BSNL Unions/ Associations leaders meeting with CMD BSNL: GS along with the leaders of BSNL Unions/ Associations met CMD BSNL and discussed regarding implementation of 3rd PRC recommendations with 15% fitment benefits, withdrawal of BSNL orders banning agitation Programme in BSNL premises and vindictive actions taken against Executives Associations General Sectaries. CMD BSNL appreciated our concern and mentioned that his top most priority is to get implemented the 3rd PRC recommendations in BSNL. He feels that in case it is not implemented today then it will never be implemented in BSNL. It is the issue of 2 Lacs serving employees Pay revision and 1.5Lacs BSNL pensioner’s pension revision. He categorically told that he will leave no stone unturned in ensuring to get implemented 3 rd PRC report in BSNL. He further mentioned that in case he fails to get implemented to 3rd PRC report in BSNL then he will resign from the post of CMD BSNL. On the issue of BSNL unions/ associations strike decision he mentioned that unions / associations should adopt some other methods to impress upon the Govt. for 3rd PRC implementations by organizing "Candle March" "Post Card campaign" etc. rather than conventional method of organizing "Strike" because at this stage BSNL will heavily loose even on one day strike.

 In the beginning of the meeting CMD mentioned that today is a very important day for two things one is that "Today is World Environmental Day". Hence, today morning BSNL throughout the country has planted about 20000 plants to protect the environment. Similarly, BSNL in collaboration with AEROVOYCE is launching AEROVOYCE believing communications (An innovative mobile service) AD pay first MVNO of India (Mobile Virtual Network Operator).

AIBSNLEA Stand on Standard Pay Scales issue and clarification thereof

Dear Comrades,

AIBSNLEA is sincerely trying for the last so many years for the effective and practical implementation of Standard pay scales (E2- for JTO/JAO and Equivalent cadres and E3 – for SDE/AO and Equivalent cadres). While the discussion came up initially, from several sources it was evident that without cascading effect (E3 by E4, E4 by E5, E5 by E6 and E6 by E7) it cannot be implemented in BSNL. If at all standard pay scale is implemented without cascading effect, its damn sure that so many litigations will be filed in the courts due to the deadly issues of junior/ senior, heavy pay loss to the executives in the E2A scale, on the wedge of getting E3 compared to the executives at the beginning of E2A Scale and also holding an executive for 10 years in E3 scale is unlike any other PSUs. Thus practically the court cases will stop the implementation of Standard pay scales without cascading effect like so many promotions of JTO/SDE are stopped through court intervention. In addition to these many of senior executives are stagnating for the last couple of years without any annual increment.

By foreseeing these realties, AIBSNLEA took a stand since beginning for the implementation of standard pay scales with cascading effect because we want to implement this for the benefits of all the BSNL executives. More over, this implementation of standard pay scales with cascading effect is doubly benefitting for the young talents of BSNL working in the non standard pay scales of E1A and E2A. Those who want to see that standard pay scales are not implemented in BSNL at any cost, can only opt for implementation of standard pay scales without cascading effect. During the agitation of United Forum of AIBSNLEA and AIGETOA ,Management Committee of BSNL Board deliberated over the issue at length and decided to recommend up-gradation of pay scales of E3, E4, E5 & E6 for Sr. SDE, AGM, DGM and SG-DGM and equivalent posts to E4, E5, E6 & E7 respectively w.e.f. 01.01.2007. Accordingly the proposal was sent to DoT vide letter number 1-13/2015-PAT (BSNL) dated 06.06.2016 for approval. But now the Majority Association is trying to get withdrawn the proposal and want to restrict the upgradation up to E2 and E3 Scales only. Hence they are harming the interest of all the BSNL Executives.

In spite of this, while DOT rejected the proposal of implementation of standard pay scales with cascading effect, AIBSNLEA also took a stand with the demand for implementation of standard pay scales without cascading effect with an expectation and symptoms that DOT will approve. DOT did not consider even implementation of E2 and E3 Pay Scales without cascading effect and approved E-1A and E-2A intermediatory Pay Scales.

But, what happened next is the outright rejection of the proposal. Who is responsible for this catastrophe? After referendum, one association, self-proclaimed as saviours of BSNL and BSNL executives, is recognised as Majority association gave trade union notice for the implementation standard pay scales for E2 & E3 alone to DOT and at a later stage withdrawn their demand for the reason known to them. When a recognised association demanding something and at a later stage unconditionally withdrawing the demands does clearly indicating that they are not serious on the demand of getting standard pay scales to BSNL Executives. This only triggered DOT to pronounce Presidential Orders for unwanted E1/E2 scales. How that association can wash off their hands? Do they think they can eye wash others from their calculated move by yelling and shedding crocodile tears in public after things are happened as per their wish ?

Now what a responsible association has to do? AIBSNLEA is doing for the benefits of all the executives without giving any scope for litigations. ....  .......  .....

GS writes to Shri Anupam Srivastava, CMD BSNL regarding reply to DoT queries on replacement scales for pre-revised E1A, E2A pay scales for JTOs, SDEs & equivalent cadres. Wherein it is mentioned that replacement of E1A and E2A pay scales with E2 and E3 scales only, keeping other scales untouched, will have implications for already approved E3 pay scale for Sr. SDE because of the provisions of the Executive Promotion Policy (EPP). Under these circumstances, an executive will have to remain in the same E3 scale for a span of ten years.

This is against the provisions of the EPP, implemented in BSNL after recommendations of the High Power Committee chaired by the then Addl. Secretary (T), DoT Shri Y.S. Bhave wherein five time bound financial up-gradations from E1A (4-6 years) -> E2A (5 years) -> E3 (5 years) -> E4 (5 years) -> E5 (5 years) -> E6 have been provided to BSNL executives.

Management Committee of BSNL Board has deliberated over the issue at length and decided to recommend up-gradation of pay scales of E3, E4, E5 & E6 for Sr. SDE, AGM, DGM and SG-DGM and equivalent posts to E4, E5, E6 & E7 respectively w.e.f. 01.01.2007. Accordingly it was sent to DoT vide letter number 1-13/2015-PAT (BSNL) dated 06.06.2016 for approval.

Some of the senior executives are stagnating in E5 scale from the last 1-2 years. Many of them, who have fortunately or unfortunately become DGM and bearing higher responsibilities, are deprived off the time bound promotions to the E-6 scale under the EPP in the name of BSNL MSRR. As such they are not having any motivating factor.

Therefore, we have requested  to kindly request DoT for approval of-

(i) Pay scale of JTO & SDE (& equivalent executives) may be revised to E2 and E3 respectively as replacement of pre-revised scale of E1A / E2A w.e.f. 01.01.2007.

(ii) The pay scales E3, E4, E5 & E6 may be up-graded to E4, E5, E6 & E7 w.e.f. 01.01.2007 in respect of the cadres of Sr. SDE, AGM, DGM and SG-DGM respectively and appropriate changes may accordingly be approved in the BSNL Executive Promotion Policy.

The executives from the scales E3, E4, E5 and E6 would be simply placed to the next higher scale i.e. E4, E5, E6 & E7, most of them will not get any financial benefit even of a single penny except those whose stagnation comes to an end.

Further, it is also requested that persuasions may be done for approval of the proposal of deduction of pension contribution payable to DoT on actual pay of an executive instead of the highest of his/her pay scale. This will reduce the additional financial implications on BSNL to bare minimum as the said additional financial burden on BSNL would remain only on account of increased pay and allowances in respect of directly recruited JTOs / JAOs and a few number of DR-DGMs.

It is reliably learnt that BSNL Management is now withdrawing its earlier proposal dated 06.06.2016 and limiting replacement of Pay scales E1A by E2 and E2A by E3 only. It has caused serious frustration, resentment and agitations among the senior executives i.e. SDEs, DEs, and DGMs whose Pay scales are stagnated and they are being forced to remain in E3 Pay scales for 10 Years in violation of EPP provisions.

We strongly believe that frequent agitations are noxious to the viability of BSNL and put a question mark on the dealing ability of HR Management. We, therefore requested to kindly resolve the whole issue in one go considering all probable pros and cons instead of doctoring it in piecemeal. Withdrawal of BSNL’s earlier proposal dated 06.06.2016 in this regard will forced us to go for agitation.

CS writes to GS for his active involvement against the BSNL management’s deplorable legacy of filing review petition and killing the promotion scope of AD OLs in Kerala.

As mentioned in the subject, Supreme Court of India has given judgement  in SLP 8575 wherein the   High Court case No OP 20/2010 has been upheld by the  Supreme court of India on 27.3.2 017.


         
        Now 2 Months elapsed and it seems that BSNL is getting ready  for a review Petition . Actually 50 percent vacancies need to be filled by BSNL on Seniority basis from All India Combined Seniority List which is lively available.   Therefore your kind office is requested to pursue BSNL management  with not to  go for  review appeal which is detrimental to the interest of Hindi Cadre especially in Kerala Circle wherein all the vacancies are yet to be filled up by regular incumbents because of long pending Court cases .This affects the Hindi Cadre of BSNL adversely and denies natural justice to them since already CAT , HC and SC found their case is genuine.

Meeting with Member (S), DoT - GS, AGS (HQ) and CS Karnataka met with Member (Services) DoT on 31.05.2017 and discussed regarding:

A. Pay fixation matter relating to BSNL employees: Date of Increment on regular promotion to a scale: We requested to issue final order in this regard to resolve the issue favorably. At present after issuance of the recent clarification dated 08.05.2017 by Pers. Cell the BSNL serving employees and employees retiring shortly will face the recoveries to the tune of lakhs of rupees. Member (S) after some discussions mentioned that on the basis of AST meeting minutes BSNL should have not issued the order till issuance of the final order from DoT Estt. Cell or Finance cell. However, he immediately spoke to Sr. DDG (Estt.) DoT and discussed the matter and directed him to take the opinion of the DoT Finance cell and issue final order in this regard. Member (S) assured an early action.

B. Implementation of 3rd PRC in BSNL with 15% fitment benefit: We requested Member (S) DoT to use his good office to impress upon in DPE office for getting approved the BSNL/DoT proposal duly approved by Hon'ble MOS (C) with 15% fitment benefits. Member (S) mentioned that DoT has already pleaded in support of BSNL proposal for its approval. He advised us to meet the concerned authorities in DPE for favourable decision.

Today AIBSNLEA leaders joined the meeting of 12 JAO Phase-I trainees completing their training this week at RTTC Trivandrum. 6 each of them from Kerala and Tamil Nadu. CS , CVP , ACS(Eng) , ACS(Civil/Electrical) , DS TVM , DFS Trivandrum , CEC Member Com. Abhilash from Alappy BA along with other comrades in TVM BA addressed the comrades . Leaders elaborated all the prevailing HR issues in BSNL and sound interactions were there.

General Body Meeting of Alappuzha Branch has been conducted at Hotel Royale Park at Alappy , yesterday on 29-05-2017-Monday. A befitting send off was given to DS Com.A. Sreevas  who is retiring on Superannuation this month . Com. Jaya S Nair  AO , who took VRS ,  was also given send off .CS Com.Shaji and CP Com.Vijayakumar attended the meeting . Com. Tom Joseph , DS welcomed all the comrades . DS and DP of AIGETOA Com.Subhiksh P Surendrean   and  Com.Sunilkumar S  also  joined the GB .

 

Com.P AjithKumar AO is unanimously elected as the new DP of Alappy Branch.

 

Circle leaders in their speech detailed all the service/HR activities in Kerala Circle. They also exposed the false face of one association yelling now for solving HR issues without acting when time demanded for the reason known to them alone . CS informed that the increment preponment  case of 1999 JAO batch is with GM(A/HR) and the case would be settled in a month time. Circle leaders appreciated DS Com.Tom Joseph and team for arranging the very effective meeting. DS informed that the district management assured the release of comrades within a week time, whose transfer orders issued from circle office. The meeting was followed by multi cuisine lunch.

Meeting with Addl. Secy. (T) DOT:- GS,  AGS (HQ) AGS (Finance) met Adl.Secy. (T) DOT and discussed regarding:-

(a) Replacement of E-1A by E-2, E-2A by E-3 and upgradation of subsequent pay scales ie.  E-3 by E-4, E-4 by E-5, E-5 by E-6 and E-6 by E-7.  We requested for   reconsideration of BSNL's 06-06-2016 proposal for replacement of E-1A by E-2, E-2A by E-3 and upgradation of subsequent pay scales   E-3 by E-4, E-4 by E-5, E-5 by E-6 and E-6 by E-7  to provide parity in the pay scales and maintaining the pay scales hierarchy in BSNL.  Addl. Secy (T) mentioned that our views will be looked in to, in case any review in this regard is taken.

(b) Pay fixation matters relating to BSNL employees- date of increment on regular promotion to a scale – request for issuance of final order  in this regard- We appraised AST regarding BSNL's letter No.400-55/2016-Pers.I dated 08.05.2017 wherein now the pay fixation of the executives is being revised before their retirement which is causing huge recovery.  We requested him to issue a final order in this regard on prospective date so that no recovery is made.  AST assured to discuss the matter with Member (S) and  Member (Finance) for an early order in this regard.

BSNL launches satellite phone service using INMARSAT from Today

Today on 24-05-2017, the  Inmarsat and its strategic partner BSNL officially opened a new Indian GSPS Gateway, which will enable Indian government and private sector customers to access highly reliable satellite phone (satphone) services via Inmarsat’s 4th generation constellation.

Under licence from India’s Department of Telecommunications (DOT), the new GSPS ( Global Satellite Phone Service ) gateway, located in Ghaziabad, Uttar Pradesh, will enable BSNL and Inmarsat to meet the most demanding requirements of satphone users throughout the country.

It will enable the Indian Government to provide secure communications to defence services, commercial enterprises, the maritime industry and India’s remotest communities.

Anupam Shrivastava, Chairman and Managing Director (CMD) of BSNL said: “This is an exciting day for BSNL as it brings reliable, secure voice communications, powered by Inmarsat’s 4th generation satellite network, within the reach of groups and communities in areas with little or no connectivity.

Satellite phones in India are presently provided by Tata Communications, which inherited the licence from Videsh Sanchar Nigam Limited (VSNL) (now Tata Communications Ltd).  "The services of TCL will be phased out by June 30, 2017," Shrivastava said.  (Ref)

Yesterday CS , CVP and ACS (Eng) met GM(A/HR) and discussed service/HR matters. All along discussion DGM(HR) was present.

 

JTO Vacancy Calculation for VY 2016-17 :

We expressed our sincere thanks to management in accommodating all the nine left out JTO candidates for training in the 2014-15 vacancy quota along with others in the list.  AIBSNLEA was in constant touch with BRBRAITT Jabalpur and Kerala circle administration also intervened timely in the matter on our request.

 

On our enquiry about the exact numbers of vacancies calculated for the remaining candidates against VY 2015-16 , administration  replied that 110 vacancies are generated but 63 vacancies are to be reserved against   various court cases. We reacted this as highly unwanted. Aspirants for 2015-16 are suffering badly due to this decision. No other circle did the same in the name of court cases. Even if  the points in front of court are flimsy, the litigation procedure may stretch to many years and the career aspects of many innocent aspirants may face huge setback and heartburn. We requested management to release these vacancies and an undertaking may be obtained from the successful candidates to forgo their claim in case of non favourable judgement from the court.

 

Apparently circle administration erred in the roster calculations while calculating JTO vacancies on different occasions during  past years. Errors once happened went unnoticed and further calculations cumulated the errors . Even though, we are thankful for current circle administration on recalculation of vacancies on our request which assured more vacancies for 2015-16 open quota aspirants,  it is not enough to accommodate all the successful candidates and  we requested management to explore the feasibility of forming a committee to look into roster calculation errors w.e.f 01.10.2006 . It shall open all the possibilities for accommodating all the successful candidates against the  LICE  VY 2015-16  . Management assured to explore the possibility.

 

We expressed our sincere thanks to management for the comfortable posting to the last batch of phase1 completed JTOs to their home BAs and nearby BAs. We conveyed that now the shortage of JTOs in all BAs are almost same and hence the successful JTO candidates against VY 2014-15 and 15-16 may also be posted in their home BAs. Management assured to accommodate JTOs to parent BAs at the  maximum possible extent. 

 

Pending SDE/JTO transfer orders :

We expressed our resentment to management on the delay in releasing the orders and remained assurance given in the last meeting that the long stay orders will be released within a couple of week . GM appreciated our concern and instructed DGM(HR) to issue the transfer orders on 17-5-2017 itself after completing all the formalities yesterday itself . Inclusion of Com.Ambika and Com.Prasanna , the left out O_JTOs , for JTO training :

We strongly requested for the inclusion of these two candidates in the coming up JTO-Phase –I training since they need not undergo pre-basic training. We elaborated the unluck happened to only these two candidates to GM and he assured to consider the request very positively.

 

All other pending HR/Service issues are discussed and the meeting was fruitful . The meeting started after 5 PM and extended up to 7.15 PM.

 

The Leaders met PGM(F) at 4.00PM and extended sincere thanks to the very favourable and comfortable posting orders  as per our request to all the DGMs and  AOs posted to Kerala Circle. All the pending HR issues in accounts/finance vertical are discussed and the meeting was very fruitful. Regarding the long pending and very legitimate increment preponement issue of 1999 JAOs , PGMF replied that the file is yet to reach back his table after clearance from GM(A/HR) . Later the matter is discussed with GM(A/HR) in detail . He fully convinced the matter that this is unsettled  only  in Kerala and assured to look into  the matter and being an entrant to the chair of GM(A/HR) he sought some time for the same. We hope the matter will be sorted out soon .

Meeting with CMD BSNL :  GS, FS,  AGS(HQ) met CMD BSNL and discussed regarding

Implementation of 3rd PRC with 15% fitment: We requested CMD BSNL for getting approved 3rd PRC recommendations with 15% fitment benefit for BSNL executives from DOT/DPE. CMD BSNL informed that BSNL has already recommended to DOT for 15% fitment benefit to BSNL executives and on Friday (12-5-2017) Jt. Secy. (T) DoT has submitted the same to DPE for further necessary action.  He assured to discuss the matter with new Secretary (T) shortly and will try to plead before DPE along with DoT officers.  He further mentioned that Member (S), Telecom Commission has transferred this matter to Administrative Cell of DOT as it is of their domain. He was dealing the matter earlier since the out going Secretary (T), Shri J.S Deepak assigned him this work. CMD advised us also to pursue the matter in DoT/DPE for positive implementation.

Implementation of 3rd PRC recommendations:

DOPT acknowledged the AIBSNLEA and BSNL letter dated 26.04.2017 and states that the subject matter is in the domain of Department of Public Enterprises (DPE) and therefore the representation along with its enclosures have been forwarded in original to DPE for further necessary action.   <<<Click here for the letter>>>>

Group of Secretaries Meeting on 3rd PRC:

 Today in Cabinet Secretariat the meeting of Group of Secretaries is taking place. Addl. Secy(T), DoT  will gave presentation in the meeting on behalf of Secy(T) in this regard.

AIBSNLEA submitted its presentation to Addl. Secy(T), Jt. Secy(T), DoT today F/N and requested to ensure 15% fitment benefit  as recommended by BSNL and Memebr(S) DoT earlier. Earlier the matter was being dealt by Member(S), DoT on behalf of Secy(T) but now Addl. Secy(T) has been assigned this work.

Yesterday , CS , ACS Com.Pushparajan  , CVP Com.Binu , CWC Member Com.Udayakumar , Faculty member Dr.Menon , Com.Parameswaran Nair and Com.Prajith –JAO IMPCS addressed the ongoing JTO Kerala  batch at RTTC. The batch comprising of 29 trainees are completing their training on this week. The meeting was very interactive and effective.

 

Regarding the asking of AIBSNLEA stand on recent trade union action by some associations , we made our stand clear that the trade union agitation series have been started and carried out by AIBSNLEA against the burning issues of 1) E2-E3 Standard pay scales  for JTO-SDE Equivalent 2) 30 % Superannuation benefits for DRs 3) 22820 for post 2007 recruiters 4) Scrapping of MT/DGM recruitment rules etc . During these series of agitation on several occasions by AIBSNLEA with AIGETOA , another association tried their level best to torpedo the agitation in synch with management . Even then, we could walk through the progress path and at DOT/CMD lever we could extend the heat and gravity of the burning issues. Apparently DOT went in the direction of issuing precedential orders for E2-E3 standard pay scales   and BSNL stopped the MT recruitment process due to our agitation . After that referendum resulted that association as Majority association and they started to create a false aura around them that “Only They Alone Will do Everything , Only They Alone Can do everything  and  No Other Association Needed in BSNL “ . However, AIBSNLEA re-started agitation after referendum along with AIGETOA for these issues. There also this association in collusion with management acted against us rather against our demands. In a later stage they have given notice for agitation due to the pressure from their own members and then they have withdrawn that agitation notice without any reason ( This gave a clear message to DOT /BSNL that they have withdrawn their demand for these burning issues , what other meaning one can read out from this ????) . Naturally DOT also reverted their stand and presidential orders issued against standard pay scales. No channel of that association is effectively used against this obnoxious move of DOT even though that association  has  known that presidential order is going to be released in this way . Thus that association is solely responsible for the lowering of standard pay scales . What is the use of shedding crocodile tears or making hue and cry in a later stage of action without acting when time demands ??? . Moreover that association never consulted AIBSNLEA in due weigtage before jumping into the agitation.

 

We concluded that AIBSNLEA only started agitation against these burning issues and we are bound to get breakthrough . For addressing and achieving victory on all these issues we have our own strategies. This we will  choke  out and shape out further in our next CWC at Trivandrum.

 

Regarding question on the stand of AIBSNLEA on reservation policy , we categorically explained our stand that whatever reservation pattern being followed in BSNL must be followed further . It is a constitutional right and no one can dilute the same . We reminded the letter issued by our CHQ to management in this regard. Some false propaganda from some corners with mala fide intention was there  during last referendum  that AIBSNLEA was against reservation.

AIBSNLEA extends its sincere gratitude and thanks to CMD BSNL, Director (HR), PGM (Pers.), Jt. GM (Pers.) and his entire team for their overwhelming support and tremendous work. AIBSNLEA congratulates all the promote officers for the new assignment.

GS, VP II Com. Chakoli and AGS (HQ) met CMD BSNL, Director (HR) and PGM(Pers) in their chambers and extended sincere thanks for issuing the 438 DGM promotion orders.  We also extended thanks for increasing the number of vacancies from 388 to 513 counting vacant DGM posts consequent up on promotion of (ITS Officers) Adl.GM  to GM Posts.  During discussion CMD BSNL congratulated all the newly promoted DGMs and mentioned that now more than 1200 DGMs (Engg) promoted from Grp 'B' cadre are holding the posts of DGMs.  They should take the responsibility of their area and should be decisive in their day to day work.  All the time they should not depend on GM’s instructions/guidance.  He further mentioned that Group ‘B’ officers should feel motivated and contribute more for the growth of BSNL.  He also appreciated our approach that through discussion only such results can be achieved.  We assured him our fullest cooperation and support for the growth of BSNL.

Director (HR) also congratulated all the newly promoted DGMs and mentioned that they should contribute more for the growth of BSNL.  PGM (Pers) mentioned that efforts have been made to give posting on promotion as a policy with minimum disturbance.  Now all the promoted DGMs should give their best to BSNL since they are in field units to run the BSNL.  We assured them our fullest cooperation.

Dear comrades,  It is a historical achievement that more than 1200 DGMs (Engg) are now working in BSNL promoted from Gr.'B' cadre. This is the outcome of our sustained efforts during the last 11-12 years wherein we ensured that proper promotion policy is in place.  Hence, BSNL MSRR-2009 come in to existence which pave the way for the DGMs promotion in all the disciplines of BSNL. AIBSNLEA efforts will continue to ensure for  filling up of all the STS and SDE equivalent vacant posts to remove the stagnation in the carrier prospects of Gr.'B'  level Executives. About remaining 74 vacant DGM posts will be filled up shortly on receipt of the APARs and by holding CPC.  Let us , now  concentrate for filling  up of the vacant SDEs, DEs, AOs, CAOs, EEs(C),SDEs(C/E/TF) Posts immediately.

AIBSNLEA stand on replacement of existing pay scales:

AIBSNLEA has reiterated its stand on the replacement of intermediatory pay scales E1A, E2A and other scales E3,E4,E5, E6 by E2,E3,E4,E5,E6 and E7 respectively and accordingly has given a letter to CMD, BSNL and Secretary (Telecom) for reconsideration. In this connection BSNL has already sent a proposal to DoT vide letter number 1-13/2015-PAT (BSNL) dated 06.06.2016 for approval wherein-

 

(i) Pay scale of JTO & SDE (& equivalent executives) may be revised to E2 and E3 respectively as replacement of pre-revised scale of E1A / E2A w.e.f. 01.01.2007.

(ii) The pay scales E3, E4, E5 & E6 may be up-graded to E4, E5, E6 & E7 w.e.f. 01.01.2007 in respect of the cadres of Sr. SDE, AGM, DGM and SG-DGM respectively and appropriate changes may accordingly be approved in the BSNL Executive Promotion Policy.

 

AIBSNLEA is demanding the same for the benefit of all executives. AIBSNLEA represents all disciplines of the executive of BSNL whether it is BSNL absorbed or BSNL recruited, hence trying for benefit of all the cadres. In case, Executive Associations do not insist upon for the approval of above BSNLs proposal then all the Executive Cadres will never forgive them. Moreover replacement of E1A by E2, E2A by E3 and subsequent pay scales E3 by E4, E4 by E5, E5 by E6 and E6 by E7 was first item in the Manifesto of AIBSNLEA for the Membership Verification held in December 2016. AIBSNLEA strongly opposed keeping one Executive in E3 Scale for ten years consequent upon revision of E1A by E2 and E2A by E3 scales.    

 

JTO / JAO promotions will not end at the level of SDE / AO only but they will be promoted to the higher grades also. In view of this all the pay scales have to be up-graded as already accepted and recommended by the BSNL Management.

 

When AIBSNLEA is demanding up-gradation of scales up-to E-7 grade, how it can be unfortunate? AIBSNLEA has been demanding for the replacement of E1A by E2 and E2A by E3 but it cannot drop the demand of up-gradation of higher scales upto E7 grade since it represents all the cadres of BSNL executives.

 

In aforesaid proposal financial burden on BSNL towards perks & allowances of the executives would be bare minimum as the executives from the scales E3, E4, E5 and E6 would be simply placed to the next higher scale i.e. E4, E5, E6 & E7 and most of them will not get any financial benefit even of a single penny except those whose stagnation comes to an end. Hence, there would not be any cascading effect.

 

We therefore, just requested CMD, BSNL to insist upon DoT for approval of this proposal to resolve the problem once for all.

 

We have also requested BSNL Management to persuade for approval of the proposal of deduction of pension contribution payable to DoT on actual pay of an executive instead of the highest of his/her pay scale. This will reduce the additional financial implications on BSNL on account of pension contributions to bare minimum.

 

However, AIBSNLEA support will continue to AIGETOA for their struggle.

AIBSNLEA is celebrating its 14th Foundation Day on 1st May 2017. AIBSNLEA CHQ extends warm greetings to all the Members of AIBSNLEA and well wishers on the occasion.  AIBSNLEA was formally launched on 1st May, 2004 by merging of 10 DoT recognized Gr "B" Associations namely TESA (I), AFSOA, AIJTOA, AIPTCE (Gr.-'B'), AIPTEE (Gr.-'B'), AIJEA, AIPTAA, ABDRA, AITSA, BSNLEA. AIBSNLEA is in the true sense protecting the interest of BSNL Executives as well as of BSNL.

On this day, we recollect the sacrifice of the May Day martyrs. We pledge to carry forward their struggle to establish a Socialist Society, free of exploitation of man-by-man.

All the Circle / District Secretaries are requested to organize Special General Body Meetings, Seminars, Get-togethers, Blood Donation Camps, Telecom Melas etc. to observe the Foundation Day in a befitting manner.

Today  CS    , VP, ACS (Civil/Electrical) Com. Manoj Viswanath , ACS (Eng)  Com.Pushparajan and Com.Sahli met the new GM(Admin/HR) Shri.Sanjaykumar along with Erstwhile GM(A/HR) Shri. D.Mohan  today and discussed all the pending Service and HR issues. DGM(HR) Shri. James Sagayaraj and DGM(Admin) Shri.Satheesh were also there .

 

Pending Long stay request transfers for SDE/JTOs:

As per the request transfer list published by circle office there are 21 SDEs and 10 JTOs requested for their parent BAs or otherwise. We requested for only three points . 1) Long stay transfers for this year are to be limited for these 31 executives only provided they will complete two years attest on   30th September 2017 and transfer for the sake of transfer must not be there . 2) it seems that all the 10 JTOs on request are not transferred to the working SSA not on long stay from parent BA hence they have to be brought back in the same way as we have brought back all the 2014 LICE JTOs not by sending out JTOs in the long stay list . 3) while bringing back SDEs , SDEs are to be send out .

After long discussion with management , AIBSNLEA could make all the three points very much clear logically to the administration  and finally they have  totally agreed on all the three genuine points . So unnecessary any more transfer long stay transfer will not be there  this year from any BA in addition to the 31 transfers  provided they will complete two years attest on   30th September 2017 , as in the case of last year . Long stay list of JTOs will not be operated this year because of the logical reason that no transfer requested JTO was transferred out of parent BA on long stay. On third point Administration asked for the feasibility of sending out JTOs against SDEs . We categorically elaborated that only JTOs on E2 can be considered for against SDEs but here all the JTOs in the long stay list are having JTO service of less than one year only and even the normal probation period in JTO cadre is not completed yet. Management shared our view . The transfer orders are expected in the first week of May-2017.

 

Hurdle posted by Kerala Circle on JTO-Vacancy Calculation  in 50:50

We expressed out total discontent on the way Kerala circle treated the very favourable corporate office order for the benefits of more than 200 JEs in Kerala waiting for the JTO cadre. Only Kerala circle has raised some objections and this affected all other circles who have declared results. We informed management about the meeting Com.Prahlad Rai , GS AIBSNLEA had with Dir(HR) in this matter and Dir(HR) entrusted GM(Pers) to settle down the case without delay . GM (A/HR) informed that all the queries of corporate office in this matter were replied on mail.

 

We appreciated management in calling DE (LA) option from among all the executives in List 6 and 7 . All DS are requested to ensure all our members give the options. Later we met DGM/CAO (finance) and appreciated the timely release of request transfers in AO/JAO cadre as suggested by AIBSNLEA . Further we requested for taking  steps to start the Phase-II training of JAO 2016 batch and the process will be started soon.

 

Dear Comrades,

 

As every executive is aware of the fact that more than 90% of executives in Accounts/Finance department are part of AIBSNLEA . Now one association storming in front just after the release of the last AO/JAO transfer orders and trumpet that they are the only saviours of the executives in Accounts/Finance seems unsolicited. They further utters that now only transparency reaches into the mysterious underworld like activities carried within the  Accounts/Finance department of Kerala . Only they could expose/stop all the black activities have been carried out by AIBSNLEA with Management here in Kerala and save all the executives along with Accounts/Finance department. We appreciate that association for this revolutionary change , only they could made it happen , even though they had  done it out of utter frustration that they could not hold executives in  Accounts/Finance as they are holding in Engg department through arm twisting techniques through controlling officers in the name of APAR. 

 

That association uncared and kept aside all the  executives of  Accounts/Finance wing till REA are now   shedding crocodile tears for these executives . In how many BAs that association has DS/DP from executives of Accounts/Finance wing? What are the issues that association taken up at CHQ level for the benefits of these executives? How much blockages that association raised against  these executives from getting membership in Engineering society  for want of finance loan ? ....... ...... ...... What more , in the trailing  list of demands for the ongoing agitation , how many issues of  Accounts/Finance wing are projected by that association ?????

 

So , AIBSNLEA request that association to stop their inherent style of  “washing dirty linen in public “ , this is not fair to executive associations . AIBSNLEA has no dirt to wash out. But....  Furthermore, language and talents are not patented to one association alone.

AIBSNLEA supports AIGETOA agitation

 

AIBSNLEA has extended its support to the agitation of AIGETOA in view of the common demands for which we jointly struggled in the past under the banner of United Forum of BSNL Executives' Associations. The arbitrary notification of E1A & E2A intermediatory pay scales by DoT has lowered the status of JTO & SDE equivalent executives. Future recruitment of JTO & JAO will take place in E1 pay scale only. This fact was well known that DoT has processed E1A & E2A intermediatory pay scales then how the said Majority Executive Associations has allowed its notification. In the recent referendum of Executives' Associations, the so called "Majority Association" has been given all negotiation powers on policy matters concerning to the executives in BSNL. Hence, the "Majority Association" just after the notification of these intermediatory pay scales should have exhausted all negotiation channels in BSNL & DoT to get withdrawal of this notification instead of jumping into agitation directly. However, it is up-to them to take such decision. AIGETOA has preferred to align with the "Majority Association" for the settlement of HR issues leaving aside the platform of United Forum of BSNL Executives' Associations comprising AIBSNLEA, AIGETOA & AITEEA.

 

AIBSNLEA, eventhough is committed to support AIGETOA in their efforts for settlement of the genuine HR issues but AIBSNLEA can't be mortgaged to some associations. AIBSNLEA is struggling for getting limited Trade Union Facilities at All India Level/Circle Level & SSA Level with BSNL Management through court cases.

 

At present after the referendum process AIBSNLEA CHQ, Circles & SSAs are not mentally prepared for the agitation. In case the CHQ Office Bearers, Circle/District Office Bearers & Members are victimized by the management, AIBSNLEA does not have any recognized channel to save them.

 

In view of this, AIBSNLEA decided to extend its solidarity support to AIGETOA struggle. We extend our best wishes for the success of their struggle & settlement of HR issues through the ongoing path.

Due to our prolonged perusal,  Somehow in a piecemeal manner , Cirle office released the E4-E5 Time Bound Financial Upgradation orders for 164 Officers . Previous GM (Admin/HR)  assured to release the orders before his relieving but due to some compelling situations he has to relieve early and  informed that he will come back next week .This association will meet him again on Monday/Tuesday, while he comes to Kerala circle office. He agreed to pursue and update all the Service/HR issues raised to him by this association with new GM (A/HR) . We expect the release of SDE/JTO rotational transfer orders , release of remaining Time Bound Financial Up gradation orders   etc without much delay.

But, one association claims parenting of each and every order released by Kerala circle office is quite amusing

AIBSNLEA notifies for its 2nd Central Working Committee meeting after the 5th All India Conference Mysuru (Karnataka) to be held at RTTC, Trivandrum on 11th and 12th August 2017 to transact the following agenda:

1. Discussion and decision on organizational matters post Membership verification.

2. Discussion and decision on the issues of importance on service / welfare matters especially issues related to:

(i) Implementation of standard pay IDA scales E2 & E3 instead of intermediate E1A and E2A IDA pay scales for BSNL Executives,

(ii) CPSU Cadre Hierarchy and abandon of MTRR/DGMRR,

(iii) CPCs to fill up the  vacant CGM/GM/DGM (Eng)/DGM (Fin), DE/CAO, SDE(T)/AO equivalent posts,

(iv) Modification in MSRRs & Executive Transfer Policy,

(v) Notional Pay Fixation w.e.f. 01.10.2000 of JTOs/SDEs (C/E/Arch/TF) Engg. Wings and PA Cadre,

5. Discussion and decision on the relative activities of other Executive Associations and Non-Executive Unions.

Meeting with Member (Services), Telecom Commission, DoT New Delhi: GS, AGS (HQ) met with Member (Services), Telecom Commission, DoT New Delhi and discussed regarding the progress on implementation of the recommendations of 3rd PRC in BSNL. Member (Services) informed that the BSNL's comments in this regard with positive comments from DoT have been sent to Cabinet Secretariat for taking further necessary action. But, the further discussions in the Cabinet Secretariat are yet to be taken only after joining of the new Secretary (Telecom) in DoT.

Member (Services) informed that DoT has also taken-up the issue of IDA Pension revision of BSNL pensioners with 3rd PRC in Cabinet Secretariat. We appraised him that earlier also the pension revision of BSNL pensioner was delayed by two years and 78.2% fitment benefit is also delayed by three years. Now, BSNL pensioners demanding 78.2% fitment benefit from 01.01.2007 are filing court cases.

Member (Services) also mentioned regarding double pay fixation in the same scale under EPP has been objected by the CCA and the matter is under discussions. We pleaded that EPP was approved by BSNL Board and the DoT and thereafter the notification was issued. Hence, at this stage review of EPP will cause serious resentment among the executives of BSNL. Member (Services) assured to look into the matter in case if it is routed through him.

Meeting with Director (HR), BSNL Board, New Delhi: GS, AGS (HQ) met with Director (HR) and discussed regarding:

(i) Additional facilities to AIBSNLEA: We requested for grant of special CLs to the office bearers of AIBSNLEA for attending organizational activities and smooth functioning of the Association. Director (HR) assured an early action in this regard.

(ii) E2 and E3 pay scales for JTO and SDE equivalent cadres: We requested Director (HR) to take up the matter with DoT to withdraw the OM dated 28.03.2017 on E1A and E2A pay scales notification. Implementation of intermediatory pay scales E1A and E2A are lowering the pay scales of the executives without any penalty imposed. It has also degraded the JTO and SDE equivalent cadres of the executives. Since future recruitment of JTO/JAO will be in the E1 IDA Pay scale only. Director (HR) mentioned that she tried to discuss the matter with Addl. Secretary (T), DoT but he is on leave. She also discuss the matter with PS to Hon'ble MOSC (IC) wherein he clarified that the proposal sent by BSNL/DoT has been approved by the Hon'ble MOSC (IC). However, she will try to discuss the matter with Secretary (Telecom).

(iii) Pay fixation initially at Rs. 22820/- of the JTOs and equivalent cadres recruited post 2007: We requested Director (HR) for the settlement of this pending issue delinking with E1A and E2A pay scales. Director (HR) mentioned that Smt. A. Panda, PGM (PF-II) committee report was studied and some clarifications have been asked from the committee Chairperson. She assured an early action in this regard.  

(iv) Conduction of CPCs: We expressed our serious concern against the non-holding of the CPCs in almost all the cadres which have been stalled in the name of pending court cases. It has caused stagnation in the career prospects of executives. Director (HR) appreciated our concern and mentioned that tomorrow she is going to meet with Sr. Advocate Sr. R.D. Aggrawala to find a way out to conduct CPCs in view of the urgent requirement of BSNL and pending court cases. We requested Director (HR) to discuss the Kerala High Court issue also with the Sr. Advocate wherein the hearings are completed and the judgment is kept reserved. Director (HR) assured to discuss this issue also.

(v) Implementation of CPSU cadre hierarchy:  We requested for the implementation of CPSU cadre hierarchy as recommended by the Khan Committee. We also expressed our anguish against the burring of Khan Committee report by the Pers. Cell and drafting a new CPSU cadre hierarchy up-to SDE level only by introduction of MTs. Director (HR) mentioned that the new draft proposal prepared by the Pers. Cell has been agreed by SNEA(I), the Majority Association. However, she assured to direct PGM (Pers.) to discuss the matter with AIBSNLEA also.

(vi) Method of vacancy calculation for the cadre of JTOs: We expressed our concern against keeping in abeyance the orders earlier issued by the Estt Cell of BSNL Corporate Office in respect of Punjab circle and other circles. PGM (Estt) who was also present in the meeting explained that Kerala Circle has raised some queries in this regard referring DoP&T instruction on SC/ST carried forward vacancies and Pers. Cell letter issued in the year 2013 on creation of PA cadre posts. After examining the Kerala Circle letter it was found logical and on that basis immediately the said clarification was kept abeyance till the matter is finalized. Director (HR) directed PGM (Estt) to discuss the matter with PGM (Pers.) and take the written clarification in this regard at the earliest to resolve the issue.

(vii) Non-consideration of request / immunity ground transfers in the Finance Wing: We expressed our serious resentment against the non-consideration of request / immunity ground transfers in the Finance Wing. Director (HR) assured to discuss the matter with GM (FP).

CP , CS , CVP, ACS, DS TVM met PGMT(F) Shri.KK Vel and discussed all the pending HR /Service matters. The discussion was very fruitful. We requested to release the request  transfer orders of AO/JAO  without delay and are PGM F assured to speed up the matter . The orders are expected in next week.

CP , CS , CVP, ACS, DS TVM met DGM/AGM(HR) and discussed Service/HR matters. We requested to issue long stay rotational transfer orders of JTO/SDE on one to one basis only , no long stay transfer orders are to be issued for the sake of transfer alone. Administration assured to look into all the suggestions.

Regarding the calculation of  JTO Vacancies in 50:50 ratio for internal, and external quota by considering carry forward and generated vacancies, we expressed our discontent that only Kerala circle has raised some queries due to which  BSNL Corporate Office issued instructions to keep the letter number 6-1/Gen/2016/Estt-IC dated 15.03.2017 in abeyance till further orders on 12-04-2017. This kills the promotion  scope of more than hundreds of young talented JEs in Kerala , at least for time being . We further informed that our GS  is behind vacating stay of this order and positively tomorrow GS will meet Dir(HR) in this regard. Kerala Administration appreciated and shared our concern . They  informed that some more clarifications sought from corporate office towards this vacancy calculation methods   and Kerala circle submit the details today or tomorrow.

Active support of AIBSNLEA to the agitation programmes being launched by Joint Forum of BSNL Executives' Associations :

AIBSNLEA extends its its active support to the agitation programmes being launched by the Joint Forum of BSNL Executives’ Associations in view of the common HR issues of Executives raised in the charter of demands as the settlement of the important issues is more important rather than the credit who so ever takes it.

Further, at this juncture, AIBSNLEA suggests to have a single Executive Association by merging all the existing Executive Associations in BSNL. Single Executive Association will have a great strength and bargaining power to impress upon the DoT Administration as well as BSNL Management and to provide a safe umbrella to the entire executive fraternity of BSNL. This concept is available in many PSUs.

Many representations had been sent by these officers to DoT for regularization. DoT informed them that adhoc services would be regularized once new Recruitment Rules were framed.  Accordingly new RR was Framed by BSNL in 2002 which contained a special provision  that all the vacancies in the grade of AD(OL) in the first year of recruitment irrespective of vacancies earmarked for promotional/ direct quota would be filled up by promotion on Seniority Cum Fitness basis from the existing adhoc/officiating ADOLs in order to avoid legal complications. 

 

Accordingly an All India Seniority List of AD(OL)s was published by BSNL and circulated among all the officers in the list. Without making even a single promotion/regularization based  on the  RR 2002, a new Recruitment Rule for AD (OL)s was framed in 2005 (RR-2005) which envisaged promotion to all the vacancies through a LICE.  Affected by the above , 11 existing AD(OL)s approached the honourable CAT, Ernakulam which directed BSNL  to promote existing AD(OL)s in accordance with the 2002 Recruitment Rules.

 

BSNL subsequently approached the Honourable High Court of Kerala to stay the  CAT judgement  But the Hon.High Court refused to stay the CAT order, but directed BSNL  to give promotion as per RR 2002.

 

Then BSNL filed an SLP in the Hon. Supreme Court of India requesting to stay the High Court Judgment. But  the Supreme Court  refused to interfere with the impugned judgement of the High Court and dismissed the SLP on 27-03-2017

         

          Since in CAT , HC and even in SC the arguments of these righteous people are honoured, we request your goodness to kindly intervene  in the matter once again to avoid further hardships  and to take up the matter with C.O. authorities so that they will be regularized as AD(OL) and thereby  justice will be granted to these unlucky comrades after  22 to 24 years.

1.     They could release presidential orders for Killing standard Pay Scale E2/E3.

2.     They could recruit DGM (T and F) from open market blocking carrier prospective of BSNL executives.

3.     Not interested in internal promotions on JTO-SDE , SDE-DE , AO_CAO etc but by neglecting internal experienced stuff they strive hard for bringing in inexperienced outside  DGM etc..etc... in the very short span of time.

 

Simply they can’t wash off their hands by showing some gimmicks , It is accountable

The first CEC of the Seventh AIBSNLEA Kerala Circle body is Successfully completed today at AIBSNLEA Bhavan at Palarivattom , Ernakulam . All members of CEC gathered in full strength and very active and full participative discussions were carried out on Service, HR and other matters . For addressing and settling Service, HR and other issues, separate committees were formed with individual convenors. All convenors are asked to submit the progress of their assigned area of performance timely for further reviews.

 

CEC discussed the modality for the very successful conduction of the AIBSNLEA Central Working Committee meeting at Trivandrum in the month of August preferably at RTTC Trivandrum. Com.V. Rajan , DS TVM is unanimously chosen as the convenor for the same.

 

CEC starts at 10.30 AM and completed around 6.00PM with a lunch break of only 30 minits . Com KNM Nair DS EKM extended welcome  and CFS   Proposed vote of thanks to the members. The CEC was very fruitful.

DS TVM reports that Anomaly in pay fixation of JTOs (erstwhile officiating JTOs) settled in TVM BA

              

              In TVM BA, the wrong pay fixation of JTOs (erstwhile officiating JTOs) has affected considerable reduction in the pay of many JTOs.   This  was due to  the non implementation of corporate office order No 250-51/2002-pers III dt 24.9.2008 regarding pay  up gradation  of  TTA’s. AIBSNLEA has taken up this issue immediately with administration. Asst. Circle Secretary Com.Pushparajan JTO, DS Tvm  Com. Rajan.V.V.and ADS Com .Suresh kumar.V JTO  met Shri. ShyamKumar.M , DGM(F) TVM BA and discussed in detail about this anomaly  and administration finally agreed to implement the order  w.e.f 2000.

 

But one Sister association  has brought up and twisted this  issue with some other matters no way related to TVM BA  and tried to create total misunderstanding among the affected executives with ulterior motto.  AIBSNLEA TVM Branch extended their sincere thanks to SSA administration for accepting all their suggestions and for the assurance given on speedy settlement of this anomaly.

Today , CS , VP and team of representatives of Candidates for JTO VY 2015-16 headed by  Com. Renjith Kaladharan met GM(Admin) and demanded for the release of JTO Vacancy Calculation details as promised to this association . GM replied that some more clarifications are needed for Kerala Circle to release the vacancies in 50:50 ratio. We expressed our total discontent in handing the matter by Kerala Circle and asked to send the clarification letter today itself to Corporate office, if so . GM agreed our demand and meting discontinued for preparing the clarification letter to corporate office . Later meeting restarted at 5.30 PM after sending the letter to corporate office . On our request GM revealed the content of the letter .

 

We express our sincere gratitude to GM Shri.D Mohan and his team of officers with him today  ( Shri.James Sagayaraj –DGM-HR , Shri. Satheesh –DGM-A Shri.Girija Nair SHE-HR ) for the hectic efforts taken to prepare the letter in short time and send to corporate office today itself.

At the outset, we congratulate you for the untiring efforts to release orders from corporate office for the clarification in calculating JTO Vacancies in 50:50 ratio for internal, and external quota by considering carry forward and generated vacancies.  We once again draw your kind attention and favorable consideration for the clarification sought by Kerala circle, vide Letter in Ref:1, to Corporate office Estt Section regarding which method is to be adopted to calculate the internal JTO(T) vacancies in Kerala Circle from VY 2013-014 to VY 2015-2016.

 

Even though some circles like Punjab already implemented Letter in Ref:3 for the calculation of JTO vacancies and already send the successful candidates for JTO  training , Kerala circle still doubting whether Kerala has to follow letter in Ref:3 or  Letter in  Ref:2 for calculating vacancies.

 

Apparently letter in Ref-2 is the CO order from personal section to Kerala circle dated 14 Aug 2013 is   purely for the PA/PS cadre  which  implies that carry forwarded vacancies are kept as such and only newly created vacancies in each vacancy year should be divided in 50:50 proportion.

.

Letter in Ref-3 is the latest order dated 15 March 2017 from Corporate office Establishment section to all Heads of Telecom circles  implies that total vacancy taken as  (aroused vacancy in each VY + carry forwarded vacancy) and divide in 50:50 proportion.

 

Kerala circle now unreasonably feels Ref-2 and Ref-3 are in contradiction to each other and hence Kerala sought further clarification, unnecessarily. Earlier Punjab circle sought clarification for vacancy calculation method to be followed and in that they are elaborated all the consequences of 50:50 method vide Letter in  Ref-4 dated 28 Dec 2016. Corporate office disagreed with the Punjab circles’ concerns and asked to submit an illustrated vacancy calculation vide Letter in Ref-6 dated 16 Jan 2017. Subsequently Punjab circle had submitted the illustrated vacancy calculations vide Letter in Ref-5 dated 6 Feb 2017. Later CO directed to adopt the method 2 which is total aroused vacancies added to carry forwarded vacancies and divided in 50:50 proportion vide Letter in Ref-7 dated 7 Feb 2017.

Finally , after receiving several queries and representations from various circles only , corporate office issued the order vide Ref-3 dated 15 March 2017 closing all the apprehensions with an example to calculate the vacancies in 50:50 format . This only Kerala circle challenged again.

 

Hence, we request your great leadership   to  take this matter also  at appropriate levels thereby directing Kerala circle to accept the method specified in Ref. 3 dated 15 March 2017 .This would be a great leap to accommodate all the 196 well qualified aspiring candidates for VY 2015-16 in Kerala circle  .
