 (Annexure2). Corporate office directed all circle heads on 22-12-2015 regarding pay fixation of OJTOs w. r .t substantive cadre superseding all previous orders ( Annexure 2A)

3.       Due to the issue of this order pay reduction is effected, so affected parties have challenged this order in Honble CAT  Eranakulam vide OA NO 1022/2012. CAT directed in favourable  to officiating JTOS . After that BSNL Kerala filed review petition vide RA 30/2015 , There after filed clarification MA vide  MA NO 1370/2016. This MA Finalised on 05/01/2017. Court directed as pay fixation to be regularised as per  Annexure 2 , but recovery is not insisted (Annexure 3)

4.       This matter is communicated to All BA heads  through letter No HR-III/2-5/JTO(O) pay fixation/2012/part-1/59 dated 12/02/2018. Intimation regarding recovery of overpayment will be given after receiving direction from corporate office.(Annexure 4)

5.        Fr 22 (1) a 1 finalisation order issued by corporate office  on 18/09/2018 (Annexure 5)

6.       On 01/05/2019 order No- 1-06/2016-PAT(BSNL) issued by Corporate Office New DElhi on the basis of Hon’ble Supreme court Judgment regarding Excess /Wrong full payments recovery matter (Annexure  6)

7.        Kerala circle DGM (HR)clarification letter to corporate office regarding recovery matter on 19/08/2019 is attached . In this letter it is  mentioned that as per court direction recovery can be done (Annexure 7)

8.        On the very next day 0n 20/08/2019 DGM legal Kerala sought another clarification for recovery on 20/08/2019

9.       On the basis of above point No:8 ,  corporate office  clarified on 30/08/2019 to implement court direction on recovery issue  .(Annexure 8)

10.   Affected JTOS have requested to CGM Kerala  to examine whether recovery to be done either on the basis of Annexure 6   or recovery to be exempted on the basis of  Annexure 8  (Annexure 9)

11.    Accordingly CGM once again sought clarification from Corporate Office on 28/09/2019 ( Annexure 10 ).

12.   Corporate office clarified on 14/10/2019  that  PAT order dated 01-05-2019  is applicable according to the merit of the case (Annexure 11)

13.   Unfortunately Circle office has not accepted this letter because of their standing argument that OJTOs belong to Group-B.

14.   Another  clarification has been sought from Kerala circle office  to corporate office on 21/12/2019 whether  officiating JTOS are  in group B or group C Category(Annexure 12)

15.   On 09/01/2020 again corporate office reiterated that  O-JTOs  are in group C  Category . (Annexure 13). As such no recovery can be made from OJTOs as per BSNL PAT order dated 01-05-2019(Annexure  6). So far no action has been taken by circle office on this favourable point, despite recovery process has been initiated by many BAs. It is a matter of clear injustice as  neither any  Hon. Court nor  BSNL Corporate Office  directed BSNL Kerala Circle  to start recovery   process .

Immediate Filling up of Vacant CAO posts in all Bas:

We requested CGMT to Immediate Filling up of Vacant CAO posts in all BAs to effortlessly achieve our financial goals and targets .This has not been happened so far even after our multiples of requests to the CGMT and PGMF in every meeting . CGMT stated very categorically that he hasn’t have any restriction in extending any kind of benefits, if rules permit.

 

As per discussion we submitted our proposal on the number of IFA/CAO needed per BA for smooth financial service in Kerala

Heavy recovery  from supernumerary JTOs without extension of proper option facility :

The matter is also discussed at length and we feel we could convince the heavy damage to the group of JTOs .

1.       Officiating started in year 2004 or 2005 . At the time pay fixation was done in JTO scale as per FR 22 1 a 1 fitment . so pay reached in 9850-250- scale . minimum  stage 9850 sanctioned

2.       After one year in 2006 one increment of Rs 250 given and reached in 10,100 stage.

3.       2nd IDA pay revision for executive on 5/03/2009 and non executive for 7/05/2010

4.       Normally the pay revision given to this category of JTOs  on the basis of 2009 order of executive wef 01/01/2007

5.       Their BP  was 23400 in 2007  and one increment is given in 2008,2009 etc up to their  pension period in 2018 0r 2019 etc

6.       In 2011 corporate office issued for option those who are promoted from non executive from executive before  issuing the non executive pay revision order on 07/05/2010. This option is not circulated and they all of them are enjoying the benefit from 2007 to onwards similar to a regular JTO. etc

We requested CGMT to spot the matter empathetically for the benefits of the supernumerary JTOs . CGMT assured to look into the matter positively

 

Inter BA long stay transfer of executives :

We discussed about the matter in detail with CGMT and requested to certainly extend the privilege of immunity against transfer, if any officer deserve as per rules well before issuing transfer orders. However, after releasing transfer orders while almost all officers are getting relieved as they have obeyed BSNL transfer rules,  issuing repeated extension orders / repeated relieving orders /Struck off from ERP / once again extension order for some other officers is nothing but a mockery to all other officers obeyed the orders and got relieved . AIBSNLEA is not against extending any kind of benefits to any officer and on the other hand we cannot support this unhealthy hide and seek game. CGMT shared our views and assured to release inter BA  transfer orders without any glitch from next time onwards.

 

All other pending HR issues were also been discussed for a positive result
