08-01-2018 Unanimous decisions
taken in today’s meeting of “The All Unions and
Associations of BSNL” to intensify the struggles for achieving wage revision
and for the ‘rolling back of the creation of Subsidiary Tower Company’. “The All Unions and
Associations of BSNL”, held it’s meeting at New
Delhi today to discuss about the steps to be taken for intensifying the
struggles for the settlement of 3rd Pay Revision and to
ensure the ‘rolling back of the creation of Subsidiary Tower Company’. The
meeting was attended by the General Secretaries / Representatives of BSNLEU,
NFTE, SNEA, AIBSNLEA, FNTO, BTEU, SEWA BSNL, AIGETOA, BSNL MS, TEPU, BSNL ATM
and TOA BSNL. The meeting was presided over by Com. K. Jayaprakash,
GS, FNTO. The following decisions are
taken unanimously for intensifying the struggles to achieve the
demands. Struggle programme: (1) Whole
day satyagraha for 5 days from 30.01.2018. The starting of the satyagraha will be marked by the paying of ‘shradhanjali’ at Gandhi Samadi
at New Delhi on 30.01.2018, by the leaders of the “The All Unions and
Associations of BSNL”. (2) ‘Indefinite

entrusted to Com. G.L. Jogi, Leader, SNEA, and to
Com. Prahlad Rai, GS,
AIBSNLEA, with the responsibility of exploring possibilities to take legal
action to roll back the creation of Subsidiary Tower Company. (6) A Steering
Committee consisting of the General Secretaries of BSNLEU, NFTE, SNEA and
AIBSNLEA is formed to monitor the struggles. (7) Meeting the
leaders of political parties and Central Trade Unions, by 30.01.2018, to
mobilise support in favour of the demands of “The All Unions and Associations

Shrivastava, CMD, BSNL regarding concerns after
squishing of the free night calling hours by BSNL. Superannuation Pension Scheme for
DR employees of BSNL BSNL increases the existing rate
of Employer's Contribution towards Superannuation Pension
Scheme in respect of DR employees of BSNL from 3% to 5% of Basic Pay Plus DA
per Month w.e.f. 01.04.2017. |

Tower Subsidiary
Formation: Countrywide Protest Demonstration on 08.01.2018 Government is going
ahead with the formation of Tower subsidiary formation irrespective of the
strong opposition from the employees. It was told that it will be subsidiary
of BSNL but Government has now appointed a Chairman Cum Managing Director for
the new Tower Subsidiary company, making its intentions clear, day by day. To protest it, as an
immediate response, all Unions and Associations have decided to hold
demonstration throughout the country on 08.01.2018. All the District
Secretaries are requested to ensure 100% participation in these
demonstrations and make it a grand success. Further course of
action will be decided in the meeting of all the Unions and Assns scheduled
for 08.01.2018. |

CGMT Meeting with recognised unions/association ( AIBSNLEA , SNEA
, SEWA, BSNLEU and NFTE ) on developmental issues and various ways and means
for further revenue generation has been carried out today at 2.30 PM at the conference
hall of circle office.

Shri.Robbin Poddar
welcomed all the senior officers and association/union leaders . CGMT , Dr.PT Mathew , addressed the meeting with facts and
figures of the performance of Kerala Circle in all verticals for the last
three quarters through power point presentation . It was very heartburn to
see that the dip in revenue of Kerala Circle for the 3 quarters is @ 17% ( -16.9%) . The fault clearance rate of Kerala Circle is also recorded very low compared to the other southern
circles. After detailing the performance of circle , CGMT expressed the uneasiness in
achieving the revenue target of Kerala
Circle when only one more quarter left behind . CGMT directed PGM(F) Shri.KK Vel to appraise the financial condition of Kerala Circle
to the meeting.
PGM(F) well narrated the financial crunch Kerala
circle is struggling through . He portrayed the difficulty he encounters to
find funds to provide at least the salary of employees. The illustration of the real financial picture of our circle turn
the meeting tensed and anxious. Thereafter CGMT invited association/unions to
speak on the means for further revenue generation. Firstly AIBSNLEA shared
our views . Then SNEA ,
NFTE , SEWA and BSNLEU also shared their views . CGMT listened to all the
views and interacted in a very motivating way.
All the associations/Unions extended unsolicited
support to CGMT Kerala Dr.PT Mathew for all his
endeavour for developmental activities and various ways and means for further
revenue generation of Kerala Circle.
In addition to CGMT , PGM(F) and
GM(A) , Sr.GM(S&M)/NWO-CFA Shri. I Thirunavakkarasu , GM(EB)S&M-CM
DR.Jyothi Sankar S ,
GM(NWP-CFA),BP&IT Shri. Sukumaran N K , Joint GM (Admn) Shri.Satheesh R were also present. The meeting started at
2.30 PM and concluded around 5.30 PM. CS , CVP and
DS-TVM represented AIBSNLEA .

DOT
appointed Shri Amit Yadav (IAS) ,Joint Secretary
(Admin), DOT as CMD of tower subsidiary company of BSNL. DOT
vide its letter no.79-51/2017 -SU dated 21.12.2017, has appointed Shri Amit Yadav
(IAS) ,Joint Secretary (Admin), DOT as CMD of tower subsidiary company of
BSNL. It seems that the Government is moving fast
to operate tower subsidiary. It is surprising that as per Union Cabinet
decision the tower subsidiary will be fully owned by BSNL ,
but after seeing the DOT order it is difficult to understand that whether
tower subsidiary will be controlled directly by DOT or through BSNL. We
strongly oppose such active move of Government to fragment BSNL assets. |

BSNL Corporate Office , New Delhi issued order
regarding Medical reimbursement with voucher for outdoor treatment - revised
annual ceiling to be calculated on revised basic pay @ 78.2% fixation for up
to 23 days w.e.f. 01.04.2018 in respect of
Executives and Non-Executives of BSNL.

Currently it is calculated for 25 days @ 68.8 % Fixation
on the DA on April of every Year. New method of calculation is detrimental to
employees to the tune of thousands.

1999 JAO Comrades The
Long lasted fighting of AIBSNLEA ended very favourably.... We
extended Sincere thanks to GS AIBSNLEA Com.Prahlad Rai ,
CGMT Kerala Dr.PT Mathews , PGM-F Shri. KK Vel ,
GM(A/HR) Shri.Robin Poddar
on settling out the long pending case very legitimately . Details of the same can be seen from the
trailing letter ( One of the series of Letters) written by There are 36 very unlucky JAOs of 1999 batch working in Kerala Circle.
In accordance with the provisions detailed vide Para 1(1)(d)(7) of BSNL orders dated 18.01.2007, they
have been promoted to the E2 scale (Rs 11875-300-17275) equivalent to AAO
with effect from 01.04.2004. When several circles granted the above promotion
and Kerala Circle was not issuing orders for the promotion, they
have approached the Hon’ble CAT Ernakulam and the CAT was pleased to order promotions to
Kerala JAO 1999 also as given in the other circles. Accordingly we
were promoted to E 2 scale with effect from 01/04/2004 as per the above
Para 1(1)(d)(7) of EPP (Ref (4)). Now kindly refer CO BSNL letter under reference (1) on the subject
cited above, wherein it has been decided by the competent authority that the
promotion to the cadre of AAO/Sr. AO allowed by DOT/BSNL during the period
1.10.2000 to 30.9.2004 may be treated as post based promotion in EPP, only
for the purpose of counting as a residency period for First Time Bound
Up-gradation as per clause [3][3.1] under the heading 'First Up-gradation in
EPP. It is submitted that, promotion given to them to the grade of AAO from
1.4.2004 which was earlier treated as time bound promotion, may be treated as
a post based promotion with reference to the CO BSNL letter No. 400-172/2015 Pers I dated 02.9.2015 (Ref 1) and the clarification
issued vide Ref(2)and (3). Many other circles like Corporate Office,
Maharashtra Circle, Karnataka, Andra Pradesh,
Madhya Pradesh, Gujarat, Chennai etc (copies of orders attached) have issued
promotion orders to JAO 1999 batch based on the letter dated 02/09/2015 and
clarification dated 14/01/2016. In Kerala Circle we
are denying the preponement of time bound upgradation as was given in the other circles on some
flimsy grounds. Actually, our circle union is pursuing the case vigorously
for a pretty long time but the circle finance
administration seems to be adamant in not giving the legitimate promotion to
the comrades. When it is clearly said that the promotions given
under Para 1(1)(d)(7) of BSNL orders dated 18.01.2007 to the
accounts personnel, why Kerala JAOs of 1999 promoted under the same para during the same period is denying the preponement? Even after receiving the order and two more
clarifications on it, kerala Circle administration
again seeking clarification from Corporate office vide GM HR
No.HR-II/6-6/TB/TB-VIII/2015-16/26 dated 25/05/2017 which is something to lag
the case some more time . It is learnt that no reply to this
letter has been received so far. Many of the affected comrades in Kerala have retired without getting the
expected benefit. Hence we request your good office to kindly take up the
matter to appropriate level in corporate office to release further clarity if
at all needed as demanded by Kerala Circle to benefit the affected comrades
as already benefitted by the group of comrades in other circles, at the
earliest. |

New Delhi allows OA filed by AIBSNLEA against the DoT order dated 05.07.2017
for withdrawal of additional increment in the same scale on functional
promotion under EPP: Today on dated
21.12.2017, the case was listed and heard in the Hon'ble PB CAT New Delhi Court No. 4. After
hearing all the related parties at length Hon'ble
PB CAT allowed the OA. Details are awaited. |

in acting quickly to distribute long pending and very much starving stipend
to the trainees within a day time. |

the information about non distribution of stipend so far to the DR JTO
trainees at RTTC Jaipur , CS Kerala requested CS
Rajasthan to act on the pending issue . Yesterday CS Rajasthan Com.Morodia met GM(A) Rajasthan
Circle and GM assured to look into the matter and do the needful so that this
week itself the stipend will be distributed. |

18-12-2017 Preparation for
e-DPC -Requirement of APARs of all AGM/DES working on regular basis: The Screening
Committee report and APARs of all AGM/DE(T) working
on regular basis is not yet received from all of the circles. All the Circle /
District Secretaries are requested to ensure
immediate dispatch of these pending APARs at the earliest so that the long
awaited DPC in view of the recently pronounced judgment by Hon'ble Supreme Court in the matter of Rule 206
implementation. |

congratulated the BSNL employees for making two Day strike a complete
success. The meeting also criticized and
condemned the negligent attitude of DOT administration and BSNL Management
towards BSNL employees strike and their legitimate demands. Further decided to hold meeting on 08-01-2018 at 15.00 hrs in
FNTO office T-16, Atul Grove Road New Delhi to
decide the future course of actions for launching hard Trade union actions in
terms of Parliament March/ Sanchar Bhawan including
indefinite strike. . |

The Long Pending
increment Preponement of 1999 JAO batch officers:
We expressed discontent in non-settling of the issue so far.
PGM informed that the matter is recommended and forwarded to CGMT on the
prolonged request of AIBSNLEA . We extended sincere
thanks in initiating
the very long pending issue , which has been settled by all
other circles very long ago, for favourable settlement . Later CS & CP requested CGMT Kerala
also to settle the long pending issue favourably as done in other
circles . CGMT Kerala was very
positive and assured to settle down the matter. We expect favourable orders
shortly.
Training of 6 JAOs
As we have informed on 23-11-2017 ,
the training schedule is released . We extended profound thanks on scheduling
Phase-I training of these candidates as assured to this association
Result declaration
of 5 JAO candidates
We expressed
dissatisfaction on non-declaration of results for 5 vacancies arose against the JAO VY
2015-16 . PGM informed that as per corporate office latest letter only one
vacancy can be considered as the clear vacancy due to the declining of one
JAO candidate and the other 4
vacancies were generated
due to the option of
Phase-I completed JAOs to JTOs .
As per latest SEA section order No.4-22/2013-SEA dated 01-12-2017 the vacancies can be counted against the
candidates who have qualified the exam successfully but declined to join the
post of JAOs. But we argued that the same letter provisioned an opportunity
for the remaining 4 vacancies also by the wording “ and there are still some vacancies
left out “ . Later we met DGM(HR) and AGM(HR/Recr) Shri. Mahesh to
reconsider the matter . They informed that as per
latest SEA section letter,
circle office will declare result of one vacancy and our
request will also be considered after the result declaration for one vacancy.
Harassment to JAOs effectively maintaining
CSCs by SDE(T) as controlling officers
We requested to initiate righteous actions to stop harassment
by SDE to JAO subordinate. We quoted an example of the same with Kottakkal CSC in Malappuram BA . We further
requested to protect the morale and efficiency of the young JAOs from the
intimidation of SDE controlling officer without delay for the sake of healthy
office performance .
Moreover we
requested either accord the administrative control of the JAO
to an AO or shift the JAO from CSC to a JTO. PGM listened
all our wordings and assured to take up the matter at concerned levels for a
positive outcome.
Filling of AO/CAO
vacancies
We expressed our displeasure on non filling of the vacancies
all along Kerala . The LA arrangements are being
given to the eligible candidates without any financial engagements to BSNL . Thus, it is a way of motivating the executives.
Negating LA provisioning against existing vacancies cannot be appreciated . PGM
shared our concern and suggested the same is his opinion . He assured to look into the matter .
Transfer request of
JAO/AOs to parent BA
We requested to consider the request transfers to parent BA
especially for those who are retiring within two years .
He appreciated our concern and replied that he can’t violate the presidency
followed in Kerala circle of completing two years for transfer to parent BA . He further mentioned in Palakkad
BA , so many young
JAOs leaving BSNL to other departments created acute shortage of accounts wing.
