Forum of BSNL Executives Associations (AIBSNLEA, AIGETOA and SNEA) served Notice for Trade Union Actions:

 

DEMANDS

 

1. All eligible BSNL Executives as on date should be promoted immediately without any further delay. The Time Bound Functional Promotion Policy up to AGM equivalent Grade as per the policy approved by BSNL Board on 28.05.2018, namely, “BSNL Executives Promotion Policy Amendment and Recruitment Rules, 2017” effective from 01.07.2018 should be implemented immediately and directions of the Board should be followed by incorporating Govt of India and DoP&T guidelines on Reservation and protecting the Constitutional Rights. The promotions should be extended w.e.f. 01.07.2018 onwards as and when the Executives fulfill their eligibility criteria.

 

2. The Restructuring order dated 17.11.2021, 23.11.2021 and subsequent orders should immediately be rolled back and immediate discussion should start with the stake holders for a HR plan which should be in line with the needs of the organization and takes care of career prospects of Executives in various grades and streams. The drastic reduction in number of Posts should immediately be done away with and inputs of Associations should be given firm consideration.

 

The stagnation criteria of 12 years in JTO/JAO Equivalent cadre for promotion to SDE/Equivalent cadre should be rolled back and revisited to make it in line with the earlier approved Time Bound Promotion Policy. Similarly, the stagnation criteria of 8 years should be introduced in SDE/AO/Equivalent Grade as Criteria for promotion to AGM/CAO/Equivalent Grades. 

 

3. Take necessary steps to approve the standard pay scales of E2 and E3 by DoT, replacing the intermediary pay scales of E1A and E2A w.e.f. 01.01.2007 as recommended by BSNL Board for JTO/JAO and SDE/AO Equivalent Grades.

 

4. Management Trainee Recruitment and DR DGM Recruitment should be scrapped altogether and no lateral recruitment should be done in the organization at any level above JTO/JAO/Equivalent. Internal Fast-Track Promotion Policy should be introduced for the meritorious and talented Executives of the organization.

 

5. All Adhoc DGM (T/F) should be made regular DGM (T/F). Thereafter, all DGM(T/F) posts should be filled up on regular basis by onetime relaxation in qualifying service.

 

6. Suitable relaxation in the qualifying service to be extended for Time Bound Promotion to CAO Grade since eligible Executives are not available.

 

7. No Looking After/Adhoc/Entrustment Promotions, only Regular promotions should be provided to BSNL Executives. 

 

8. Immediate final settlement of long awaited SDE Reversal case as one time measure as agreed and directed by the Director HR on various occasions.

Details of  discussion held between the AUAB and the DoT, on 24.11.2021.

A Meeting held between the AUAB Leaders and the Shri Sanjay Gupta, DDG(PM), DoT  who is looking after the duties of Joint Secretary(Admin) on 24.11.2021 at 1600 hrs. at Sanchar Bhawan. Smt.Anita Johri, Sr.GM(SR), Director(SU), DoT also present in the Meeting. Com. S.Sivakumar, GS AIBSNLEA along with the General Secretaries/Representatives of 12 Unions/Associations of AUAB participated in the meeting. At the outset, the AUAB bitterly complained that, the assurances given by Shri Manoj Sinha ji, the then Minister of State for Communications and Ms. Aruna Sundararajan,  the then Secretary, Telecom, in the meetings held in December, 2018, regarding 3rd Pay Revision, Payment of Pension Contribution by BSNL, based on actual basic pay (As per FR.116) and delinking of Pension revision from Pay revision, were not implemented by the DoT. Hence, the AUAB insisted that minutes / record of discussion should be issued for this meeting and the decisions taken, should be implemented by the DoT.

Responding to the observations made by the AUAB, the DDG(PM) stated that, hereafter regular interactions would take place between the DoT and the AUAB a at least in every quarter. Thereafter, point to point discussion took place to the Agenda items submitted by the AUAB.

 

Launching of 4G by BSNL:

The issue of up gradation of BSNL’s BTSs, for providing 4G Service, was taken to the ETG (Empowered Technology Group) and the PMO. However, it was not approved. The PMO has insisted that the “Core” of BSNL’s 4G equipments must be Indian made.

The TCS is in the process of supplying 4G equipments to BSNL. The CEO of TCS has assured to complete the POC (Proof of Concept) by 31st December, 2021. The POs (Purchase orders) will be placed by March / April, 2022. The commercial launching of 4G service by BSNL will take place in August / September, 2022.

 

The CAPEX (Capital Expenditure) for BSNL’s 4G launching comes to Rs.14,000 crore and MTNL’s CAPEX for 4G launching comes to Rs.1,000 crore. This Rs.15,000 crore will be borne by the Government. Cabinet note will be sent shortly to get the approval of the Cabinet for this.

Govt. has agreed in principle  about Rs.1.60 lakh Crore Budgetary support to BSNL on immediate basis in order to overcome financial constraints in a bid to promote domestic technology in line with Atmanirbhar Bharat (Self-reliant India).

 

Payment of Outstanding dues (Claims Payable) to BSNL by the DoT amounting Rs.39,000 Crore:

 The DDG(PM) replied that,

 

(a)   Interest on refund of WIMAX and CDMA Spectrum, as being claimed by BSNL, may not be paid. Comparatively, the Government is going to provide a bigger amount for BSNL’s 4G launching and revival.

(b)   Refund of Leave Encashment to the tune of  Rs.11998 Cr is being dealt by DDG(Accounts). The issue is to be taken with them.

(c)   The issue of paying compensation to BSNL, on account of Rural Telephony to the tune of Rs.13789 Cr is being dealt with by the Hon’ble Minister of Communications.

 

No handing over of BSNL’s Mobile towers and Optical fibre to the private, under the National Monetisation Pipeline.

The DDG(PM) stated that, the amount coming through Monetisation of BSNL’s Mobile towers and Optical fibre, will only come to BSNL. However, the AUAB refuted this and stated that under the National Monetization Pipeline, this amount will only go to the Government. Hence, it was argued strongly that, no Monetisation of BSNL’s Tower Payment of Pension contribution by BSNL, based on the actual basic pay.

The DDG(PM) stated that, this issue was taken to  the  Finance Ministry, by the DoT, on three occasions. However, the Finance Ministry did not accept the demand, he stated.

 

Speeding up of BSNL’s Land Monetisation to off-set the Company’s debt.

To this, the DDG(PM) stated that, presently, four properties of BSNL are being sold through DIPAM for Rs.2,000 Cr. This money will come only to BSNL. He further stated that, as per the Government decision, Lands worth below Rs.10 Crore could be sold by BSNL itself. Lands worth between Rs.10 Crore and Rs.100 Crore could be sold with the approval of the DoT. Lands worth above Rs.100 crore could be sold only through the DIPAM.

Immediate settlement of 3rd Pay Revision for the Executives and Non-Executives of BSNL.

The DDG(PM) stated that, a decision on this could be taken only by the Hon’ble Minister of Communications.

CWC meeting of AIBSNLEA has been successfully conducted on 19.10.2021 in online mode. It was attended by all the CHQ Office Bearers, CHQ Advisers, Circle Secretaries, Circle Presidents and CWC Members from all over India. After opening remarks by All India President Com. Subhasis Mitra, two minutes silence has been observed in the memory of the OBs & Members of AIBSNLEA and the Employees of BSNL including retirees who lost their lives during the tough time of Covid-19 Pandemic.

General Secretary Com. S.Sivakumar has placed GS report before the House and delivered inaugural address to the House. All the Circle Secretaries have placed their report and status about the Organization in their respective Circles and offered very good suggestions. Queries were raised by the CSs about updating on various HR issues & BSNL Revival Package. Chairman, all the Organizing Secretaries and Assistant General Secretaries have also expressed their views and suggestions for the betterment of the Organization, their Members as well as BSNL.

Com. S. Sivakumar, General Secretary has replied all the queries raised by the CSs, CPs & CWC Members on various issues. He also discussed about all the burning issues related to BSNL as well as Executives. He updated the House on post VRS structure of BSNL, Restructuring & Manpower Planning in BSNL and the future Road Map for the Revival of BSNL.

GS also explained about the allocation of 4G Spectrum to BSNL, funds for implementation of 4G Services in BSNL as a part of revival Plan & Compensation from Govt. of India due to delay in allocation of 4G Spectrum to BSNL.

GS mentioned that the Claims receivable from DoT to BSNL to the tune of Rs.29,540 Crore is pending towards Viability Gap for Rural Telephony, Surrender of Wimax & CDMA Spectrum, Excess payment of Pension Contribution & Leave salary reimbursement, outstanding for various Projects (Bharat Net, LWE, USO Funded- A&N, Lakshdweep, Assam, Amaranth Yatra, Wi-fi Hotspots etc.), Providing Telecom Services, Building/ space Rent and reimbursement of Staff relate claims etc.     

GS further mentioned that the CHQ accepted the Verdict given by the Majority Executives of BSNL and most of the Executives were voted for a particular Association in the name of DR. The main reason for becoming 3rd position is reduction of our Membership due to VRS and more number of CHQ Office bearers, Circle Secretaries and Circle Office bearers have gone on VRS. However we continue our efforts more aggressively to safe guard the Interest and achieve the Legitimate Rights & Issues of all the BSNL Executives. To further strengthening AIBSNLEA, the New Talented Youngsters to be inducted as members as well as the office bearers in the Districts, Circles and CHQ level. We have to critically examine of our strength and weakness regarding actual paid membership of the Association since large number of our members have opted for VRS.  This meeting should discuss about the Organization strength in Various Circles, District bodies in the Post VRS scenario and decide the further line of action. Strategies to be evolved to increase our membership by conducting extensive tours by the Circle Secretaries and conducting General Body Meetings and explain the initiatives taken by the AIBSNLEA CHQ for the settlement of various issues and continuous persuasion of AIBSNLEA CHQ with the Management for the settlement of pending issues and proper corrective measures, wherever necessary, should also be planned. Ensure regular and timely election of Circle/ District bodies to provide transparent and democratic organization structure. Circle Secretaries are requested to take stock of the situation in their Circles and to hold immediate CEC Meetings and Special General Body Meetings in the Districts to assess the situation and interact with the members to discuss their grievances and form new Branches wherever not exists. CHQ Office Bearers and Advisors in their respective Circles should go on organizational tours and to take stock of the status of the issues of various Executive Cadres taken by AIBSNLEA during the period and capitalize it.

GS explained in detail about the working of CHQ at New Delhi that how CHQ is functioning continuously even during the worst period of 1st and 2nd Wave of Covid-19, when whole Country was under Lock-down and very less presence was in every office even then General Secretary was stand alone like a rock for the issues of Executives before the Management and continuously writing & discussing the new issues being faced by the BSNL Employees on day to day due to Covid-19 Pandemic. During the tough time of Covid-19, GS AIBSNLEA is the only GS who raised about Compensation amount & the Compassionate Ground appointment to the Family Members of the deceased BSNL Employees due to Covid-19.

GS also briefed about how the Human Resources in BSNL can be utilized optimally, Status of various CPCs & Promotions in all Cadres, LICE examinations, 3rd PRC/ Merger of IDA, Pension Contribution on actual Basic Pay, other HR issues and various related issues etc.

Chief Guest of the CWC, respected Director (CFA) BSNL Board Sh. Vivek Banzal has graced the occasion and addressed the House with a motivational speech. He congratulated all the Office Bearers of AIBSNLEA for successful convening of 1st CWC Meeting and also greeted BSNL family members for the ongoing series of festival seasons. He mentioned that it is the great opportunity to attract with Executives from all over India and BSNL family at one place. An excellent interactive session was also conducted between Director (CFA) and our Office bearers. Director (CFA) clarified and answered all the queries raised by our Office bearers and appreciated for the suggestions and feedback given by them for the further improvement and revenues generation in CFA Segment.

All India President Com. Subhasis Mitra had managed the House in a very cordial & cooperative manner for which the House deserves Congratulations.

The House also discussed about the Venue of 7th All India Conference of AIBSNLEA. After discussion in length, the House has unanimously decided that 7th AIC of AIBSNLEA will to be conducted by Tamilnadu Circle in Chennai during the last week of January 2022.

CWC Meeting of AIBSNLEA

Central Working Committee Meeting of AIBSNLEA has been successfully conducted under the Presidentship of Com. Subhasis Mitra, All India President of AIBSNLEA through Online Mode on 19.10.2021 from morning 9.00 am to 9.30 pm with the active participation of more than 80 Comrades including GS, Chairman, CHQ Office bearers, CHQ Advisers, CS, CP & CWC Members from all over India.

 

Respected Director (CFA), BSNL Board Shri Vivek Banzal has graced the occasion as Chief Guest and addressed the gathering with the motivational speech followed by very good interactive session with the participants on the Cluster, FTTH & other CFA related issues.

AUAB writes to the CMD BSNL and the Secretary, Telecom, on excess posting of ITS officers in BSNL.


According to the deployment plan approved by the Cabinet, the number of PGM/GM level officers to be posted in BSNL during 2021-22 is just 199. However, today, the working number is more than 425. About 130 PGM/GM level officers are working in excess from 2020 onwards and in 2021-22 the number will be around 225. Management is simply accommodating hundreds of senior officers in BSNL without any justification and paying them the benefits of 7th CPC, LTC, Transport Allowance, TA, Tuition Fee reimbursement etc., on the revised rates, when the same are denied to BSNL employees. It is identified that, about 20 PGM/GMs are in excess at BSNL CO itself. BSNL is paying about Rs.90 to 100 crore per annum as salary and allowances for the excess officers working in BSNL....<<<Click here for letter>>>

Shri  Ashwini Vaishnaw, a former IAS officer and Rajya Sabha Member from Odisha, is the Minister of Railways, Communications and Information Technology (IT). He belongs to Jodhpur, Rajasthan and has studied Management at Wharton School, University of Pennsylvania, in the US. As an IAS officer, Shri Vaishnaw has worked in the PMO, during the Prime Minister ship of Shri Vajpayee and has handled the Public-Private Partnership (PPP) framework.

UAB holds crucial discussions with the CMD BSNL.

The AUAB held a crucial meeting today, with Shri P.K. Purwar, CMD BSNL. On behalf of AIBSNLEA, Com.S.Sivakumar, GS AIBSNLEA participated in the Meeting. General Secretaries / Representatives of BSNLEU, NFTE, AIGETOA, SNEA, SEWA BSNL, BSNL MS, SNATTA, AITEEA, BSNL ATM, TEPU, BSNL OA and BEA participated in this meeting. From the Management Side, Director (HR), Director (CFA), Director (CM), Director (EB), Director (Finance) and Senior Officers of the Corporate Office participated.

Leaders of the AUAB forcefully demanded prompt upgradation of the BTSs, to immediately launch BSNL’s 4G Services. Payment of Salary on the due date of every month was prominently raised. Immediate Settlement of the dues to the BSNL amounting Rs.39,000 Cr by the DoT, improving the Maintenance of Transmission Network  as well as Landline and Broadband Services, etc., were raised. Modi Government’s plan for raising Rs.40,000 Crore, by monetising BSNL’s Towers and Optic Fibre was severely opposed. Proposals of the Management  for Restructuring BSNL’s Manpower came under severe criticism. Regarding the Superannuation Benefits, it was firmly demanded that BSNL Management should immediately take steps to increase it’s contribution upto 30%. The BSNL Management’s policy of continuing to rely on the ITS officers to run the Company was severely criticised. Many other issues related to the employees and the Company’s revival were also raised. 

Finally CMD, BSNL replied to the demands raised by the AUAB Leaders. The Meeting Lasted for 3 Hours. Further details will follow………..

Submission of Memorandum to CMD/CGMs/BA & SSA Heads  on 30.6.2021 as per the AUAB Call.

As per the call of AUAB, Memorandum to be submitted to CMD/CGMs/BA & SSA Heads  on 30.6.2021 for non disbursement of Salary on due date. Copy of the Memorandum already forwarded to the Circle Secretaries.

Only Circle Secretaries shall meet the concerned CGMs and submit the Memorandum. Likewise, District Secretaries shall meet the concerned BA/SSA Heads and submit the Memorandum.

All the Circle Secretaries and District Secretaries are requested to co-ordinate with the Constituents of AUAB and make the Programme a Grand Success.

All the Circle Secretaries and District Secretaries are requested to co-ordinate with the Constituents of AUAB and make the Programme a Grand Success.

GS, AIBSNLEA once again written (Reminder) to Shri P.K.Purwar, CMD BSNL and requested for immediate creation of Trust/Fund  for Post Retirement Medical Benefit for BSNL Recruits and releasing the  full pending arrears to the  Trust with effect from 01.01.2007 so as to mitigate the suffering being faced/would be faced  by the BSNL Direct Recruits and their families after VRS, Retirement,  Death etc., and to avoid any resentment and frustration among the BSNL Direct Recruits.

In this regard, GS AIBSNLEA has already written to CMD BSNL on 4.7.2020 and requested CMD, BSNL , Director(HR) and Director(Finance) for the past one year in so many meetings for immediate creation of Trust/Fund  for Post Retirement Medical Benefit for BSNL Recruits and releasing the  full pending arrears to the  Trust with effect from 01.01.2007.But till date no action has been taken in this regard. Hence Reminder has been written by the GS AIBSNLEA to CMD BSNL for immediate action in this regard.

Suggestions of AIBSNLEA

1.   PRMB should be a well defined contribution just like Superannuation Pension fund, EPFO Contribution ,Gratuity Fund etc.,

2.     This 3.3% of PRMB should be made as Defined contribution & Separate BSNL PRMB Trust should be formed otherwise this 3.3% contribution has no meaning & it should not be counted for Superannuation Benefits contribution.

3.     The effective date of creation of the Trust/Fund for Post Retirement Medical Benefit for the Direct Recruits Employees of BSNL must be 01.01.2007 i.e., the date of effect of 2nd PRC recommendations otherwise it will be a gross injustice to the BSNL Direct Recruits.

He insisted the Secretary(T) DOT for the immediate release the Claims Payable to BSNL to the tune of Rs.29,540 Cr  viz., Compensation to BSNL for un-remunerative but Socially desirable Projects ( i.e., for serving in Rural / Tribal/ Naxalite prone/LWE Areas) Compensation for carrying out Govt. Projects, Excess payment of Pension Contribution, Reimbursement of Leave encashment paid to the absorbed employees for the DoT period , Interest on Wi-Max Spectrum etc., which will definitely useful to BSNL for the timely disbursement Salary to the Employees of BSNL for improving its Services during the Pandemic and  Financial Crunch period.

 

Several measures of the Government of India, aimed at compensating BSNL for un-remunerative but Socially desirable Projects have provided the support required for Financial Viability of such operations to a great extent, in a scenario where the opportunities of cross subsidizing its Services have almost disappeared in a hyper competitive urban market. A Major Package of such support was in the form of subsidy for its Rural Operations through various schemes of USO fund. Several Government Projects have also been awarded to BSNL on nomination basis, where BSNL earns a centage for Execution. However, Technical evolutions in Telecom Network Landscape, intensity of competition in Telecom Sector, and inadequacy of Capital resources with BSNL has presented it with twin challenges of supporting a high maintenance Legacy Network on one hand and decreasing demand for its Services, which lag rest of the Industry by a Generation, on the other. BSNL is obliged to continue to provide the Services in Rural Areas which were provided with Capital as well as operational Subsidy under USO Fund  Schemes, even after the period of Subsidy expires, and the Services continue to be Financially non-viable. It is important to note that challenge of Financial viability is not restricted to Wire line Services only. BSNL provides mobile telephone Services also  in Rural and remote locations in Border States and North East Region by incurring huge cost of more than 150 Crore towards IDR Bandwidth and VSAT charges.

Whereas a long term solution in terms of assured access to adequate Capital resources needs to be evolved, continuing the arrangements for funding of viability gap in rural operations needs to be ensured for financial viability of BSNL’s operations and its continued relevance in Indian Telecom Services Segment. BSNL received last support for its rural Wire line operations installed before the introduction of USO funded Schemes, for a period upto July 2013. The Rural Wire line Network Infrastructure and Exchanges continue to be maintained by BSNL regularly, and the existence of this infrastructure has enabled Government in realizing the objectives of providing affordable access to Broadband Services to Rural India, through Bharat Net Work. Whereas the deficit on account of Maintenance of this Infrastructure being borne by BSNL is not only draining its Financial resources, the quantum of loss in its Books of Accounts is also impairing its capacity to raise fresh Capital from Banks and Financial Institutions. As on date BSNL borrowed around Rs.24,000 Cr from Banks.

 

The matter of subsidy for Rural Wire line operation of BSNL has been under constant pursuance with Member(Finance) and Officers of DoT by the GS, AIBSNLEA for the last one year. BSNL Management has also pursuing the issue with the Joint Secretary(Admin), USOF Administrator,  Member Finance and other Officers of DoT time and again through various meetings  but the deficit in Rural Wire line operation for FY 2014-15 to 2019-20 to the tune of Rs.13789 Cr. ( As per the Audited statement of Accounts of BSNL) has not been   reimbursed till date.

 

 

BSNL is facing severe Financial Crisis and not able to pay even Salary in time, for the past 20 months, Electricity Bills, Towers Rent, Vehicle Running Expenses, SAB benefits, Fuel Expenses, Contractual Labour Bills, Payment to Vendors, Telecom Infra Service Providers and Local Cable TV Operators etc. It has caused serious demoralization and frustration among all the concerned. The OPEX, CAPEX, Statutory and other accumulated Liabilities are also pending for more than Rs.12,800 Crore and it is likely to increase in the months to come.

 

BSNL is not able to meet even its fund requirement for monthly salary due to heavy dip in Cash inflow for the past 20 months. Cash flow for the month of Apr’2021 was Rs.1400 Cr. whereas it is reduced to Rs.1000 Cr during May’2021 (i.e 29% decrease) and likely to continue in June’2021 also due to Pandemic situation. But our monthly Operating Expenditure is around Rs.9000Cr.

Further, the gap between monthly revenue and bare expenses to continue operations as a growing concern has reached a level where continuing with BSNL operations could be nearly impossible without immediate infusion of adequate liquidity

 

Matter has been further aggravated by the Second wave of Covid-19 pandemic due to which BSNL has to extend the Pay by date of the bills receivable from its Customers leading to delay in collections. Many of our employees have got infected by the Virus leading to exponential increase in Medical Expenses. Sufficient funds are not available with BSNL to meet its liabilities. Adequate funds for even the salary of June’ 2021 are not expected to be available due to the impact of lockdown and delay in collections. Help from DoT by releasing the above amount would provide the much needed support to BSNL at this stage, especially in view of the present pandemic.

So in the present Scenario, DoT has to release the long pending outstanding dues amounting to Rs.29,540/- Cr to BSNL  so that BSNL can tide over the current acute financial crises and meet its obligations.

Hence the need of the Hour is all the Unions and Associations of BSNL should join together and unitedly fight and demand  DoT for the immediate release of long pending outstanding dues amounting to Rs.29,540/- Cr to BSNL so as to disburse the Salary of BSNL Employees in time and payment of other pending bills by BSNL due to the present pandemic situation . <<<Click here for letter>>>

Health Insurance Scheme (Medical Insurance Policy) to the BSNL Willing employees in addition to the BSNL MRS

Today GS, AIBSNLEA discussed with Shri A.M.Gupta, Sr.GM (Admin) regarding the proposal given by AIBSNLEA on 17.5.2021 for the implementation of Health Insurance Scheme (Medical Insurance Policy) to the willing BSNL Employees in addition to the BSNL MRS. Sr.GM(Admin) appreciated our concern and mentioned that the proposal is under process and submitted to the Competent Authority [Director(HR)] for approval. It is learnt that a Committee may be formed after getting the approval from Director (HR) to negotiate with the different Insurance Companies.

GS AIBSNLEA suggested that if the Committee of the BSNL is functioning as a Facilitator and bargain with the Govt. Insurance Companies like National Insurance Company, New India Assurance Company, Oriental Health Insurance and United India Insurance Company, we will get comparatively lower Premium Rates and the Premium amount can be deducted from the Employees’ Salary and can be remitted to the Insurance Company by the BSNL Management as in the case of GTI Scheme.

Sr.GM(Admin)  positively responded and assured that the Management will implement the Scheme very shortly after getting approval from the Competent Authority.

Immediate Release of Emergency Medical Advance Funds to the Circles for the treatment of BSNL Employees and their families affected with Covid-19: GS AIBSNLEA appraised the Director(HR) about the BSNL Employees those who are working at the Field Level, Customer Service Centre and Offices affected by Covid-19 throughout India and taking treatment in Private Hospitals for saving their Lives. But Private Hospitals are demanding Lakhs of Rupees as Advance for treatment. Status of JTO to SDE(T) Promotion case in Hon'ble CAT Jabalpur: The JTO to SDE (T) promotion case was heard in Hon'ble CAT Jabalpur since last few days. Yesterday after the arguments are over,  the judgment is  reserved. It is reliably learned that after the pronouncement of the judgment JTO to SDE(T) DPC under SCF quota (67%) for promoting about 4500 eligible JTOs will be conducted.

 

Status of List no. 9 seniority case at Hon'ble CAT Chennai Bench: BSNL CO has  issued provisional seniority list no, 9 for the TES Gr-'B' equivalent to SDE(T) 2006-07 dated 10.08.2020. Some Senior candidates promoted earlier though Seniority-Cum-fitness quota aggrieved due to the wrong fixation of their seniority in the list no. 9 have approached the Hon'ble CAT Chennai  to recast the same basis on  DOJ as per Law (as per Chandigarh CAT & Supreme Court Orders in the case of list no. 6 , 7 & 8).

Hon'ble Chennai CAT directed the respondent (BSNL) to consider the  representations of the applicants aggrieved due to disputed provisional seniority list no. 9 dated 10.08.2020 and issuance of speaking order 'As per Law' within a period of two months. <<<Click here for order>>>

GS AIBSNLEA, AGS and CHQ-Auditor met Shri P.K. Purwar CMD, BSNL and discussed regarding:

 

a) E-Tender for Planning, Engineering, Supply, Installation, Testing, Commissioning and AMC of 4G Mobile Net Work : We enquired the CMD BSNL about the recent Detailed Notice Inviting E-Tender issued on 01.01.2021, sought proposal through the (EOI) Expression Of Interest from the Indian Companies for Planning, Engineering, Supply, Installation, Testing, Commissioning and AMC of 4G Mobile Net Work.

 

CMD, BSNL mentioned that as per the approval of DoT on 29.12.2020, BSNL Board has approved the proposal immediately and issued Tender Notification inviting proposal through EOI for the procurement of Equipments, AMC etc., for the tentative 57,000 4G Sites with prior Registration and Proof of Concept (POC) from the Indian Companies interested in participating the upcoming 4G Tender as per the initiative of GOI ÁTAMNIRBHAR BHARAT’ to promote Indigenous Manufacturing in Telecom Sector on 01.01.2021. CMD further mentioned that the Bidder or its Consortium Member(s) should fulfill the Technical Proven-ness requirement i.e, experience of Planning, Engineering, Supply, Installation and Commissioning. The Bidder not fulfilling Technical Proven-ness requirement shall be eligible for upcoming 4G Tender if they complete the POC successfully against this EOI.

 

CMD further told that through this E-tender Notification by Mass Media the message has gone to the nook and corner of India “that BSNL is going to launch 4G services shortly” and hopes that things will be changed in the positive direction very soon.

 

b) BSNL has to manage MTNL Mobile Net work on outsourcing basis: We enquired about the financial assistance, if any, will be given to BSNL by the Govt. to maintain MTNL Mobile Net Work in Delhi & Mumbai.  We told CMD that we have to invest very huge amount (CAPEX) to put back the MTNL Net Work in order and we have to insist Financial Assistance from the Govt., since BSNL itself is struggling for maintaining its own Mobile Net Work due to heavy financial crunch. CMD, BSNL informed that we have to wait for another one month for completing the formalities and then only we will assess the situation and our Targets.

 

c) Free Corona Vaccine to BSNL Employees treating them as Frontline workers: CMD BSNL mentioned that he has already gone through the letter given by AIBSNLEA in this regard and appreciated our concern for writing such a letter in the interest of BSNL Workers with a copy to Hon’ble Minister for Health and Family Welfare. He assured that he will take up the issue with the Secretary (H&FW) through Secretary (T). <<<Click Here FOR GS LETTER>>>

 

d) Compensation and Financial Assistance to the family members of deceased BSNL Employees due to Covid-19: We requested CMD BSNL to consider the Compensation and Financial Assistance to the family members of deceased BSNL Employees due to Covid-19, AIBSNLEA has taken up and requesting for the past 6 months. CMD BSNL mentioned that the proposal was discussed in the BSNL Board Meeting in length but not considered due to heavy financial crunch.

 

e) Non remittance of SAB recovered from monthly Salary of  Apr’ 2020 to Nov’ 2020: We brought to the notice of CMD that SAB benefits in respect of DRs of BSNL recovered from the monthly Salary of Apr’2020 to Nov’2020 has not been remitted to the Concern Authorities, resulting in non receipt of Pensionery benefits by the Retired Officials. CMD assured to look in to the matter.

 

f) Restructuring and Regular Promotion in all the Cadres: GS appraised the CMD BSNL that thousands of Executives already drawing Higher Scales are working in the entry level grade of JTO equivalent and waiting for their 1st Promotion for the years together. Likewise SDE(T)/ SDE(C/E/TF/Arch)/ AOs/ CCS/ PS cadres are waiting for their regular promotions since long. The Promotions are held up by the Management in the name of Restructuring and various Court Cases on Reservation & Seniority issues. AIBSNLEA has continuously pursuing and requesting the BSNL Management for the issuance of Regular Promotion” Orders in all Cadres of all the Streams. We categorically told that AIBSNLEA strongly oppose any look-after arrangement in higher grade but we demand immediate promotions on ‘Regular Basis’.

 

CMD mentioned that restructuring proposal is likely to be finalized shortly and presented to the BSNL Board for Approval. CMD further told that Management is ready to consider the Promotions in all the Cadres but due to Hurdles created by filing cases in various Courts, Management is facing problems and not in a position to issue Promotion orders in a timely manner and dead lock is continued.

 

g) Discrimination in consideration of request transfers of Accounts Personnel: We brought to the kind attention of CMD that request transfers in respect of Accounts Personnel has not been considered  by the Management for the past 7 months in the name of Restructuring,  whereas request transfers have been considered in all other cadres. We also explained CMD BSNL about the problems being faced by the Accounts Personnel without family in other Circles for more than 3 years due to Covid-19 and requested him to consider the cases on Humanitarian grounds and issue necessary instructions to the concerned Authorities for issuance of transfer orders. CMD after patient hearing advised us to take up the issue with Director (Fin)/Director (HR) and also assured to looked into.

 

h) Compassionate Appointment to the family members of deceased BSNL Employees due to Covid-19: CMD BSNL mentioned that the proposal was discussed in the BSNL Board Meeting but not considered due to heavy financial crunch.

 

 i) Financial Status of the Company and benefits of Tower Company: CMD BSNL mentioned that the Company is earning Operating Profit (EBITDA positive) in the first half of the F.Y 2020-21 i.e., after 5 years and revenue is slightly increasing. We requested CMD for the disbursement of monthly Salary on the last day of the month. CMD told that our day to day Cash flow is not sufficient for our Operation and Maintenance and this year 2021 also BSNL will face severe financial crunch, since in addition to monthly/quarterly expenditure of Salary, O&M expenditure, Bank Interest, GST,TDS, L.Fee and Spectrum Charges etc., also BSNL is having Liability to pay Rs.3000 Cr to DoT Vendors in respect of Advance received for Bharat Net Projects. In addition to that BSNL is not yet getting any Loan from Banks for CAPEX on the basis of Sovereign Guarantee Bonds or fledging of Monetized Assets till date.

 

Regarding Tower Company CMD mentioned that BSNL earn several hundred Crores due to non remittance of L.Fee w.r.t. AGR but BSNL is getting very good revenue from the External Projects of Civil & Electrical Wing from Odisha, H.P and other Circles for which separate Escrow Account is being maintained.

CMD requested that each and every employee should work hard to increase our day to day collection/Revenue and follow the Austerity measures instructions issued by BSNL CO scrupulously to control over the Expenditure. We assure CMD BSNL that AIBSNLEA is always support the Management for the betterment of BSNL and finally requested the CMD BSNL to consider the Promotions in all the Cadres so as to boost the morale of the Young Executives in BSNL.

As AIBSNLEA has been  going on receiving multiple calls about the progress of the matter from the concerned executives   ,  a discussion on the matter have been carried out with IFA Kerala Circle  Smt. Rathi Rani A  for the speedy settlement of the matter . IFA was kind enough to take up the matter in due spirit and assured to finalise the fixation without delay. Understandably, for some of the executives an extra benefit of Rs. 700 to 800 per month is getting up as per the new pay fixation.

Wrong recovery of Overpayment from 2010 departmental 40% JAO quota AOs.

The whole avoidable process starts at Circle Office, may be, by a misinterpretation of the contents envisaged in the corporate office letter dated 14-01-2020. It says only to recover amount overpaid due to any wrong fixation of pay done to 2010 departmental JAOs. The instance cases referred in the letter are the cases where fixation was given from the date of promotion of JAO as per clause 3.6 of the Non executives’ pay revision order circulated vide letter No. 1-16/2010-PAT (BSNL) Dated 07- 05-2010. In many circles, the option (as per 3.6) was considered and pay was fixed on 2010 itself counting the officiating period of JAO and continue to draw the pay and allowed increment thereby before its regularization by Corporate Office letter dated 24- 07-2015  .

 

The CGMT Kerala extended a very patient hearing on the matter and CGMT convinced the unfortunate note of circle office . CGMT directed IFA Kerala circle to calculate due drawn for all the affected Accounts officers in connection with Option for 2nd PRC in 2015. If any arrears it would not be extended as per CO guidelines and if any net excess amount paid, it would be recovered.

 

AIBSNLEA Kerala circle extends sincere regards to CGMT  Shri. C.V  Vinod for his timely intervention and having taken a very fair decision on the matter according to BSNL guidelines.

 

Relieving of all the executives (SDE/JTOs) who are under inter BA request transfer orders :

We requested to release all the executives who are under orders of transfer on request. CGMT assured to relieve them in ERP on 30-11-2020 , if not relieved by BAs till the time.

 

CGMT mentioned on operation of long stay list of SDE/JTO & AO/JAO subsequently with minimum disturbance, if  needed. CGMT assured to discuss on the matter with all stake holders before release of the fresh orders.

 

Calling  sufficient AOs for CAO ( LA )

We requested CGMT Kerala to call sufficient AOs for extend their options for CAOs as Circle office has done in the case of SDE to AGM and AGM to DGM LA . CGMT assured to extend the option facility subsequently

AIBSNLEA extend its sincere thanks to CMD BSNL,  DIR(HR),  PGM(Pers), DGM(Pers-JM), AGM(Pers-II) Shri Pyare LalDM(Pers.II) Shri Ramoorthy. For the past two months, the entire Pers-II Team of BSNL Corporate Office is working for the release of AIEL of JTOs, especially Sh. Ramoorthy, DM(Pers.II) has attended the office on all Saturdays & Sundays for the past eight weeks as per the directions of superiors and completed the task successfully.

CS Com.Shaji , CFS Com.Biju Gopal , CVP Com.Rajan and DS TCR Com. Aneesh  Antony  had a pre-appointed meeting on 08-10-2020 with the CGMT Kerala Shri. C.V  Vinod . The meeting started around 4.45 PM and extended up to 6.45 PM. We discussed the following matters.

 

Include FTTH count also to the total DEL count:

The DEL calculated for LL: 1 , BB : 1.5 and Leased Line :2 . Being ARPU of FTTH is heavier than BB and as FTTH lines being added in an exponentially increasing way, DEL count for FTTH is mandatory for justification of the Executives’ post in BSNL. If we will not consider the FTTH DEL count as BB customers are switching to FTTH , the geographical seize of clusters will increase and the  number of clusters will  shrunk badly affecting performance of BA .

 

As on 30-09-2020 BSNL Kerala has 1, 38,647 FTTH Connections. Most of the customers are migrated BSNL BB Customers. The proportional DEL value is more than that in 2 or 3 BAs. We requested CGMT to take FTTH DEL count as 2 while fixing cluster seize. CGMT shared our concern and replied that surely he would take up the concern to corporate office.

 

Distribution plan of SDE/JTO and AO/JAOs

We expressed our concern on showing surplus 30 executives in Accounts/Finance vertical in Kerala. We shared our concern on the non counting of the posts of officers (AO/JAO) working very effectively in CSCs. AO/JAO can effectively distributed for marketing. CGMT assured to consider all these suggestions till Corporate Office instruct differently.

 

BSNL can Eruct 4” GI Pipe for extending FTTH connections in feasible locations :

As of now BSNL and N/E LCOs extend OFC for FTTH through non-BSNL poles in almost all areas. KSEB already informed in black and white to remove our cables to reduce the overload of their poles. Understandably Rs.400 / Rs.200 are the rent per pole per year for KSEB in urban/rural areas. BSNL can freely do FTTH business by erecting sufficient GI poles coast @Rs 1500 per pole and the ROI can be earned within 2/3 years in terms of rent from E/N LCOs. We requested CGMT to consider the case with deserved merit as the CFA sector migrating to FTTH business especially on the fact that BSNL starting to extend any LL Directory number with FTTH line.  CGMT appreciate our concern and assured to look into the matter.

 

Online attendance : frustration and morale demotion of executives working round the clock for BSNL

Most of the officers working in Transmission, BSS and other similar fields are discharging their duties till late night rather round the clock. They are certainly humiliated on many days to attend office @9.30AM to mark online attendance after attending faults in late nights. They are not getting enough rest and leads to health issues and reduction of efficiency. It is badly affecting the output. Provisions may be extended to adjust the morning reporting time with the last day's attendance Mark-Off time. If exit time is more than 6 hours late than the normal exit time, their next day's attendance may be allowed to mark as duty off with the approval of controlling officer. Or, instead, flexibility in reporting duty shall be extended to the affected officials on a balanced way.

CGMT appreciated the hard working executives and non-executives carrying out extra efforts for the benefits of BSNL even after office hours. Further, CGMT suggested online attendance is a free matter of choice between these officials and their controlling officers. Everyone in this sector can invariably use Mob App for marking attendance. We appreciate the concern of CGMT Kerala.

1.Implementation of  Single bill concept (Grouping of individual connections ) to all State Government Departments and Directorates  which will improve the  first month collection efficiency  and will avoid frequent  disconnection of connections  due to Delay in processing of service  bills at various offices .

2. One time settlement option to  small  business firms ,shops etc presently under suspended NP Status  whom defaulted the payments due to COVID-19 by allowing discounts for the non usage period (closed period due to lockdown)  for reconnection purpose.

3. Exploring more business opportunities  from State ,central and Defence sector  in view of the large scale data usage  in post  COVID-19  Scenario by offering  bandwidth up gradation for existing and new provisions  with discounted offers .

4. Single window system for provision of FTTH connections.

5. Immediate completion of Projects pending with E-health, Court and Jail etc there by generation revenue.

6. More attention to Revenue Generation from EB  which is lagging significantly in this F.Y

7 Ensure frequent visit  EB customers by KAMS

AUAB served Notice to observe BSNL Formation Day

AUAB demands that:

1) The Govt. should clear the road-blocks and launching of BSNL’s 4G Service immediately.

2) BSNL Management should upgrade the existing 49,300 4G compatible BTSs and procuring another 15000 BTSs (4G) by placing an “Add on” purchase order, through the existing tender.

All Unions and Associations of BSNL (AUAB) meeting held on 07.09.2020 unanimously decided with a heavy heart, to observe 01.10.2020, the 20th Foundation Day of BSNL as "BLACK DAY"

AUAB has also decided to organise HUNGER FAST on that day maintaining Social Distancing.

The employees will wear black-badges on 01.10.2020.

On-Line CEC of AIBSNLEA Kerala Circle has been conducted today evening. CP chaired the meeting. CS elaborated the situations during referendum and that of post referendum in CHQ/Kerala circle. All District Secretaries  articulated the faith of our members to AIBSNLEA and expressed strong trust on AIBSNLEA CHQ/Circle leadership that our strong footed association having unique legacy can resolve out issues related to both our executive community and  BSNL  with management  . CFS proposed vote of thanks.

 

CEC evaluated that though AIBSNLEA voting count recorded in 2nd MVP is less than expected, the actual membership base of AIBSNLEA is intact. CEC decided to conduct the 7th Kerala Circle conference on ON-LINE mode on 18-10-2020, Sunday, by considering the COVID-19 super spread situation in Kerala.

AIBSNLEA CHQ received feedback from many of the Circle Secretaries & Field Units that wide spared anguish are being reported by many of the BSNL FTTH Customers connected through N/E LCOs that Voice quality is not there, unpleasant noise while on hook, one-way speech etc. etc.,

*Quality of both “Voice” and “Data” may be ensured...

*AT procedure for BSNL OLTs may be extended to non-BSNL OLTs also...

*Authenticity of address for FTTH provision by LCOs may be cross checked...

*As per the constraints in allotment of VLAN-ID for Voice Service, chance of disguised fraudulent voice calls prevails in FTTH Service. Any Directory number can be configured from any other ONT. This may be arrested by providing password changing options to the Customers. This can be implemented through NIB Nodes...

BSNL raises Rs 8,500 cr through sovereign bonds.....Today BSNL issued  Govt. guaranteed 10 years  maturity  bonds at coupon rate of 6.79 per cent per annum for 10 year period and within one and half hour, it is over subscribed to 2.02 times for total worth of Rs. 17183.10 Crs.

Meeting with CMD BSNL:

Today  GS and AGS AIBSNLEA  met CMD BSNL Shri P.K. Purwar and discussed regarding:

1) Special Insurance Coverage for the BSNL employees who are maintaining essential Telecom Services throughout India against COVID-19 and Financial Assistance/Compensation to the bereaved family members of BSNL Employees, who expired due to Covid-19: We requested the CMD BSNL for the immediate extension of the Special Insurance Coverage of Rs.50 lakh to the BSNL employees who are maintaining essential Telecom Services throughout India against COVID-19 as suggested by AIBSNLEA during the month of April 2020 and we also impressed upon the CMD BSNL that due to non-payment of Medical claim reimbursement bills for indoor treatment to the Hospitals, our Executives and Non-Executives are being facing problems for admission in the Approved Hospitals for cashless treatment for Corona as well as other treatments.

CMD BSNL mentioned that due to heavy financial crunch in BSNL, BSNL Management is not in a position to extend the Special Insurance Coverage to the BSNL Employees. However, CMD mentioned that as per the suggestions of AIBSNLEA, BSNL Management has already written to DoT during the month of May,2020 itself for the extension of Financial support to BSNL so as to pay the Compensation to the bereaved family members of BSNL Employees. GS AIBSNLEA has written the letter in this regard to the BSNL Management  in the Month of April' 2020 itself. <<<Click here for GS letter dt 14.04.2020>>>

He assured that he will personally take up the issue again with the Secretary (T) and Member (Finance) DoT for getting the Financial support for the Compensation to the bereaved family members of BSNL Employees, who expired due to Covid-19. We handed over the reminder Letter addressed to CMD BSNL in this regard. <<<CLICK Here for Letter>>>

(2) Fixing the Time Line for Monthly Salary disbursement: We requested the CMD BSNL to fix the time line for the disbursement of monthly salary on the last working day of the concerned month since the Net Salary expenditure is estimated around Rs.425 Cr and BSNL can very well manage the Net Salary Monthly expenditure from the monthly collection of around Rs.1350 Cr. CMD mentioned that now only Sovereign Guarantee approval has received from DoT and BSNL Management is proposed to release the Bonds before the end of September' 2020, then only our commitments towards Bank etc., will be reduced and opined that after this process only BSNL Management may be in a position to pay the monthly salary in time.

We requested the CMD to release at least August, 2020 salary in the last week of August 2020 due to the “Onam” Festival. CMD mentioned that we are not having sufficient funds for the disbursement of August Salary since July salary was paid on 20th August, 2020.

 

(3) Immediate promotions to all the Grades and Streams considering the post VRS Scenario: We requested to conduct the CPCs immediately for the promotion in the Cadres of:

(a) JTO(T) to SDE(T)

(b) JTO(C/E/TF/Arch) to SDE(C/E/TF/Arch)

(c) SDE(T) to DE(T)

(d) AO to CAO

(e) SDE(C/E) to EE(C/E)

(f) SDE(TF) to AGM(TF)

(g) PA to PS, PS to PPS & PPS to Sr.PPS, CSS and AD(OL).

(h) DE(T) to DGM(T) and CAO to DGM(F)

(i) DGM(Adhoc) to Regular DGM.

CMD mentioned that due to 2nd MVP the Promotion issue was not considered and he assured to consider the Regular Promotions in all the Cadres at the earliest.

(4) Discrepancies in the Provisional Seniority list No.9 of SDE(T) for DE(T) Promotions: We have brought to the notice of CMD about the discrepancies observed in the Provisional Seniority list No.9 of SDE(T) for the promotion of DE(T) issued by the Pers branch on 10.8.2020 and we categorically mentioned that the provisional Seniority List 9 is not prepared purely on the basis of the date of joining in accordance with the judgment pronounced by Hon’ble Supreme Court. But it is prepared on Date of Joining within the vacancy Year.

We further explained the CMD that the SDE(T) RR 2002 Amendment (That is Modification/addition/deletion in SDE(T) RR 2002) circulation dated 08-May-2018 as in Annexure 8 – “the Inter-se Seniority of the officers promoted against Seniority Quota (SQ-67%) and those who are promoted through LDCE/LICE quota (CQ-33%) against the particular vacancy year shall be fixed in the ratio of 2:1 irrespective of the year of appointment/date of joining”. “This Modification applicable with effect from 28/08/2015”only. Any RR amendment is applicable from that date (that is Prospective in nature) but not on retrospectively. CMD assured to look into the matter.

Meeting with Director (Finance) BSNL Board:

Today GS and AGS, AIBSNLEA met Director (Finance) and discussed regarding:

(1) Disbursement of Monthly Salary on due date in every month: We expressed our serious concern regarding the non-disbursement of monthly Salary on due date. We appraised that after VRS, our monthly Salary expenditure has been reduced to 50%, the Net salary works out to Rs.425 cr. only, but BSNL Management is not able to disburse the monthly salary in time and every month it is getting delayed almost 20 days. We requested Director (Finance) to stream line the timely payment of Salary in every month.

Director (Fin) informed that we have cleared almost all our liabilities and trying to update all the pending liabilities also. We have obtained the moratorium for Bank Loan/Interest also for 6 months during Covid-19 which is due to be paid during the month of Sept., 2020. Further, BSNL has received the approval for Sovereign Guarantee and BSNL Management is proposing to issue the Bonds up to the last week of Sept., 2020. By the issue of Bonds Management is expecting at least Rs.4250 Cr. and we may manage the salary in time with in next three-four months.  

 

(2)   Extension of option for Pay Fixation in respect of JAOs (Departmental) (10% Quota) of 2010 Batch: Director (Fin) informed that the Committee recommendation in this regard has been accepted and approved by the Competent Authority and assured that the formal orders will be issued with in a couple of days. AIBSNLEA has taken up this issue continuously for so many years and finally there is a ray of hope that is we are seeing the light at the end of the Tunnel since we are expecting the fruitful results shortly for our consistent and sincere efforts.

 

(3) Consideration of request transfers in the Cadre of Accounts Personnel: We requested Director (Fin) to consider the request transfers in the Cadre of AOs and CAOs since they have already completed more than 30 months service in the present Circle and requested for transfer to their Home Circles to join with their family. We also impressed upon the Director (Fin) that our Accounts Personnel are facing so much problems due to Covid-19 in other than their Home Circles and further requested to consider the transfer requests on Humanitarian Grounds. Director (Fin) immediately discussed over phone with PGM (Pers) to process the transfer requests on priority basis including the requests received from Accounts Personnel of BSNL Corporate Office. PGM (Pers) replied that the cases are processed and order will be issued shortly after getting necessary approval.

(4) Request for Withdrawal of letter issued on the  presumption of Telangana  Circle regarding  the wrong  Pay fixation done against first up-gradation under Executive Promotion Policy (EPP) for the JAOs of 1999 Batch by DGM Vigilance of CGMT, TS Circle: We impressed upon the Director (Fin) that the issue was discussed with  Dir(HR), DIR(Fin), PGM(Pers), Sr.GM(Estt),  GM(EF) and DGM (Pers) in detail several times with relevant orders/clarifications issued by the DoT, Pers & SEA Branch of BSNL CO, but even after a lapse of five months, the issue has not been resolved. To our surprise, TS Circle has revised the Pay fixation of Account Officers (JAOs 1999 batch) who are presently working in BSNL as well as who opted for BSNL VRS-2019 and wrongly ordered for recovery of Overpayment to the tune of Rs.7 Lakh to 12 Lakh and stall the regularization process (Pension & retirement benefits) of VRS optees in a biased and arbitrary manner with ulterior motive on the basis of frivolous complaint, which is against the Natural justice. We requested Director (Fin) to issue necessary directions to withdraw the arbitrary orders of reducing the Pay of aggrieved JAOs of 1999 batch. Director (Fin) immediately spoken to Director (HR) over phone and requested to resolve the issue on priority basis since the issue is pending at Pers branch for a petty long time. <<<Click here for GS letter reminder III >>>

In this regard, GS AIBSNLEA discussed with Director (HR) at 19.00 hrs. and requested to issue the necessary orders immediately. Director (HR) after discussing with PGM (Pers) over phone assured to issue the direction shortly.
