All the 31 JTO candidates are requested to submit an undertaking in the specified Performa released by circle office on 31-12-2016 at the earliest so that training process can be started without any delay. All DS are requested to ensure the same. More over all the DS are further requested to make sure that the representation  to CMD from other JTO candidates, against reserved vacancies of 200 seats, are forwarded to circle office from your SSA , representation from minimum SSAs only received so far to recruitment section of circle office. Already one month time specified by court for the submission of representation to CMD elapsed . On this association request , GM Admin , Kerala circle agreed to wait some more days and all representations would be send in a single bunch .

CS Writes to CGMT Kerala regarding  Transfer of JTO LICE 2014 batch executives working in various SSAs to  Parent SSA and posting of JTOs undergoing Phase-I training at RTTC Trivandrum.

 

  Sub: Request Transfer of JTO LICE 2014 batch executives working in various SSAs to Parent SSA and posting of JTOs undergoing Phase-I training at

Your kind attention is drawn to the request transfers of JTOs belongs to the  JTO LICE 2014 Batch , who had been posted to various SSAs in August 2014. 64 Number of the JTOs out of 134 in the batch were posted out of their parent SSAs to Alappuzha , Pathanamthitta ,Thrissur, Malppuram, Calicut and  Kannur . Remaining  candidates  had been retained in their respective SSAs due to the timely intervention of this association.

 

Now all these JTOs completed 2 years of service in their working SSAs as on 11th August 2016. Individual Transfer request of all these JTOs are available with Circle Office, TVM. Kindly recall the discussion we had on this case during the last meeting with you wherein this association had absolutely requested and hopeful for the implementation of the transfers. Once again, I request your good self  to look-into the matter empathetically so that these request transfers to parent SSAs are ordered without any delay and without any differentiation among the group. 

 

During 2014, most of the JTO candidates were posted for field training in some SSAs and regular postings were given to several other SSAs. By and large this was noticed as an unfair practice.  Hence, this time the JTO Candidates, who are currently undergoing phase-I training at RTTC Trivandrum, may be posted in single SSA for both field training and subsequent regular posting. Moreover, they may be preferably posted to parent SSAs or nearby SSAs.

At the Outset, AIBSNLEA Wishes all the members of the Executive Fraternity of BSNL, a very happy and prosperous New Year 2017. We wish you all the success in the year 2017 and sincerely hope that at least now BSNL management will rise up to the occasion and settle the long pending HR issues.

 

This is another matter that Director (HR) and Her Team has started the year with another series of vindictive actions against the leadership of the constituent partner of United Forum i.e. AIGETOA by issuing show cause notices under Section 5(27) and Rule 22 to Finance Secretary AIGETOA and Joint Secretary (North), AIGETOA for pursuing the matter of Ex-General Secretary AIGETOA - Shri R P Shahu with a charge that they have undesirably met Director (HR) on 25.11.2016 and sought the status report in respect of disposal of disciplinary cases against Shri R P Shahu.

 

It is pertinent to mention that as General Secretaries of AIBSNLEA and AIGETOA were away on tour, Joint Secretary and Finance Secretary AIGETOA met Director (HR) on Friday, the 25th November 2016, Evening  after taking due permission from her through her PS to discuss the status on the assurance issued by SR cell vide letter no. BSNL/7-9/SR/2016 dated 23rd November 2016 wherein it was stated that the decision on the same shall be taken within a week. The Joint Secretary and Finance Secretary were asked to Meet Director (HR) by the General Secretaries as per directions of CMD BSNL in the meeting on 23rd November 2016 to discuss the matter after 2-3 days.  Based on the assurance, the joint agitation program was withdrawn.

 

Now, the Management is showing its true colors and are trying to come up with vindictive and Coercive actions.They are trying to impose upon a virtual GAG order on United Forum with active support from the antagonists of United Forum.

 

So Comrades! Time has come to respond to such arm twisting techniques by Director (HR) and her Team. Unless we Strike hard... our issues are not going to see the light of the day…We Again repeat what we posted some days back:

 

"Its Now or NeverIts Today or No dayIts at this point of time or no time….Its time to show our unity…Its time to show that we care.. Its time to show that We exist…Its time to show that We are there.. there for our rights…"

 

We know that Management is after us like anything... We know that Management will not resolve the things so easily…We know that We have been marked at Point blank....but we will not relent…. …We are not worried because We know that it is our fight…It is our resolve... It is our destiny….We will achieve it.. Let Management come and Finish us….Let Management come and Hit us… Let Management come forward with their agenda… We will reply with our struggle…

Dear Comrades

United Forum of Executive Associations consisting of AIBSNLEA, AIGETOA and AITEEA thanks one and all for coming forward and supporting the movement against killing of democracy and resolution of the long pending HR issues pertaining to BSNL executives.

Friends, contrary to the congratulatory messages floated on the website of the sister association, the situation is different in reality. The burning issue of extending Standard Pay Scales of E-2 and E-3 in place of non-standard E1A and E2A is slowly dying a death at DoT with hand in gloves approach of Management and the sister association. DoT has not moved an inch from its earlier stand of sending  the proposal to the Cabinet of approving E1A and E2A. The only way it was possible was through merger of Sr. SDE and SDE scales. That was not allowed by the so called warrior association for reasons of heart burn. DoT is not in mood to replace even the initial two scales and if we don?t fight it out now, the issue will be killed forever.  Without struggle, this issue is not going to see the light of the day. So, if we really want the issues to be resolved, we have to come forward and show our might.

The crocodile tears of the Association singing Majority - Majority tune is now visible to one and all. They have claimed that the committee was formed at their insistence. While the same association was some days back claiming that 22820 cannot be given without achieving E2. United Forum of AIBSNLEA, AIGETOA and AITEEA worked tirelessly for this issue and when there was some development, the claimants came forward and claimed it as their achievement and SR cell also came forward and issued minutes for the testimony of the falsified achievement. This shows that the friendly association instead of becoming representative association of executives, have become the spokes persons of Management Side.

All the write-ups on their website are showing that they have achieved moon but the fact remains that nothing is being done and whatever initiation is being done because of sincere efforts of the United Forum, the management and their representative association leaves no stone unturned for derailing that. .

Resolution of Rule-8 cases is another glaring example where these so called majority-majority singers have been trying to block the efforts taken by United Forum at CO and Circle level. All they are interested is to retain these executives in their current circle so that their Leadership keep on enjoying the fruits on the heads of the innocent executives waiting to go to their parent circle. Similar is the case of DPC and LDCE, where they have been instrumental in blocking the issuance of orders just to keep executives running for their long awaited promotion.

So Comrades, struggle is the only option and the only solution.   WE HAVE TO COME FORWARD AND RISE TO CALL OF THE TIME.

SO MAKE EXTENSIVE PREPARATIONS FOR SUCCESS OF THE PROTEST ACTION PROGRAM AND MAKE IT SUCCESSFUL ALL OVER THE COUNTRY. IT?S A DO OR DIE SITUATION FOR ALL OF US AND THERE IS NO ROOM FOR COMPLACENCY.

We would like to invite kind attention and early action on completion of formalities including training and subsequent appointment as JTOs from the merit list dated 9/12/2016.

 

          In Kerala circle 2007 batch, DR TTAs joined in different periods for Induction training due to administrative reasons and limited capacity of RTTC Trivandrum. A batch consisting of 30 members from Trivandrum, Pathanamthitta, and Calicut SSAs could only join before 1st July 2008 and all the remaining batches after this date. This created a clear anomalous situation like equally or highly performed TTAs in direct recruitment competitive examination or in induction training became ineligible and the same time one batch who could join before 1 July 2008 due to their luck became eligible in LICE held on 22/05/2016 for vacancy year 2013-14.

 

After representing to BSNL Management in time , as a final option some of these TTAs approached Hon Tribunals. On the basis of interim order by Hon CAT Hyderabad Bench in a similar case BSNL Corporate Office extended provisional candidature to all 2007 batch irrespective of their date of joining thereafter declared results all other circles except Kerala & AP. Hon Tribunal convinced and directed BSNL to provide result in a separate sealed cover.

 

Later  on advance stage of recruitment BSNL corporate has withdrawn this eligibility without showing any reason. We came to know that most of these applicants were passed this LICE which was held on 22/05/2016 while results were opened before Hon Tribunal. On 29/11/2016 Hon Tribunal Ernakulam pleased to dispose all OAs filed to stake a claim of eligibility for vacancy year 2013-14  by allowing all applicants to submit a comprehensive application and directed  BSNL to dispose it before 2 months of submission if it is filed within one month time from the date of order.

 

In the meantime BSNL conducted second LICE on 24/09/2016 for vacancy year 2014-15 and merit list also published. 181 candidates qualified in this LICE and 215 UR vacancies are available. But unfortunately circle office published results of  only 8 OC and 23 SC candidates on 09/12/2016. Out of this 215 UR vacancies 207 UR vacancies reserved for the applicants those who filed OAs without even a court direction. Those who qualified in both examination  were not included in result. If they submit comprehensive applications to the authority on the basis of Hon Tribunal order dated 29/11/2016 and even if it is disposed in either direction i.e.  eligible for vacancy year 2013-14 or 2014-15 these candidates are qualified. Some candidates included in result are also applicants of these OAs. There is no dispute over eligibility in vacancy year 2014-15 and Hon Court allowed 2 months period to dispose representation meanwhile JTO Ph1 induction training is 10 weeks. So it is able to dispose representation before posting.

 

Moreover BSNL declared results of SC candidates. These SC vacancies were carry forward from 2013-14. It is not possible to fix their quota now. If they are posted in 2014-15 vacancies, definitely most of them will be in UR quota and the candidates in this list are applicants of these OAs. So we humbly request your good self  to send all candidates who passed both examination for 2 vacancy years or Second examination for training  provisionally along with these 31 candidates whose results published during the pendency of OAs.

 

For this reason, once again we request your   kind office for an early action on completion of formalities including training and subsequent appointment as JTOs from the merit list dated 9/12/2016.

CS AIBSNLEA , CS AIGETOA Com.Saheer and CEC Member Com.Binu met DGM(HR) and other officers at various levels of circle office and discussed the following issues on 20-12-2016.

1.    Request transfer of JTOs completed 2 years: 2014 posted JTOs on LDCE :

 

This matter has  already been discussed in detail with CGMT and GM(A) and we could convince the management the need and legitimacy in bringing these JTOs  back to parent SSAs since they have  completed two years tenure in the working SSAs , as we have reported several times . From management we have assurance that the transfer orders of these candidates would be released before general transfer in March/April 2017. Moreover It’s also assured that all the genuine medical requests would be considered without delay . We requested DGM(HR) Shri.James Sagayaraj  , he was there in both meetings with CGMT/GM(A/HR) , to start the transfer process . Today he informed that the transfer process of these comrades are started and we expect release of the orders as assured

2.    Posting of JTOs candidates for field training and regular posting.

On this  matter of posting  JTOs   who are undergoing training at RTTC Trivandrum  in parent SSAs/Choice SSAs for field training and resultant regular posting , We requested to call option from these candidates for choice SSAs . He replied that TVM, EKM like SSAs are not having proportionate vacancies and fresh posting may not be considered for these SSAs. In other SSAs choice posting will be given according to vacancy availability. We requested to consider request posting of candidates belong high range areas of Ernakulam.

The matter will be discussed with the appropriate levels of management in next month also.

3.    Training and posting as JTO - 2007 batch DR TTAs , upon the Hon CAT Ernakulam orders in OA 299/2016, OA 310/2016, OA 330, OA 336/2016, OA 337/2016.

 

Based on the request latter from circle coordinator SNATTA to CS AIBSNLEA , Kerala , the matter is taken up for discussion and speedy implementation  of the hon. CAT order at circle / corporate office levels. The first round of discussions to management at circle levels have been carried out along with coordinators of the batch.

 

 The 2007 batch of DR TTAs joined different periods for Induction training due to administrative reasons . A batch consisting of 30 members from Trivandrum, Pathanamthitta, and Calicut SSAs could only could join before 1st July 2008 and all the remaining batches were started after this date. This created a clear anomalous situation for the remaining TTAs batches of trainees in year 2007 .Due to this reason they could not became eligible for LICE held on 22/05/2016 for vacancy year 2013-14. These candidates , hence , approached CAT for legitimacy and based on CAT direction , BSNL Corporate Office extended provisional candidature to all 2007 batch irrespective of their date of joining thereafter declared results all other circles except Kerala & AP….Now CAT released final verdict that BSNL has to post these candidates as JTOs .

 

As per the court verdict all the candidates belongs to this batch have to submit  comprehensive representation before the CMD BSNL  to consider their appointment as JTOs for the vacancies . The comprehensive representation in proper format, being prepared by coordinators of the batch and It will be ready on 21/12/2016 . Circle coordinators will select SSA coordinators to ensure all the JTO candidates in this group are represented to CMD BSNL through proper channel. As and when the representations reaches to circle office from all SSAs , it will be forwarded to CMD . The matter is discussed with GS AIBSNLEA and he agreed to take up the matter at appropriate levels for the speedy release of orders.

 

Recruitment cell of Kerala circle informed today that the file with CAT order is forwarded to legal wing . Dear comrades further details will be informed subsequently.

Dear comrades, 

Membership verification of Executive Association is over but against the killing of the democracy by BSNL Management wherein AIBSNLEA even after winning of 17 circles with majority votes has been declared as support association is not accepted.  Against this our struggle will continue in BSNL.  Already united Forum of BSNL executives Associations comprising AIBSNLEA, AIGETOA and  AITEEA  has served a notice for organisational action programme commencing w.e.f  20th December 2016 against the non settlement of pending HR issues pertaining to pay, promotion and pension of the executives.  AIBSNLEA has secured 18377 votes during membership verification and has emerged as the second largest executive association. Hence it is the duty and responsibility of AIBSNLEA to protect the interest of these large numbers of executives.  In the name of recognised association we can't allow one association to play with the carrier of thousands of our members.  We have equal rights to protect the interest of our members and management cannot ignore our strength.  Hence, we are determined and committed to get resolved all important HR issues pertaining to pay, promotion and pension  of the executives. Let us be united under the umbrella of United Forum of BSNL executives Association comprising AIBSNLEA, AIGETOA and AITEEA to struggle and get settled the legitimate demands.   Unity is strength.  Some vested interests will always  try to break our unity but with our strong commitment and conviction of unity give them befitting reply by not allowing to weaken our unity.

United Forum of Executives Association Comprising AIBSNLEA, AIGETOA & AITEEA serves upon Notice upon Shri Anupam Shrivastava, CMD, BSNL for organizational actions against the delay in settlement of Burning HR issues and non-extension of Majority status to AIBSNLEA in the circles & SSAs where AIBSNLEA has secured majority with following charter of demand:

1. Recognition to AIBSNLEA as 2nd majority association at all India level with facilities at par with first majority association and as a 1st majority association in all those Circles/SSAs where it has secured majority.

2. Extension of 22,820 as initial basic to the executive’s recruited post 01.01.2007.

3. Replacement of intermediate Pay Scales E1A, E2A by Standard Pay Scales of E2-E3 for JTO and SDE equivalent executives.

4. Extension of 30% Superannuation Benefit to the BSNL recruited employees

5. Implementation of CPSU Hierarchy in line with the recommendations of the Khan Committee.

6. Issuance of Posting Orders for LDCE-2015 qualified candidates and notification of SDE RRs.

7. Immediate conduction of various CPCs in all the disciplines to fill up the vacant group-A and Group B equivalent posts in a time bound manner

8. 1st Time bound upgradation in four years

9. Resolution of pending Rule-8 cases and clearance of waiting list from the JTOs qualified through LICE.

10. Scrapping of MT RRs/DGM RRs,

11. Notional Pay fixation of all upgraded pay scales w.e.f. 01.10.2000 of JTO/SDE (C/E/Arch/TF) Engg. Wings and PA cadre.

12. Extension of one increment to LDCE-2012 passed candidates

13. Diversion of 50 Percent MT quota CAO Posts to the seniority quota.

14. Extension of E1+5 increments to JTO SRD, JAO 2010, 2013 and 2015 batches.

15. Removal of Pay anomaly of JTOs Promoted from TTAs of outside quota.

Protest action Program:

1. 20th  December 2016: Massive Demonstration at SSA/circle/BSNL CO during Lunch / Closing Hrs.

2. 27th and 28th December 2016: 2 Days Dharna at SSA/Circle and BSNL CO level.

3. Work According to Rules and Complete Non-Cooperation with effect from 27th December 2016.

4. “Dilli Chalow.e.f. 10th January 2017 for Indefinite Dharna at BSNL Corporate Office New Delhi till resolution of the issues.

            Your kind attention is drawn to the Corporate Office letter cited under reference conveying approval for the issue of Diary and Calendar 2017 to the executives . Therefore it is requested on the matter to cause necessary steps to arrange supply of diary and Calendar 2017 to all executives of Kerala circle positively in the last week of December-2016 itself. We are happy to   submit that our association has already prepared diary -2017 @ Rs.150 and ready to supply according to orders.

Dear Comrades! Unions & Associations of BSNL have decided to go for One Day Strike on 15.12.2016 against the formation of Subsidiary Tower Company. All the District Secretaries are requested to kindly coordinate with all the Sister Unions and Associations and make the Strike 100% Success.

AIBSNLEA has brought BSNL EXECUTIVE DIARY-2017 which is containing updated information on service matters mostly concerning the BSNL employees and also important information on Telecom Engineering, Financial matters and Tariff Plan of BSNL services for marketing purpose. The important features of the Diary which was brought out last year by the Association are having place in this diary. The Executive Diary with improved quality and features is having full page for each day.

 

The diary is ready for dispatch. The price has been fixed at a competitive rate of Rs. 150/- (Rs. One Hundred fifty only) per copy including postage / freight charges only.

 

Bulk orders in advance (Not less than for 20 Executive Diaries) are requested so that early dispatch of the consignment may be ensured. While placing the orders kindly intimate the name of the consignee officer along with his name, mailing address, PINCODE of the City and the Mobile Number for timely receipt of the material.

On the subject cited above your kind attention is drawn towards this Association letter of even number dated 04.11.2016 (Copy enclosed for ready reference) written to Shri A. M. Gupta, GM (SR) for making suitable amendments in the Ballot Paper proposed to be used for the 1st Membership Verification of the Executive Associations wherein we have mentioned that our apprehensions that some executives inadvertently may affix the casting stamp in the blank cell of the header row of the Ballot paper. And to avoid unnecessary loss of such voting to AIBSNLEA we have suggested to fill the blank cell by some wordings.

 

Today, when the polling started, we came to notice that no cognizance is being given to our suggestion thereby there are chances that some executives inadvertently may affix the casting stamp in the blank cell of the header row of the Ballot paper. In such cases, we request your kind honour to kindly issue instruction to count these votes in the favour of AIBSNLEA.
